Mother Gets No Prison Time for Murdering Her Child

PHOENIX -- A judge sentenced a west Phoenix woman to lifetime probation Tuesday after she admitted to starving her 2-year-old daughter to death.
Eboni Perri, 26, had earlier pleaded guilty to charges of attempted child abuse.
Her daughter, Nakeisha Walker, was pronounced dead at a Phoenix hospital on March 5th, 2005.
She weighed only 14 pounds at the time.

I dont understand the sentence. Why was she not put in jail ? Should I just read a link ? This is strange to me. Poor baby.

The link will not work, but I did search around for others. She was plea bargained down!
No jail time to begin with is, IMO, a travesty of justice, as her act was hardly homicide by misadventure. Serve some hard wake up time, then permit probation, if they go that route.
AZ's statute:
13-1105. First degree murder; classification
A. A person commits first degree murder if:
1. Intending or knowing that the person's conduct will cause death, the person causes the death of another person, including an unborn child, with premeditation or, as a result of causing the death of another person with premeditation, causes the death of an unborn child.
The cuplable mental state, or mens rea, is crucial here. It seems the Prosecutor did not feel he or she could prove she "knowingly" committed an intentional murder, as gradually starving a person does not necessarily they will die in a specific time frame?
Very very tragic case for the poor little child, and as oneup profoundly posted, the child is with the Creator now.

It sends a strong and wrong message that our babies and little children don't get equal justice in this country.
There is nothing so unforgivable to me than a mom or dad who neglects, abuses or murders their own child.

I'd assume that socail services would be making frequent house visits if she were to have other children.
