I think his repeated assertion that there were only 1 shooter with an assault rifle was arrogant, his star witness has said from day 1 there were 2 men firing at him with assault rifles, and just because he found no evidence he has decided only 1 shooter with assault rifle, thus telling the jury that the star witness is a liar,

I am not sure if it was just his demeanor I missed some of his testimony..not sure how everyone else feels.

They knew what had happened almost immediately, that a young girl was dead so they knew they had to get rid of them, if it had stayed just a shoot out between two idiots who thought it was the only way to deal with someone you had a "beef" with they would have probably kept the guns,

if he was only interviewed a couple months ago, as a mother i certainly couldn't remember if my son was home on a certain day that long ago...no matter what had happened on that day...

Something just struck me...If there were 3 shooters, as LeRoy and DD say...and 2 of the three were firing on LeRoy..Wound it have been LeRoy who was actually shooting in self defense?..

I guess thats the thing I am not buying..LeRoy shooting first..

From the evidence I heard, LeRoy walking down the runway..as described by "Mr' Entertainment"..and DD was on a porch..and was described to have yelled to LeRoy while walking away, D walks off porch carrying his AKA..and aproach LeRoy ( no one described LeRoy approaching DD on his porch)..then bullets started flying...LeRoy ran away, and DD rn into house and dumped his AKA with or with another person....

I Apologize if this conflicts with some who believe just because coming to that complex (LR that is) was alone was enough intimidation to provoke this shootout..Anyway, I just dont buy that..

only one person saw the shootings who has testified, the female witnesses who was scared, she said she saw redrock fire first, but she has withdrawn that statement and now says she did not see the shooting, so the jury will have to decide if she was telling the truth initially and is now withdrawing her testimony under duress, the other witness who saw 3 shooters did not see the actual shooting only the aftermath,

so all the jury have is one witness who says she saw shooting now says she did not, they also have one wit saying 2 shooters, and 1 saying 3 shooters, once again jury has to decide who is truthful,

I think the jury is going to be questioning why the state is believing only parts of yellow man's story.

To me that means the rest of ym's story is lies and he should have to go to trial.

Insession was talking about the next trial. It is in MISSISSIPPI, not MI - no wonder I could not find anything about that trial the other day when CW first posted the locked forum.

I say could have 3rd man DNA evidence on them, if there is a third man then he needs finding and arresting/charging, as he seems like the other two to be trigger happy, and he may feel the need to settle other scores with his gun

I heard in court that the prosecution will have rebuttal and the judge told them to have their witnesses ready by 2pm tomorrow. The judge also told the jury to be there 9:15 am if I remember correctly. So I do not know what is going on first thing in the morning.

I am not sure if the closings will be Tuesday or Wednesday. I best guess the jury will get the case to deliberate no later than Thursday.

I am not sure if there are any lesser charges included. If this is a straight all or nothing on 2nd degree murder, this could end up a hung jury. jmo

I might be way off on my take on the Darling case (I haven't been watching as diligently as I usually do), But I think there were three shooters, and I think it doesn't really matter whose bullet killed that sweet little girl. They're all responsible, imo.

The new MS trial looks very interesting.

I agree on the three shooters and all are guilty. I am just not sure if it should be 2nd degree murder. I am not sure if there are lesser charges included.

Yep RB I see it's from above. But I have to say, if I saw this photo I could say, hey that's my neighbor! :eek:
I thought the jurors were never to be photographed. Defense could call for a mistrial.
I've never done this before now there are two trials on at the same time ttv is covering both lol!
Thanks for all the updates they are super helpful to read, these links on the case prior to. It is helpful to have the backstory and I like to read the local links too to see what the community is thinking!

Thank you! Leaving this as resonable doubt! I am not sure if I could convict someone even knowing this guy is gulity as sin,that lingering thought would haunt me. This case is disturbing eneough, the fact that they were also filiming a reality tv show and adding fictious dramatic effects for more dramtic tv is disgusting, my heart go's out to Shey's family.

From what I understand, the judge is still deciding on some of the lesser charges included for this defendant.

Thanks, jury may discard the stand your ground on the premise that he was committing a crime by having the assault rifle during the incident,

stand your ground can be nullified if the one standing there ground is committing a crime

This Judge looks and sounds very familiar...Was it in another case..or has she appeared on a TV Crime show as a TH?...She certainly does enounce each word very clearly..

Listening to these instructions..I find it very dificult to find anything that excuses him for firing his weapon...??????

I am on the other side of the fence. I think Yellowman came to the Pork n Beans with a get away driver. I think that Redrock acted in self defense. According to the law in the State of Florida, I believe that Redrock acted in justifiable self-defense. I did not feel this way at the beginning of the trial, but I do now. jmo

I most respectly have to disagree my friend Root...I have been listening to these instructions...and I have not heard anything that excuses Master Darling..LOL.In fact she broke down the stipulations that would justify Damon to even have access that gun and to fire it....Since from testimony LeRoy was witnessed to walk down that "Runway: (LOL) and it was DD who yelled ofter LeRoy....seen carrying his AKA..before any shots were fired....then for myself..it would have been rather stupid for LeRoy to start the shootout...Course that is only my take...

IF, as you believe DD gets off on this charge..then it will be a "Green Light" for all these thugs to just shoot and claim self defense later..and the LE and DA have to prove "Who shot when and why"...I doubt society can swallow that premise....I really dont believe this jury would justify DD for what he did...

Time will tell I guess..:wink:

Judge told lawyers to leave their cell phone numbers and to stay near by in case of any jury questions. Otherwise, the Judge will not bother the jury until 7:30 pm to see how they are doing. Dinner was there ready for them when they left to deliberate.

I would agree with you except for one fact. Red Rock is a convicted felon on parole & because of that he is not allowed to possess or fire any kind of weapon much less an AK47. The stand your ground statute clearly states the person has no duty to retreat, may meet a threat with similar force (even deadly force) if he/she is not engaged in any kind of illegal activity. It is illegal for Red Rock (& Yellow Man for that matter) to have weapons in his possession.

They cannot use weapons if they are convicted felons, that is illegal in Florida. Both men are convicted felons on parole.

Actually, when the judge was reading the law to the jury, there were exceptions to that. Even ex-convicts can defend themselves.

Not while they are on parole, they cannot have weapons in their possession---period. And the only way for an ex con to be able to possess weapons is to petition the board of pardons & parole to life that restriction but that can be done only after they successfully complete their parole. Yes ex cons can defend themselves but without weapons.
