Good morning Everyone! I need to re-look at all those Motions with a fresh mind this morning.

I sure got a chuckle yesterday, when reading the defense's Response To State's Request On Discovery. Macaluso, perhaps has an imagination that matches or exceeds Casey's. Who would have thought? (Or did he just blatently go before the court and spew lies?)

Good morning everyone!
Well, I had my daily chuckle reading the motions. :w00t: What a bunch of nothing. Judge Strickland already ruled on some of the motions and it just seems that AL is cluttering up the court's time again. She promised more motions, but I had hoped that it wouldn't be silly motions. I had more hope for her expertise than that. Looks like we just have another "Huge Waste" onboard to my way of thinking from what I see here. Oh well, it won't take Judge Strickland long to rule on them and also point out that he has already ruled on some. JMHO

Joy Wray is their ace in the hole??? Okaaaaaay..... How's that workin' for ya Jose????? :D

I'm starting to wonder if Lyon is intent on making sure that Casey is being represented by a death penalty qualified attorney, and is intent on somewhat starting over ...thus why we are seeing motions that are covering a few of the same issues that were already ruled on by the court when Baez was in charge.

Did they actually read the witness statements? In the motin to dismiss http://www.wftv.com/pdf/20972702/detail.html on page 7 they list under statement of facts Joy Wray searched the woods, the Fox News crew film from August 5 that was re aired on Greta's 12/17/08 show, Roy Kronk call in August, Keith Williams and TES.

I posted a breakdown of Wray's statement to LE on yesterday's thread. http://boards.insessiontrials.com/showthread.php?p=13486116#post13486116

Keith Willams told LE on page 25 http://www.wftv.com/pdf/19342403/detail.html
"If it was in the brush then that makes sense why I didn't see it then."

FOX News report on Greta can be viewed at http://www.youtube.com/watch?v=_gNJdDjZrgg The report states they believe their reporters were 25-30' from where they (the reporter) believes Caylee's remains were found, the film shows no water on the ground and there was no odor of decomposition. August 5 was 7 weeks after Caylee disappeared. IMO, there would not be an odor after 7 weeks of being exposed to the weather, heat and scavengers.

Roy Kronk's interview with LE has been beat to death. The motion states LE searched the area. IMO, the street cop failed to investigate Roy's call in August thoroughly.

TES has said several times the area was not searched because of water.

The motion mentions Heat, bugs don't deter Caylee Anthony search volunteers http://www.orlandosentinel.com/community/wintergarden/orl-caylee0808sep08,0,2181449.story IMO, the area searched in that article is not the same area Caylee was found...well according to google maps.

The article also mentions David Lohr posted on his website an article about seaching with TES on 9/7/08. "they (TES) were in the process of completing a thorough sweep of the area. See Appendix E." I couldn't find David Lohr's article or Appendix E, so I am not sure what area Mr. Lohr wrote about.

Just a reminder...when listening to the Fox video...we had a very dry summer here until Hurricane Fay hit in mid August. I can not remember the exact day, but I think it was August 15-16 around there.
If he was searching in that area the first part of August, it would have been very dry. If he had been there filming later, there would have been a different story to tell.
I think by early August, there was not enough of little Caylee to have any kind of odor and to the naked eye in the middle of all the trees and brush, she would look just like all the other garbage that had been tossed there.:(

Not until after January when the book is out...that's for sure.
She could not buy this kind of publicity. Millions of people are seeing her name, hearing about her..getting to know her.
This is a gold mine for her..and all she has to do is stay with the case.
Well, not all she has to do, she will have to get the fact that she has a new book coming out.

Lyon states in her Motion to Dismiss:

16. "Without access to crime scene before the State removed the remains and topsoil, Miss Anthony was unable to gather evidence regarding the precise arrangement of the remains and the surrounding landscape. Without this evidence, defense experts cannot effectively examine or challenge the conclusions made by State experts."

17. "By destroying the crime scene, the State has prevented Miss Anthony from gathering evidence to challenge the credibility of those witnesses who will describe the prior searches as well as those who ultimately discovered the crime scene."

18. "The State has excavated the crime scene and dismantled the remains so as to effectively prevent Miss Anthony's access to exculpatory evidence. "

---------------------
Didn't Macaluso specifically state in front of Judge Strickland that the defense has discovered "exculpatory" evidence?

OT but not really:
Had a flash flood here last night pretty nasty. Car went into ditch Mom and young son inside. The water was moving around us fast and sucking the front end of the car further down into the ditch. We had to get them out through the car windows. They are ok the car is totaled.
The mother was hysterical trying to get her and her child to safety.
There were 3 of us trying to get them out. The front seat was flooded up to the window ledges.
As one of the guys climbed on the window ledge to grab the son I was pulling him as he was coming out. The guy then crawled across the hood to help that man pull the mom out.
If it were not for these two guys I do not know what the outcome would have been.

Ordinary people doing extrordinary things. The searches for Caylee, the donations of food & water to help the searchers keep going to find Caylee
Donations of money to help cover expenses and equipment.
LE spending countless hours trying to find a nonexistent person.
The defense team.. I just don't know how they sleep at night knowing that everyone was doing everything they could to find Caylee and was praying for a good outcome. Now the defense wants to trash their names and shame their efforts. Shame on them!
I understand that Casey should get a fair trial we are living in America but, when I read about Silly motions being filed and the court system having to take their time and talent to wade through their nonsense it is maddening.
A fair trial to me means the truth and nothing but the truth. Shaping lies to fit the story is just messed up. I am ranting I know!

I have never heard of a Sheriff's office investigating and processing a crime scene to let a gaggle of Defense lawyers in to compromise the scene. Baez and AL are living in a parallel universe with the tot mom. Jeesh, what a WASTE they are! :w00t:

Defense attorney's come in after a crime not before. Maybe Casey can read that paragraph from one of her many law books she studies to Baez during their next little (romp) I mean" visit."

Thanks, I react calmly while something is happening, when everything is over I lose it. I was so scared the car was going to go completly under before we got them out.
All the mom was saying get my son, get my son.
That is how a Mother reacts.
That was all this woman cared about was her son getting out.

It's the only way to make his mark when you have someone so guilty as Casey and the rest of the Anthony's.

I did expect more from Andrea Lyons though....thought she was the end to all...when it came to DP cases?

She looks like she is grasping at straws here

Yeah, when she first came on the scene all the hype was "she was to be feared" then I read up on her and found out she has no more scrupples than Baez.

One can accomplish anything if they have the right tools: Baez & Co.. just don't have anything to work with. jmo

And I think the same way. The truth is what we are after, not new and ingenious ways to twist a lie. Those at the crime scene worked tirelessly for days searching through the heat . They searched every inch of that area in the hopes of recovering all of little Caylee's remains. To even insinuate that they were covering up something, or not acting correctly is a direct slap in their faces.

here's my question - on one hand, the defense says the state destroyed evidence so no clear determination can be made as to when caylee's remains were placed in the area they were found. on the other hand, they state that caylee's remains were placed AFTER kc went to jail.

The City of Orlando Public Works, http://www.cityoforlando.net/public_works/Stormwater/rain/rainfall.htm reported June 2008 7.95", July 2008 9.14", August 2008 12.98" and September 4.09" of rain.

I agree re Caylee's remains. I think by the time August rolled around, her remains would have had very little soft tissue left. Unless a searcher actually ran across a rib cage or skull, I do not believe they would have recognized her tiny little bones scattered in the woods. Her bones would have been discolored by the environment and look nothing like the skeleton from your h.s. science class.

You are correct. I can compare Baez & Co to a cup of coffee. It can be served either hot or cold. Baez it is either you can't determine when Caylee was placed there or you have proof that someone did it. Which is it? Would you like some creme with your coffee?

You can get a cup of coffee just because you like it but as far as clearing your head you are good to go!

don't a lot of experts rely on crime scene and autopsy reports and photos? they don't HAVE to visit the ACTUAL site WHILE it's being investigated?

Well, I guess this desperate defense team will just have to rely on the numerous and well documented crimescene photos and reports from the FBI and other LEO's, just like thousand of other defense teams have done.

I am so disappointed in lyon, I thought she'd be so much better then this.

If I remember correctly there was no flesh left on poor little Caylee's bones so the medical examiner had to crush some bone and do special test to identify her which is why it took longer. I would like the defense to name one case where the defense team was at the scene before the body of the deceased was identified. Baez should remember he was just miles from Caylee's remains eating crab cakes with her grandparents while the LE were on their hands and knees trying to bring Caylee's remains home to her ungrateful family who didn't even want her to be found in the first place.

just think about it - how many deceased individuals are found each year and no id can be made at the scene? did kc's team think they would have free access to each and every one of those crime scenes just in "case" it was caylee who was discovered?

Thanks desmom for posting these links on today's thread! My mind was a bit tired late yesterday when they were posted, and looking at these motions with a fresh and alert mind is much better.

Is the defense out of their minds, asking Judge Strickland to order the Jail to alter their normal policies for Casey, her family, and her defense attorneys? I cannot imagine the jail allowing anyone to meet with an inmate, unsupervised or unmonitored. Video taping is for the protection of all parties (unbiased).

The Michael Peterson case put Henry Lee's reputation permanently in the dirt as far as I'm concerned. I can remember watching that disgraceful ketchup episode - my jaw just dropped.

Actually, he left the country during the PS trial - I think it was right before or right after Sara Kaplan's very reluctant testimony that she saw him pick some small white object up at the crime scene and put it in a post-it(can that be correct?). I can't believe ANYBODY would still hire him as an expert or have him guest on their talking head shows. He's a complete fraud, imo,

JMO

Glad everything turned out OK with the Mom and little kid :)

I think it's sadly funny that Dr. Henry Lee thinks he should be let into ANY crime scene after the Spector case. And then they already had the *finding new hair* issues with the car by this point? I wouldn't let him anywhere near any evidence.

There is nothing to stop Casey from allowing visits with her family. This is Casey's choice. And, from what I have seen, Casey doesn't choose to meet with her family.

The only thing that stops Casey from speaking freely with her family, is the fact that she is guilty of the crimes that she is charged with, and her actions/words (lies) reflect that (something the defense does not want used against her in court).

Thank heaven for all three of you....Cheers to you....

I too can not understand why any family would not want their loved one to be found, no matter what condition they were in...Not knowing is the very worst...that is why I know that they all knew exactly where Caylee was since the very beginning...whether they figured it out or it was told to then by Casey, I don't know....but they knew....

I can not believe that this defense team is going to take up more of the courts time with this rediculous motion to dismis the murder charge...If I were the judge, I would start fining them everytime they brought up these ludricous motions....

It is laughable that Lyon is considering a "manned" security station, to be a factor in a violation of Casey's rights.

I would love to see Casey's Inmate Visitor's Log. Could Lyon be having difficulties communicating with Casey? I just read this document written by Lyon, and ....now I'm having doubts that a trial for Casey will even happen in 2010, or 2011 for that matter. (page 47 is especially interesting, given the fact that Lyon is now wanting all video taping to stop. Does Lyon really believe that Casey might "talk" honestly, under any conditions? HaHaHa

Wow Jeepers...thanks for posting this...you are all hero's in my book as were all the searchers for Caylee...then we have the grandparents...ugh!!!

The difference between givers and takers is so obvious!!!

Yeah, my husband called me from work and told me it made front page I thought he was kidding but I went to Al Live and the picture of the car is there. The water had gone down a lot by the time the pic was made. The water covered to the top of the windshield.I saw the concrete border in the pic. Me and one of the guys were standing on solid ground holding on to the hood then we both kinda fell in. We were tripping over the concrete border we could not not see and losing our footing. Scary for everyone.

Casey Anthony: WFTV legal analyst rips defense's latest moves
http://blogs.orlandosentinel.com/entertainment_tv_tvblog/2009/09/casey-anthony-wftv-legal-analyst-rips-defenses-latest-moves.html

But it's clear that defense attorney Jose Baez doesn't care for Belich. She and WFTV have taken the hardest-hitting approach to covering the defense.

Oh Good morning everyone....

I agree with you. I wish they could impose a fine on everyone of them. If Judge Strickland could fine them maybe Baez & Co would think long and hard before they even thought about slipping a piece of paper under his door. Baez & Co = injustice jmo

Maybe Baez thinks they should transport Casey over to the Ritz every time he wants to meet with her. How dare they have armed guards in a jail. How dare they 'watch' what Baez is doing with his client during visitation. I guess he's finding it hard to smuggle mail in with the guards watching.

Sheaffer also said ..But it's clear that defense attorney Jose Baez doesn't care for Belich. She and WFTV have taken the hardest-hitting approach to covering the defense. I can guess why.. It's because of the emails cindy sent to Kathi and she forwarded them to the FBI.. IIRC thats when she became a Thorn in his side..dont think there was a problem until the emails were sent to her.. Attorney comments on Casey Anthony case
http://www.myfoxorlando.com/dpp/news/anthony_case/091809_Casey_Anthony_attorney

Video on left.

Hornsby is confused by the motion to throw out the case because he said JB is equating investigating the crime scene with destroying evidence. Mr. Hornsby went on to say if this was a motion prepared by a law student, he would return it because it mis-cites the law, it asserts things that are not true, it mis-applies the law.

jmo

Note from Baez office to Hornsby: Well I meant to say the other one.
You know the other law on the other page of that oh what is it....
You know that book that has all those laws in it... you know the one I am talking about... help me out here. tap..tap..
Wait till I see Casey. She read me the wrong page....again
Poor Casey she got miscontrewed one more time.

Tying up court time.. Putting garbage out there and honest law bidding folks are having to spend their time correcting his motions. Huge Waste!

Way, way back towards the beginning of this case, I recall Baez making a statement that led me to believe that he would first screen all of the mail sent to the Jail for Casey, before it was given to her. In other words, he had opportunity to give her "only" the mail that he wished her to see. I wish that I could find some of those old media clips like that one, but some of my old links just don't work any longer (or I failed to put the links in my notes).

I have complete faith that Judge Strickland will be quite the professional, and you won't see him laughing at the defense while seated at his bench. He will more than earn his salary that day.

HaHaHa

http://www.wisspd.org/html/training/ProgMaterials/Conf2006/DDEFE.pdf

Sun thank you so much for posting this very interesting link! It certainly lays out Lyon's game plan and her mindset as well as helps to make some sense (from HER standpoint) of why these motions were filed. I've only read 6 of the 46 pages but plan to read all of it later.

From this article Lyons says: File any motion for which there is a good faith basis. It is the right thing to do for your client, it just might work, and very importantly it may lay the ground work for a successful appeal.

A few more interesting snippets:

At this part of the trial prosecution may present aggravating evidence, some of which is described by statute, and some of which is not.

Mitigation-reasons to punish with imprisonment rather than death- is any evidence which might tend to explain the client’s action, family history, mental health issues, physical health matters or the impact the client’s execution would have on his or her loved ones.

….in addition to locating and presenting mitigating evidence much of which is a matter of shame to the client and his family. **Look out G, C & L....I hear a bus coming your way.

When you get a capital case you should literally open 2 files (1) one about the client’s life and (2) one about the capital case.

The presence of your client’s family is very important to your ability to win the death penalty hearing. Try to enlist their support and aid early in the process, and make it as easy as possible for the family to come to court, visit your client, and talk with you.

**Lyons thoughts on how to interview family members to get info was quite interesting as well. Oh how I would love to be a bug on the wall when she meets one on one with Cindy.

In PDF document...State's request on discovery...the motion states that what the defense has learned about when Caylee was placed where she was found has been through depositions. ???

The defense has thus far relied on the discovery from the state to come to the conclusion that Caylee Anthony's remains were deposited after Miss Anthony was incarcerated. ???

It amazes me how Casey's defense team expected to be allowed
onto a crime scene while the LE is in the process of gathering evidence.
As a poster earlier said .. most time defense lawyers come into the case after a person is arrested and charged with a crime.
Usually by that time the scene has been gone over with a fine tooth comb.
Why they thought they should have been allowed to be there as they collected evidence is beyond me.
I really believe the defense is grasping at straws doing and saying anything that can and will keep putting the trial off.
When is the justice system going to say enough ?
I would not be surprised if they add another attorney and then stall because this attorney needs to brush up on the case.....
I do wish the wheels of justice would go faster on this case.

How many crime scenes do LE investigate a year without having a POI or suspect already in custody?

Why the defense team thinks they had the right to be there before it was known it was even Caylee, is beyond me. But what if Caylee had been identified right away? did the defense have that many experts on hand so they could split up and visit every site where a body was found just in case it was caylee?

I sense a power struggle among the defense. Baez has made it a priority to "isolate" Casey from everyone but his firm. Even her own family. Now Lyon is filing a motion indicating that it is important to the defense that she be allowed to meet with her family (and that those visits remain private). Is Lyon fighting the Sunshine Law? Isn't that what allows for those jail visitations/phone calls to be made public?

I need to re-read that motion. And, concentrate on what Lyon is saying concerning Casey's emotional well-being. Could we be seeing a glimpse that all is not well in the jail. Casey not doing too well emotionally? Perhaps Casey is not liking how often Lyon mentions the death penalty and matters surrounding it?

Dells

Bolding by me.....

Apparently they did based on the motion that they filed.:sneaky: Can you imagine how much the defense team's presence there would have corrupted the crime scene if in fact this was not Caylee? They do not care. The defense knew it was Caylee though because Caylee probably told JB exactly where she threw poor Caylee away like she was a piece of trash. JB is the one that was holding back evidence from the state, because as soon as those remains were found, he knew it was Caylee.

They are going to try anything and everything..IMO casey should get the DP..but LWOP maybe just the ticket.. never again go to a party, no beaches, no MEN , no shopping, no more big family thanksgiving's no more Christmas dinners with the family, none of moms chili , no birthday parties, someone telling you what to do every minute of the day, telling you when to eat what to eat, when to go to bed , when to get up. when to shower, wearing clothes they issue to you with numbers and dept of on the back.. humm she's only 23 she should have at least another, 55 to 60 years enjoying the good life behind bars.. or beautiful life which everyone she chooses.. look at diane downs, betty broderick before and after pictures.. heck betty broderick was hardly recognizable at her second trial.. and the longer casey sits in the county the more she'll be like betty broderick in every way... jmo..

Exactly! LWOP will be a very fitting and very appropriate punishment for Casey. She is very young and will have a lot of years to sit in prison and think about just why she is there. I sometimes think that LWOP will be even harder for her than the DP. If she gets the DP, she will remain in some sort of protective custody and will not have to work. Ultimately she may even choose death if she has to live out the rest of her days in prison. I think LWOP will be a very scary prospect for her. She someday may have to be in GP and she will have work. **Shudder** For someone that was so lazy they never liked to work, the prospect of having to work the rest of her life at (hopefully) at an undesirable job (scrubbing toilets or something along those lines) can't seem very pleasant.

Re Defendant's Motion for a Protective Order Directing Orange County Jail to Destroy Videos of Family Visits
http://www.wftv.com/pdf/20972696/detail.html

page 2 - 4. In an ordinary trial, the jail is responsible for Miss Anthony's general well-being. In a high-stress situation such as a capital trial, the jail should also be held responsible for her emotional well-being.

and ...grant her application and issue a protective order and an order to cease and desist prohibiting the Orange County jail from:

1. Saving any video and/or audio taping Miss Anthony's visits or phone calls with family;

Yep, there is no need for the Anthony's to go with Jose to visit Casey in order for her defense to build their case in defending her.

If they want to talk mitigating factors with the Anthony's they can do that at the Anthony's home or Jose's office.

All of them getting together would be nothing but a meeting of the minds to try and get stories correct, IMO.

I so agree! The judge is never going to let Casey meet w/her family privately. Why should he? It is not his authority to order how the jail handles visits between the prisoners their and their families anyway. Why should the jail bend the rules for Casey and her family? If she gets special privileges, then everyone at the jail is going to want them. I almost hope that Judge Strickland denies these motions w/out even having a court hearing on them, because they are just that ridiculous and the court's time has already been wasted enough by the judge just having to take the time to read them.

Sun from the Lyons article you linked, my take is the emotional well being of DP inmates should be a top priority considering what is at stake--their very lives. You need to keep them emotionally strong to assist with their defense, and Lyons believes family support is a big help in doing so. (Obviously she doesn't know THIS family.)

However I do strongly suspect that casey is beginning to crumble now that AL is likely telling her like it is, and probing into those uncomfortable areas she'd rather not discuss which could serve to save her life. It is doubtful Baez ever upset his girl with a lot of probing or worst case scenarios.

What I find interesting is if this motion regarding private visits, no video taping, etc were granted casey would be receiving preferential treatment over all the other Fl inmates. Can you imagine the vast number of inmates coming forward to petition the court to let them have the same 'Casey Marie Anthony' rights.

I am with you on this Dells. The rest of her life behind bars.

Maybe that is what the defense is counting on? Maybe that is why they want the trial moved to the specific areas that they mentioned? Shouldn't it be the judge who decides where the trial should be moved to if it has to be moved at all? What gives the defense the right to dictate where this trial should be moved to? I think the defense has finally picked up on how bad it looks that this family hasn't visited her since last October (Larry King - weird). This is just their way of putting the blame on someone else for that.

Baez did not want them to visit because none of them can be trusted. You're right. When she's in court, she doesn't even try and look for them, which most people would do.

I agree. It is the defense's fault (specifically JB's) that Casey hasn't visited w/her family since she was charged w/murder. I also suspect that Casey really and truly does not want to visit w/her family anyway. She knows that they know that she is the one responsible for Caylee's murder. But the defense is now trying to throw the blame on others as to just why Casey hasn't been visiting w/her family. It's the big, bad jail's fault now because they are actually making Casey, her family, and her defense team abide by the rules that they put in place for EVERYONE to follow. It's pure nonsense!

And, perhaps the isolation of protective custody (and the jail rules that pertain to that status) are finally taking a toll on Casey. but, but the Judge and the jail have already denied JB and the family's request for a private memorial service, the family to have private meetings with Casey and the security cameras be turned off when JB is meeting with his client...oh which reminds me...didn't JB complain about meeting Casey in a classroom and accused the jail of listening to their conversations? In his new motion he said they meet in an area that is "open to viewing and there are two security stations with unobstructed views. Every time there has been a visit, both of those security stations have been manned." (page 1 http://www.wftv.com/pdf/20972696/detail.html ) The jail must have moved them from the classroom.

jmo

Yes, the judge has already denied JB numerous times on this one specific issue. Which is exactly why this one will be denied as well.

I hope the judge tells the defense team not to keep wasting his time w/the exact same motions filed over and over again. The answer is NO. It is always going to be no. They are not going to be able to meet w/Casey privately w/out any monitoring going on at all.

If Casey's parents want to visit w/her, then they are going to have to visit w/her the same exact way that other families visit w/inmates that are housed at the OCJ. Period. End of story.

When is the defense team going to realize that they are not going to get special privileges and that the same rules that apply to everyone else, apply to them as well? Their whining and their filing of these frivolous motions just make them appear uninformed and incompetent. I so agree. I think the defense team is going to strongly encourage Casey to acknowledge her parents in some way. It will be interesting to see if Casey takes their advice. I think no. what could he hope to gain by this? that kc would fess up? not after all THIS time. not only that kc didn't tell the truth about what happened to caylee when she was at home, before her first arrest, and alone with cindy. if she had said "mom, it was an accident" way back then, she probably had a chance. as a matter of fact, they didn't discuss caylee AT ALL, iirc.

as far as her mental state, she appears to be angry at the a's for not getting her out of this self-created mess. what would change if she saw them without being videotaped?

Keeping in mind that casey hasn't spoken with her family since the remains of her daughter were located, any visits at the point would be vastly different than in the past when they were playing along with her BS about the nanny kidnapping, and trying to obtain clues from her. I would imagine there would be an awkwardness and a lot of tension between the 3 of them when they meet again for the 1st time. Especially since casey has so obviously shunned them in court. There is no longer a reason to discuss the 'search' for Caylee, the possibility of her being home for her next birthday, what casey's future plans are regarding sharing Caylee with the family, Cindy will not need to tell casey she doesn't have to work, no need to discuss bailing her out, she can't respond to questions with "I've already discussed that with Lee and he is working on it", ditch the small talk, blah, blah. No wonder the defense is so concerned about visits being taped... while at the same time Lyons thinks it's very important for casey's family to visit her. Not to mention AL wants to observe their true interaction as a family without the influence of a video camera, or any of it being made public.

I'm sensing that there may be something more behind this "emotional well-being" just now cropping up. Perhaps it could have to do with the death penalty phase that we all believe is going to happen. I seriously wonder though if the Anthony's would even want Casey back in their home if she somehow miraculously gets off on some technicality? How could they ever trust her? I mean someone who would murder their own defenseless 2 year old child should have no problem murdering anybody else. More importantly, especially considering Casey's treatment of her parents while in court, I have to wonder if Casey would even want to go back to her parent's house? She would probably think that Cindy would hold the murder of Caylee over her head for the rest of her life and use that as a means of controlling her. And she's right. Of course, Casey doesn't have many options as to where she might go if in fact she did get out of prison. She has no friends and no family besides her parents that might be willing to take her in. Where would Casey go? Would one of her defense attorneys take her in? I think they probably think she is guilty as sin as well, and they probably won't want to have anything to do w/her after this case if over with, even if they somehow manage to get her off scott free.

Got to make you wonder why they dont want them recorded...umm cause maybe she killed her baby and everyone including defense knows this and is afraid of what might slip..

How stupid does al think Judge Strickland is? I can bet this will never fly either.. just wasting the courts time..I can see it know Your HONOR casey's visits and phone calls between her parents and her should not be taped.. this is client parent privilege... they are working on casey's defense team..roflmao......

jmo..

Bolding by me.....

Why does the defense team even care about what Casey is potentially going to say to people? If she is so innocent, as they are proclaiming her to be, then it should not matter. If she is so innocent, then there is no way she could say anything that would be incriminating. The very fact that they are trying so hard to keep ALL of Casey's conversations so private just adds to fact that even Casey's defense team knows she is guilty and can't be trusted.

I seriously wonder though if the Anthony's would even want Casey back in their home if she somehow miraculously gets off on some technicality? How could they ever trust her?

(snipped by me)

they prolly would take her back home. they trusted her blindly before, and STILL trust her, so trust wouldn't be an issue. their "reality" switch is permanently switched to "off" regarding kc.

don't forget, caylee is missing, not murdered. zanny did it. kc is innocent.

see how well that works when your "reality" switch is always in the "off" position? no problem.

With the way this family is they may very well pick up where they left off. Remember, in their world, there is a person running around free who kidnapped and caused Caylee to have a terminal event. Casey still holds clues.

1. Saving any video and/or audio taping Miss Anthony's visits or phone calls with family;

2. Disclosing to anyone anything that occurred in the meetings or communications with the family.

Casey has shown very little emotion throughout this whole ordeal...well except for a tear here and there and her tantrum when her parents visited.

JB is not concerned about Casey's "emotional well-being". JB is concerned about Casey's lack of emotions. I think he is also concerned if G & C visit or call Casey, there will be a replay of the tantrum she threw on 8/14. JB does not want any witnesses to Casey's lack of emotion or tantrums.

jmo

BBM. Sorry I don't know how to snip yet.
Didn't the jail give her a sedative when she asked for it when hearing the news about a childs body (Caylee) being found? They also let her take an unsheduled shower IIRC to feel better. Should she have gotten a make over also?
Shouldn't AL have filed amended motions instead of the ones she filed?
Delay, delay, delay.

I so agree. I think the defense team is going to strongly encourage Casey to acknowledge her parents in some way. It will be interesting to see if Casey takes their advice. I think no. Casey is spiteful like that and, she will probably still continue to ignore her parents, even if it ultimately hurts her case.

I think Lyons has probably already (or will) cut to the chase with casey and explain to her the importance of the perception the jury has of her by their observation of her demeanor in court. Lyons may not press for casey to get warm and fuzzy publicly with her parents during these motion hearings, but I bet she will beat it in casey's head to do so during the murder trial. But I agree, casey is spiteful and likes things her way, and she may not take Lyon's advise.

Attorney comments on Casey Anthony case
http://www.myfoxorlando.com/dpp/news/anthony_case/091809_Casey_Anthony_attorney

Video on left.

Hornsby is confused by the motion to throw out the case because he said JB is equating investigating the crime scene with destroying evidence. Mr. Hornsby went on to say if this was a motion prepared by a law student, he would return it because it mis-cites the law, it asserts things that are not true, it mis-applies the law.

jmo

So glad to hear an attorney weight in on these motions and so glad to see that his views are the same as mine.

I am wondering why the defense thinks they can get the entire case thrown out because of the "spoilage" at the crime scene where Caylee's remains were found? That isn't the only evidence in this case to support a murder charge. According to my records, Casey was charged w/1st degree murder way before Caylee's remains were even found. I think if they were going to take this route at all, then they should have tried to get the evidence from the remains site thrown out of court, not the entire case.

I so agree w/you. But Casey is so spiteful she doesn't even look at the bigger picture here.

i don't think kc equates "cooperating with her attorneys" with "improve your public image, you dolt."

if she was more cordial to her parents (to say the least), she may have gained a little more sympathy with everyone looking in on this case. instead, she projects this spoiled brat image which immediately turns everyone off. it is so true (to my mind at least) that if the jury doesn't personally like your client, if they can't relate to them in some way, your client will not get off.

HaHaHa

I'm sensing that there may be something more behind this "emotional well-being" just now cropping up. Perhaps it could have to do with the death penalty phase that we all believe is going to happen. Perhaps Lyon is not able to get Casey to agree to meet with any of her family. There is just something, and I can't quite sniff it out yet.

I know what you're saying, but maybe it's as simple as the A's flat out refusing to visit casey if the visits are taped and made public. Remember on LKL when Conway said he thought the A's SHOULD visit casey, despite Cindy's excuse about not being able to do so because of the video recordings and the public misinterpreting everything said. Perhaps AL thinks she can influence them to visit if she can get this motion through to do away with the video. And frankly I doubt casey wants to face either of her parents at this point. If she indeed has something hanging over their heads she may be waiting for the right moment to unload, and this would be easier to do if she distances herself and doesn't speak with them in person. I don't think visits with her parents will do much to improve her emotional well being, in fact just the opposite. I'm not even sure how much Lyons cares about her emotional well being, she is primarily looking for something to help her get the death penalty dropped, and she needs to see the family interact to pick up some clues and help with directing her investigation into family history. I believe this will be the primary mitigating factor she will rely on to attempt to save casey's life. The family has no idea how down and dirty this is going to get!

I think AL has one mission and will do whatever is necessary to have the death penalty dropped. Everything she says and does will be a means to achieve that end to add another notch to her belt.

i wonder what would happen if al decides that kc's parents are such bad parents, mentally and emotionally abusing kc all these years, that they are ultimately responsible for kc's actions, and decides to lay the blame at their feet. "kc grew up in such a dysfunctional home, learned all these evil traits at her parent's knees, that she couldn't help but react in this manner" kind of thing. again, it's the "not me" generation thing but that seems to be the norm these days. not having the person actually responsible for committing the crime be held accountable for their actions alone.

i realize physical handicaps such as schizophrenia, brain disease and such can be mitigating factors, but sometimes i have a hard time with the "it's all my parent's fault" thing. when does someone stand up and consciously decide that "i won't be like my parents and will do things differently" and make a better life for themselves. like children of alcoholic parents don't necessarily grow up to be alcoholics themselves, deliberately avoiding it because they saw what it did to their parents? anyone know what i'm talking about?

If you haven't had the pleasure of watching cases involving HL you in store for a real treat-UGH. His reputation has gone down the tubes in the opinion of most, and I'm amazed anyone still wants him as an 'expert' in their high profile cases.

I agree with you Cindy is barn blind. See only sees what she wants to see.

I think that someone like Judges S maybe needs to remind the defense that Casey is in jail accused of murdering her daughter. She not in day care or summer camp and it is not the Casey show. Murdering your daughter and throwing her away like trash doesn't make you special. These people all need a serious reality check. I wonder if her lawyers have given any thought to what the other inmates will do after the princess is convicted?

As long as Casey is thinking about......by now I'm sure she has begun to think about what the big house is going to be like......and I'm sure she isn't getting a pretty picture....

In the world of horses, we have a phrase for those people who cannot or will not accept that their horse is not perfect: barn blind.

I know one lady whose horse was so vicious it had to be wear a muzzle at all times so it couldn't bite. To her, this horse was *perfect* -- right up to the time it ripped her throat out, and even after that event. She was barn blind.

Cindy is barn blind where Casey is involved.

Wow Spots, that is really interesting. Thanks for sharing that.

And yes, I agree with your summation of Cindy and Casey in this context!

I go back and forth on Cindy's intent.

She confuses me, lol. I can see her openly defending Casey while secretly stabbing her in the back.

Me too, no doubt she confuses everybody.

I also go back and forth. However at this point I lean more toward IF Cindy truly is making sincere efforts which she thinks will help get casey 'off' it's only to save her own reputation as her mother, and the person who raised her. Cindy is first and foremost concerned with Cindy, than she is casey, or even Caylee, that much is clear. Like George said...(paraphrased) I don't want to think that a child I raised could be capable of doing something like this. Cindy doesn't either because the world in general puts more blame on a mother, than a father.

Besides all these so called efforts to support casey are doing more to hurt than help her, they are making Cindy into a martyr which she seems to thrive on, and creating juice for books, magazines and a movie or two. Cha ching! Cha ching!

I think its less spitefull and more sociopathic behavior in Casey's case. She can only think about herself, she is the only one that matters to her.

Before anyone bashes/asks this is an OPINION, I am not in the medical field at all....

JMHO

Hugs,
Spyder

Although Casey fit's it t a tee (sociopath) it is not considered a mental illness in the eyes of the law....she knows right from wrong no matter what....therefore when she is being spiteful, she knows she is being spiteful....when she talks to her parenst the way she does, she is actually trying to bully them into being on her side...

Now, she may have gotten this trait honestly (from her mother) but probably more from the genes then from the way she was raised....

But either way....her actions will never be excused no matter what phychiatrist may say....

Sadly, somehow I just don't think Casey is seeing the big picture yet. She has someone in her ear telling her about all the people that think she is innocent. And let's not forget how famous she is and the potential gift she can give her Mr. Baez...fame. IMO she is all caught up in being "the headline". Unfortuneatly, her parents are on the same track. Disgusting....

Just think, Cindy wont have to go looking for Casey, she wont have to worry about Casey stealing any more money, she will know Casey's every whereabouts at all time....That should be a big burden lifted off of her....especially with all the money they are raking in right now, they wouldn't be able to trust Casey around all that.....

I could be wrong and it wouldn't be the first time, but I truly wonder just how much they are taking in. I can't believe that so many people are shoving money at them on their site. Usually when others so donate, it's a one time thing and not that much since times are hard. And take into account that so many hate them for their actions. It just seems hard for me to believe they are raking it in. That might be why they courted the media for the new documentary. And last I heard, the media outlet said they aren't sure when it will be run. It could be they are getting lots of emails like before and people are saying they will boycott. Speaking of that, which outlet is doing it? I don't know if I have ever heard.

I'm pretty sure that they have been approached with movie deals and such....they may have signed a few exclusives...one thing is for sure, they are paying their bills and neither is working...They were having it bad when this started, then all of a sudden they can travel, buy a boat, pay their bills, buy clothes stc., ...they must be getting money from somewhere....

If that is the case, her attorneys need to tell her it is time to grow up. She is 23 years old and looking at the DP. She needs to cooperate with her attorneys.

jmo

I think there will always be something that keeps Casey from giving straight answers to the questions, if it's not the chain, then it will be her parents not being able to visit. If they get clearance for the parents to visit without cameras, she'll come up with something else. The attornies better realize she's not gonna help her case because she is lying thru her teeth. I'm sure everything she has told them has been checked out and has been proven false. Her story is like a mouse in a maze without an pathway that leads out, it's all deadends and backtracking.

Listen to Cindy talking to the FBI and Matt Irwin, dealing with Casey is probably the same.

I think they've been living off the $250k they got from selling Caylee's pics. Nobody is sending them enough money to live off of. They haven't worked in 15 months.

Cindy's probably blowing through the dough quick so it's time to sell some new pics and continue on with the media blitz of how innocent Casey is.

And that's the bottom line right there. Casey should not be given any allowances that are not given to any other prisoners. If she can't see her parents or call them without it being taped, so be it..that's the way the cookie crumbles.

Documentary? I have been off the boards for a bit but what did I miss? Why is it that the lives of this family is worth a documentary? A teaching tool maybe but not a documentary.....this is why they think they are above the law, people have made them feel like celebrities and they don't have enough common sense to feel shame for what their daughter has done.

I agree with you. I wish they could impose a fine on everyone of them. If Judge Strickland could fine them maybe Baez & Co would think long and hard before they even thought about slipping a piece of paper under his door. Baez & Co = injustice jmo

I so agree w/you, but I don't think Judge Strickland will impose any fines on the defense team. If he did, the defense would be whining that he was showing bias towards the prosecution. I do think he will forcefully knock down their motions though. He will do it politely and fairly, but he will do it w/purpose.

I was kidding. I thought it was funny.
Yep, this is not Cindy's first rodeo Cindy's been biting at the bit at Casey for a long time.

They are so much alot alike that is why they cannot handle each other.

Casey was jealous of Caylee when Jesse was still in the picture. That is a sick twisted sister (to be jealous of a baby)
I think Cindy had always been jealous of Casey
When George was talking to Casey at the jail and he something like,
"Hey beautiful" or something like that and Cindy put her head on George's shoulder (appeared to me as showing possesion to Casey)
I think Cindy was jealous of Casey even when Casey was a baby. They just seem to constantly spar with one another.

But just think how a jury might feel if they see this family slobbering all over each other at the trial. Wouldn't just one think that if the family believes she didn't do it, maybe she didn't?

Sure, and that's the idea behind all defense attorneys grooming and preparing their clients for the trial.

Just the mere fact of casey's parents being the grandparents of the murder victim in and of itself speaks volumes....since they are supporting the accused murderer of their only grandchild who lived with them since birth. :cursing:

Maybe Baez thinks they should transport Casey over to the Ritz every time he wants to meet with her. How dare they have armed guards in a jail. How dare they 'watch' what Baez is doing with his client during visitation. I guess he's finding it hard to smuggle mail in with the guards watching.

And maybe they can munch on crab cakes while they are brainstorming for ideas on how to get Casey off scott free for the murder of her child?:sneaky: JB's motion isn't going to get him anywhere. His visits w/his client will continued to be monitored, as they should be. JB is so hypocritical. I could just see if something happened while he was meeting w/Casey if the visits weren't monitored. He would be whining that nobody was watching their visits to make sure he was protected. No matter what, JB is going to whine. It's all he's got and it's the only way to detract from the real issue here, the fact that Casey is guilty of murdering her daughter.

Bolding by me.....

I so agree w/you. I think the real issue here is that Casey doesn't want to have any contact from her parents, whether it is in the form of a video visits or letters. Part of JB saying that he was the one that did not want any contact between Casey and her parents comes in part from the fact that Casey DOES NOT want to visit w/them. That looks bad. To try to help combat that, that is why JB says he is the one discouraging visits. I don't think it is the whole issue, but I do think it is a big part of it.
