Man sued for defending his home

They litter his land, vandalize his property, kill his cattle and threaten the safety of him and his family. And then these trespassers are allowed to sue him? MALDEF should be forced to pay not only the court costs, but all damages Mr Barnett has incured since they want to represent the group that caused these damages and choose to support people that are breaking out laws.

Just when I thought I heard everything, something like this comes along. This is absolutely scary. It is so wrong! My husband is going to law school and only has 3 more years. He wants to be an attorney to help victims and to get justice for them. He says our justice system needs a complete overhaul.
Now that we now who these illegals are because they have the nerve to sue an honest man, I wonder if this man can turn around and sue them. He should sue them for making him have to carry a gun and have a dog for protection on his own property. I bet they have caused so much stress in his life. Only problem is.......they don't have money to sue for. Maybe they could work it off by building a fence.

Makes no sense, but then again, there have been cases that even legal citizens that break their leg while robbing a house has sued the homeowner.

Outrageous!!!! This has no bearing on whether they should have the same rights that American's do because as an American I have the right to defend my property and if they want to use our laws against us then they should be locked up for trespassing and intimidation. Then hopefully he counter sues because of the emotional and financial burden the illegal aliens crossing his land are causing him! I really hope the jury sends a statement out along with a not culpable verdict...something to the effect that if you want to use our laws then start first by obeying them!

Hmmmm, now. Maybe it's karma? Remember when the native americans and black people had their land stolen? Their wives and children stolen, hung and/or murdered.?

oh give me a break! what black people had their land stolen ? and as a historian, very conversant in this area, I have never heard of female slaves hung in labor....could you post a source, please ?
And since when should an American land owner have to bow to ILLEGAL immigrants !!??! We have no one to blame but ourselves if we sit back and just post on a message board and dont take action !! This is going to eventually effect everyone that posts here if you let it......

I agree absolutely! And I also hope that the jury awards damages right then and there with no need for a countersuit. If the illegals can afford to sue they (and the organization promoting this suit) should be prepared to pay the judgement when the case goes against them. This should not cost this landowner one penny! Damages should include the cost of cleaning up his land (yuck!)

Are you self sufficient in that way? If so, good for you: most of us don't have that option.
We need to support farmers not make life more difficult for them. We need them. I'm grateful to them every time I go to the market, aren't you?
Or what is your plan if we all decide to agree that farmers don't own their land?

Silliness.
This rancher never stole the land, never gave out a blanket infected with pox, never stole a wife or a child. He bought land, worked it, made something with it, and just like the native American who had their land invaded by us, he too has a right to sing the blues.
I'm married to a native American - I can tell you this for sure - they know what it's like to have your land invaded, taken over by those who don't care for your rights to your land and homes - and they sure as heck don't want it to happen again! He's as much or more against illegal immigration and this kind of garbage as I am.
But this reads like silly junk, so I'm no doubt wasting my time.

Anyway though - I hope he countersues. They should have to put up a bond to sue him, to show that they can pay his full attorney costs, court costs, and time, plus a punitive penalty, if they lose, if this is ruled frivolous.

I must have missed in the article where he did these things. Would you like to point it out? Or do you just think all people should be held accountable for what their ancestors may have done? Then again, you have no clue about them either. Better to babble than put up a real arguement for whatever you're trying to prove?

I did some searching and could not find anything specific to hanging slave women while in labor. There are plenty of atrocities out there, but the only killing of pregnant slaves or babies after delivered I could find were by female owners who suspected the child may be her husbands.
Many disgusting things happened in those times. But again, how can they be connected to this man? On the basis of his skin? I'm half German so does that make me responsible for the Holocaust?

I love selective history.
I challenge anyone to name one group of people that have not been victimized.
Is it just that it is not PC to mention the abuse of the Irish, Chinese, as well as other poor Europeans, that came to this country as indentured servants?
Is it not PC to acknowledge that there was violence and war between Native American tribes? That slavery was also practiced in Africa, that human beings have abused and enslaved even those of there own 'race' all over the world.
And where is this 'karma' for the Spanish that conquered many territories, and 'converted' Native Americans to their faith through torturous means?
I guess those facts don't matter because it does not fit the agenda.

I will be glad to recant my disbelief if you can give me a "credible" link and a provable story.....I have seen many things that have been put out there to try and make a story better that were later proved to be wrong.
Slavery is going on in Africa today. Black against black. They had a huge story about it in either the Smithsonian magazine or the National Georgraphic within the last two or three years but I have never seen that put out there in a big way. Slavery happened in this country, just like it has since time beginning. It wasnt right but it happened. Unfortunately, some people have made it a way of life to relive it on people who had nothing to do with it.
And, you are so right. The Spanish wiped out whole populations with cold blooded murder. The first island that was landed on in the New World, the people were enslaved and killed and completely wiped out. The Mayans, Incas and Aztecs enslaved other people, murdered them and then the Spanish came along and went those guys one better.
I hate revisionist history and people that are not really that educated about a subject making unfounded and blanket statements. JMO.

He was convicted on 2 counts and ordered to pay more than 77K - and 60K of that was punitive. He didn't violate their rights - but he was convicted of assault and of causing "emotional distress". Please! What about the emotion distress these people cause this man? He is appealing.

I don't understand to whom you are referring or how the next comment makes something disappear. Now that we have settled a little confusion about posting about this case we can move forward.
I hope we have someone in a position to continue to follow this case and let us know how the appeal goes. Meanwhile it would be great if the rancher could hire the recently released border guards Ramos and Compean. Perhaps the organizations supporting the illegals would suggest they take another route and avoid this man's property in future.

I have to say that I emphatically stated that I had never heard of hanging slave women in labor....and I havent or could I find any mention of it when googling the subject. Having said that, I was reading some history about Virginia recently and did find that there was a law on the books for many years that slave owners could hang pregnant women though it wasnt done because slaves and their live offspring were valuable to the owner. OT but wanted to qualify my previous statements to the poster.

Indians were killing each other over land here and slavery was taking in place in Africa long before we caucasions ever were part of it. That's not cool to point out, though. Apparently the mantra of the pc crowd is, "White people-bad. Everyone else-good". People in general have had a history of not being nice to each other. We're never going to get past that by ignoring parts of history while selectively acknowledging others.
