Did he say the father was abusing him? Alot of kids get very angry at their parents at that age.

"The state's Children, Youth and Families Department reports that state officials received nine calls regarding the family on a department hot line used to report possible child abuse or neglect. Officials substantiated only one claim involving the boy's mother."

Could this be claims that were against the mother and that is why he had custody of them?

I guess it sounded to me that the abuse happened between the father and mother. I shouldn't speculate, I'm sorry. I just don't get this? I am also sorry that I put this on breaking news, it sounded like it was breaking news on the Fox website. CW can delete this is she wants. Oops.

This shooting happened 8/27.

BELEN, N.M. -- Belen police have charged a 10 year-old-boy with first degree murder in the shooting death of his father.

Police said officers responded to a Valencia County home after getting a call around 7 p.m. Thursday from 10-year-old Benjamin Hilburn.

When police arrived, they found 42-year-old Bryon Hilburn shot once in the head. Police believe Benjamin used his own rifle to fatally shoot his father.

The boy reportedly told police he felt his father was disciplining him too harshly and too often.

Hearing that 911 audio is heartbreaking. So very sad. Now this boy will have to live with this the rest of his life and from the 911 call it sounds as if he will be affected by it. :sad:

Isn't it strange how we each interpret the same statement. I took it to mean 9 times Childrens' Services were called, eight against the father and one against the mother...all 9 were abuse or neglect of the child. hmmmmmm

Well..I'd interpret it as you have. And, I'd wonder if the mother wasn't being abused as well? Perhaps..they came there..and only Mom was home...and she's suffering from things in the home with the father..so she is charged that time?

I have lots of hope for this particular child. He seemed genuinely full of regret and remorse, called 911...etc... 9 Calls to CPS...... Unlike that 8 year old that laid in wait and shot & killed his own dad and lured another man to his death....then lied about an alibi and described a "getaway" car

Yes it is strange but it often happens. lol

How I interpreted it is DCS had 9 anonymous reports made but only one could be substantiated (by DCS) and that was against the mother.

I'd like to know how the justice system can charge a 10yo child with murder -- a person who just understands truth from falsehood (experts say that begins about 7yo), never mind understanding how wrong or how permanent murder is.

A 10yo has an adult IQ of about 56 (=10yo/18yo). Would they try a man with a 56 IQ, or would they declare him guilty by reason of insanity?

We never had anything like this years ago. I think we can all blame the glorification of violence in entertainment (movies/videogames) and in parents not raising their kids like they used to. I guess this kid found out the hard way that you can't start the "game" over again in real life.

And, regarding the only abuse found against the mother ... if one parent is abusive, then oftentimes, the other one is also abusive.

He's not being charged as an adult.

I have little faith in Child Protection Services ability to actually keep children safe. Just because the allegations made in those calls were found unsubstantiated doesn't mean nothing happened.

10 year olds should not have access to guns, they can't drive, can't smoke, they can't drink, they can't gamble, but they can kill, makes no sense - jmho
