Casey Anthony: Is Leonard Padilla decision a setback for defense?
http://blogs.orlandosentinel.com/entertainment_tv_tvblog/2009/08/casey-anthony-leonard-padilla-associates-could-be-called-at-trial.html
Later, WKMG-Channel 6's Tony Pipitone provided more insight about Padilla and the bounty hunter's team. "We don't know what's in those statements, but [defense attorney Jose] Baez does," Pipitone said. "And he didn't want it to be considered even for evidence. But we should know soon, because today's ruling means it opens the door for this to become public record."

Morning, Des.
Thoughts for the AM:
Jose is a fool.
Is Mark K. a bit envious of Tim? Don't get me wrong I love Mark but how does his record compare to Tim's? Tim puts his money where his mouth is and anyone that disses him makes me :cursing:

JB is definitely afraid of those LE interviews with Lenny and Crew. I think Casey was being Casey and attempted to dazzle the Crew with her BS. I think in that aspect she is a lot like Cindy...she doesn't know when to put a cork in it.
I wonder if Casey told JB she blahed, blahed to the Crew or if he found out when he listened to their interviews with LE.
One thing I miss about ole' JB is in the past when Judge Strickland would make a ruling, he always had something to say to the media about how unfair the decision is, how his client is being crucified in the media, Casey is innocent and we will all understand when the facts come out. I think Lyons told JB to put a cork in it.

Better yet, is this when the story changed i.e., Zanny and her sister took Caylee from Casey at the park? Jurors hearing a change in the story, an aggressive, physical kidnapping, but one that was not reported to police....case closed. Stick a fork in her, she's done.

o happy days! (good morning everyone!)
so glad LP and crew's statements will be admitted. i thought they would be because the "oral" agreement jb was alleging wasn't worth the paper it was printed on. also because LP was appearing in the media hinting and talking around things - begs the question (asked many many times) why the heck didn't jb file for an injunction at that point?

I honestly believe that the testimony/statements of Tracy and Rob are gonna be extremely damaging to Casey's defense. We've heard quite a bit from Leonard but not from them. In MY opinion they have kept quiet because they have the most damaging stuff to tell, remember still waters run deep.
Im happy their statements are gonna be allowed and I look forward to hearing what hey have to say. I believe its gonne shed alot of light on not only Casey, but the whole Anthony Family.

I also loved how the Judge mentioned at least twice that he based his decision in part on what GA testified to. How's that for a smack down of the liar on the stand. They will never learn, but they will see the hammer come slamming down on them before this is all over. No matter what Lee said, this group is not too smart. They all deserve each other. IMHO

ITA I think they saw and heard so very damaging things while in that house. IIRC Tracy lawyered up real early on. I'm wondering if she even told ole Lenny what happened in there. Jose, et al certainly are doing their best to keep an jury from hearing what they have to say. They could be the ones to sink Casey's boat.

perhaps ga will remember this and not say "i don't recall" that often anymore. he thought this amnesia would help but all it did was HURT!

I wonder just how soon the media will be able to get their hands on that CD. When I realized that the State hadn't spent the money to have their interviews transcribed yet, it made me wonder if they were even thinking of using LP and his crew as witnesses at the trial. No matter, they took the interviews and were obligated to turn this over to the defense. Baez/Casey evidently didn't want the media to get these interviews and release them to the media.

They will have the CDs transcribed eventually. Remember when the FBI interviews with G & C were first released, they were in video/audio format. It took awhile but eventually we did get a transcribed edition.
Lenny & Crew's video version of the interview will be more interesting to watch than G & C's. I wonder if Lenny had his toothpick.

Now that I've read Strickland's decision on the privacy motion, it seems obvious that George thought his "security" answers regarding Padilla & Co. were going to help the defense prove its point, but he was so off the mark. He actually reinforced that they were not agents of Baez. What a clown.
I also think George's "anger" is phony. He's trying to be macho man yet he looks anything but.

I am so gratified at this decision by Judge Strickland. However,
let's remember that when this finally rolls into the courtroom,
this desperate defense will still object on the basis of relevancy,
to every line of questioning by the Prosecutors to the Padillas, Dick and McLaughlin.
If lyon is doing the objecting, we have a chance that the objections
will be based on some statute and/or law. If it's the incompetent
and incoherent jose, I predict we will require a gibberish to English

IMO Cindy & George have excuded the attitude that they are far smarter than anyone else involved in this case. They have tossed out their "big words" ( totally out of context) in order to try and impress the public with their brain power. I have news for them, the use of 8 or 10 letter words does not in and of itself make you smart. If you don't know what they mean and you use them out of context, they can actually make you look incredibly stupid. You re not smarter than the lawyers involved in this case (yours, Casey's or the SA) . While at times you may appear to be smarter than Jose & CO, they do have a knowledge of the law that you do not. The antics of George on the stand in this last hearing have proven that you can do more harm than good for your daughter. Maybe it's time to shut up, follow the advice of the lawyers and let them run the show. You simply aren't smart enough to do it.

I agree that the Ants think they are smarter than others. We know Cindy thinks she intimidates LE, and with her giant Trapper Keeper she's got the the whole lowdown on everyone associated with Casey. Too bad she refuses to face the fact that all of the answers can be found with her own daughter Casey, not with her old friends or her new friends or with any of her acquaintances, but with the girl herself.

Big words? Haha, the only big words they know are - hey! get off my lawn or I'll smack you with this hammer. These people are not smart. In my opinion they don't even know how to act smart. Remember - CA says she is a nurse, yet she went along with her daughter's story about having a tumor without ever checking it out with casey's dr, without ever actually looking at casey and seeing little Caylee who was growing inside her. How smart is that?
I figure someone must have told GA to smile when he's upset - but he's not smart enough to know that a smile is not a grimmace, that looking away and grimmacing at the same time makes him look like an unhappy clown. :tongueside: No amount of coaching can help these people.
I'll bet anything all casey did when Padilla's people were there was try to get Rob Dick's attention. I'll bet she asked all about him all the time. Remember - after casey killed Caylee, that baby no longer existed for her. She was gone. All casey could think about by then was how she was going to glom onto Rob Dick.
Sun sorry to hear you are under the weather. Hugs for a speedy recovery.

That would be very interesting.
I can just imagine how many times Baez will interupt prosecution questioning.
I also think that is a strategy with lawyers when "things' are getting rough for their case ...they will do anything they can to interrupt and maybe hope to change the thought process on what is being said.

IMHO

perhaps the judge was sending a subtle warning to ga - tell the truth or there will be results you definitely DO NOT WANT. (although, if the a's did tell the truth, the results would be the same, no?)

i don't get this at all - CAYLEE IS DEAD, NOT MISSING! if they truly wanted to do some good, they should be supporting people who have had loved ones die because they were MURDERED!
they can do this without admitting that kc killed caylee. think of this - if they supported people whose loved ones were murdered, they could still advocate for kc's innocence and say they were still looking for the real killer. that would make a WHOLE lot more sense to me than *supporting* parents of missing children. if i had a missing child, their presence would be distasteful, to say the least, and i would wonder if my missing child would turn up murdered like caylee did, kwim? there was no happy ending for caylee - she wasn't returned safe and sound - she was found dead and the a's presence would remind me of that.

Then I found this video http://www.clickorlando.com/video/20483824/index.html It is a car wrap. I asked College Son, who is into car shows, overhauls, paint jobs, etc, and he said to wrap a truck that size is probably $4,000 - $5,000. To replace the panel with Caylee's pic, would be probably $700.

Nope. These survivors might actually require some care and feeding, and ~probably~ wouldn't be thrilled with being handed a lousy stuffed bear with a dead child's name on it. How will the Anthonys survive if they give away all the money?
Seriously, though, I think people are more inclined to give for a missing child, because there's always hope, plus a tangible need for searchers (supplies, etc.). A murdered child brings sympathy and more of a "we can't do anything now" attitude. They might donate to a one-time need such as a funeral, but after that - why bother?

I am so gratified at this decision by Judge Strickland. However,
let's remember that when this finally rolls into the courtroom,
this desperate defense will still object on the basis of relevancy,

If lyon is doing the objecting, we have a chance that the objections

Caylee's dead yet they still have this missing child thing in their heads.. If they dont realize Caylee's dead then: I want to know whos cremated remains they are wearing?
The foundation is for them.. so they can rake in the money and never have to work again..Hopefully people realize this and DONT send one RED CENT! They never searched for there own missing blood why would they search for a strangers child? No  that will never happen You or so right CAYLEE was never a missing child she was a murdered child. casey knew where she was all the time and so did the rest of the an;s but this foundation is just for the an;t to live high for the rest of their lives. this just makes me sick and sad. I don;t think Trenton's day understand this. Trenton will never be found because his mother made sure of that. She knew what she had done and could not live with what she had done to that baby. some people do have a heart and can;t live with what they have done but when it comes to casey she has no heart and it looks like none of the an;s do.jmho

IMO, they are doing everything possible to raise funds NOW. Once Casey goes to trial and is found guilty they will no longer be ab le to call it a "missing child" case and the world will no that their daughter killed her. Right now they are preying on those unsuspecting people that don't follow cases as closely as people on crime message boards. The clock is ticking for these folks and they know it. Josh is a very caring young man. He feels sorry for anyone who has a loved one missing. Look at it this way....for a few days, Caylee was missing. Can you imagine how he felt when the facts started to come in and he had to come to terms with there being another young mother out there like the troubled young woman he married? I don't think he looks at the truck as being a tribute to the A's but rather, as a memorial to all the little ones who didn't have anyone else to stand up for them.
One day, Josh won't be as naive as he is now... we all become jaded at some point.

I'm going to guess that Judge Strickland is taking very special care with this, before making a ruling. I'm going to guess that he will determine that the murder case takes priority, above all else. But given the already long delays in the murder case, I am also going to guess that there is a very slim chance that won't happen.
Im praying that the Judge will let this case go forward.. IMO it really sucks that Amy has to wait .. She's waited over a year now.. Time to get on with it.. Not her fault that casey stold from her and not her fault because jb and company keep delaying the murder trial..why does everyone ever connected to the A's have to suffer because of them?

I can vouch for Martha's memory, although I don't remember the exact document. I'm leaning towards "Lenny on the NG show."
Or was it Casey on the air mattress in Cindy's room, George on the sofa?
Anyway, I think it was more to keep Casey from talking to Tracy than to keep her from running. The ankle bracelet + Lenny's security was supposed to keep her from running.

Dead kids aren't worth much on the open market.
Missing kids are a gold mine in donations.
Sorry to be so blunt, but that's how I sees it.
I thought that George's angry reaction to references to Caylee's "body" or "remains" during his deposition was weird. Obviously those bones came from Caylee - there's no real factual dispute about that, right? He and Cindy are not too emotionally devastated to go on TV talkshows so answering politely phrased questions during a deposition should be OK.
However, if you consider that perhaps they are hoping for gifts of money from people who believe that Caylee is still "missing" then it makes sense that they don't want to openly admit that Caylee (all that remained of her on this earth i.e. her remains) has been found and is no longer "missing." It's all about money with these people.

I'm guessing that the Judge is trying hard to find case law that will allow him to let the forgery and felonies connected to that to go forward without taking a chance on it causing an appeal. Don't know if there is case law like that or not. I know he doesn't want an appeal of any kind. MOO
Interesting thought. I hope you are right. I do find it interesting that the judge hasn't ruled on this particular motion yet. Everyone seems to think that he will delay the fraud trial, but he seems to be taken his time w/it so maybe it isn't such an open and shut decision as everyone seems to think? I have to admit that I keep checking back to see if a decision has been made yet.:blushing:

I wouldn't doubt that it was Cindy who wanted to sleep in the same room with Casey, to try to keep her from telling Tracy anything incriminating. Not saying that's what happened, just saying it sounds like Cindy, always trying to be in control.

"Casey didn't want to come in (her bedroom) at first because this is where she and Caylee spent most of their time," Cindy Anthony said. "We got an air mattress and she wanted to stay in our room -- and we have a big enough bedroom that she had a big enough space -- for the whole first week."
Such liars they are.
That was AFTER Jose came in and physically walked Casey out of the room with Tracy because they were chatting too much.
"We got an air mattress" Ha! Wonder if it's the same one she said Casey had for when Caylee slept over at the invisible Nanny's house.

I wouldn't doubt that it was Cindy who wanted to sleep in the same room with Casey, to try to keep her from telling Tracy anything incriminating. Not saying that's what happened, just saying it sounds like Cindy, always trying to be in control.
You might be right ... maybe all three slept in there ... Tracy on the air mattress ...

I just keep wondering what could possibly be the holdup with the document release??????
Interesting thought. I hope you are right. I do find it interesting that the judge hasn't ruled on this particular motion yet. Everyone seems to think that he will delay the fraud trial, but he seems to be taken his time w/it so maybe it isn't such an open and shut decision as everyone seems to think? I have to admit that I keep checking back to see if a decision has been made yet.:blushing:
I think it's a shame if they delay the fraud case. Casey will get convicted of murder and the fraud charge will go by the way side denying Amy her day in court.

Thanks Des,
Maybe PART of that is true ... the air mattress in her room and if Cindy did sleep in there with Casey, why the air mattress, why didn't they sleep in the same bed? why all the fuss with the air mattress?
Guess Tracy's statements will clear up a lot of questions

Taped Interviews To Be Released In Anthony Case
FBI To Interview Woman Who Bonded With Casey Anthony
http://www.wesh.com/news/20604174/detail.html
the state attorney's office told WESH 2 they will release audio taped interviews with bail bondsmen Leonard Padilla and his team. That means the public will hear what they heard and saw from Casey Anthony long before the case goes to trial..............
The spokeswoman for Lawson Lamar said they plan to release the tapes because they are part of the public record. She plans to do that late next week or the week after.

Me too, Jeepers ... good ones ... Cindy's no doubt preparing her "Spin" on the events that week, that should keep her busy!
Just my opinion: I will always believe the A's knew Caylee was gone before day 31.Maybe not know as a fact but they knew something bad had happened. Cindy has been just too together. I understand her "frushtration" having to answer direct questions from the media
I just don't see how she could put together information on everyone and keep journals of what she said and everyone else "binders". I can't believe she would/could redecorate Caylee's room. "My heart would not let me"
She did not have time to mourn Caylee or time to look for her and her real killers.
I just think when the public did find out about this case. Cindy was already prepared beforehand. Cindy just underestimated the public's concern and wanting justice for Caylee.
I love you, Kat, but I don't think George's responses were thought out in any way. Period. I think he had decided to be Mr. Nasty Pants that day, and he was just taking offense at every straw that he could grab onto.
The "fingering" thing was another example. What a doofus.
I think Jose is stuck between a rock and a hard place. Cindy's to volatile to use on the stand and George's lies are as transparent as the 'Nanny'.

It will come in the form of a motion arguing there is insufficient evidence to support a murder charge against Casey Anthony.
Not enough evidence?!? :confused::scared:
There are no witnesses to Caylee's murder, but how does the defense explain:
Casey was the last known adult to be with Caylee.
Caylee was missing for 31 days before anyone knew Caylee was missing.
Cindy calls 911.
Casey lied to LE for over 12 hours before she was arrested for child neglect.
Casey said Zanny the Nanny kidnapped Caylee.
Casey said she told Jeff and Juliet about the kidnapping.
No one can find Zanny.
No one can find Jeff or Juliet.
No incoming or outgoing phone calls to Casey's phone from Zanny, Jeff or Juliet.
Casey's car had hair with the death band and decomp odor and residue.
Casey dumps the car and tells her friends it is in the shop and she is getting a new car.
Casey parties, gets a tattoo, manicure, parties more during the 31 days her daughter was missing.

I agree w/you. I don't believe that AL truly believes that there is not enough evidence to support a murder charge against Casey. I think it is grandstanding on her part and also a chance to try this case in the media. It will get the headlines out there that state that the defense says there is no evidence against Casey. Kinda how they got all the headlines about Caylee's body being moved to the remains site after Casey was already in jail by bringing up their latest ridiculous defense theory. AL is doing it to try to create reasonable doubt and I am sure she expects to lose the motion. I know she is just doing the work that is expected of a defense attorney, but it still doesn't infuriate me any less.:sneaky:

For me if I was sitting on this jury the forensics would play a very small role. At the end of the day Casey can't place Caylee in anyone else's hands but her own. She never claimed to have left her in the yard for a minute and came back and she was gone. She never claimed leaving Caylee in the car to run into the store and Caylee and the car were gone when she came out and there is not one shred of evidence that a Zanny ever existed. Until and unless they can place Caylee in someone else's hands all the evidence leads right back to Casey.

I so agree w/you. To me, if Casey was so innocent then she should be able to name the person that kidnapped her daughter or she should be able to explain just how Caylee got out of her possession.
The fact that the defense has to latch onto some far fetched theory that Caylee's body was placed at the remains site after Casey was already in jail just reinforces the fact that she is guilty, at least to me it does.
If your client is innocent then you take them to LE and have them tell them just who had your daughter. You don't sit in jail for a couple of years and latch on to outlandish defense theories.
And I don't buy that Casey is being quiet to protect her family.:sneaky: Caylee's dead and she is in PC in jail. I, for one, am dying to see what Tracy McLaughlin has to say about Casey's time in the Anthony abode. I'm sure her observations will shed much light on the dynamic in that household. Gonna make for good readin'!
I have been waiting for her to tell what went on in the house of Cindy for soo long. Can't wait.
I have to plan my menu for reading munchies!

:cursing:When will the A's ever get the message - Caylee is not, never was, a missing child. She is a murdered child and they raised her murderer in their own home. They should just go home, shut the door, wait a year or 2 until casey is convicted, then try to start over again. They look foolish and attention seeking participating in real missing children events like these.

No but I would
1. Glady watch the A's reaction and
2. listen for free after the major networks pay for it. :tonguewag:

How many think this motion will be over 100 pages?
Since AL seems to be a bit of a windbag, I'm going with "over."
I will go with over 100 she wore me out last Friday saying a whole lot of nothing.

So am I. Heck we have the teaser now going to be probably a week before we get to see it..
Just read to where AL is filing a motion where she says insufficent evidence to charge casey with murder..
Also, some time after Labor Day, Andrea Lyon from Casey Anthony's legal team will make her first major statement in the case.
It will come in the form of a motion arguing there is insufficient evidence to support a murder charge against Casey Anthony.
OK AL guess you've been too busy teaching to do your "HOMEWORK"
I have a question. Isn't the grand jury's purpose to see if there is enough evidence to go for Murder charge. Can that be changed with a motion???

Okay all you moralists. :tonguewag: I'll buy it and send a copy to you for the low, low price of $9.99. But wait! There's more! I will throw in a anatomically correct chart of where George's vital organs *should be* and a replica handbag that houses them now. If you act now, you will also receive the Mexican Jumping Bean that has acted as Cindy's character for the last 51 years. (Plus Shipping and Handling charges.:sneaky:)

I thought her objection was with the death penalty, not the murder charge. I could be wrong.

Hi sammy
From this statement that was made today "Andrea Lyon from Casey Anthony's legal team will make her first major statement in the case.
It will come in the form of a motion arguing there insufficient evidence to support a murder charge against Casey Anthony."
From this statement (my bolding) that the professor has made should be imo argued in court in front of a jury in order for this to be stated. jmo

KP, if you are still here...
What sort of things could we expect to see in the motion AL is expected to submit addressing the lack of evidence for a DP sentence? (add murder charge)
To me the evidence is overwhelming, but I do not know how much of it would be admissible.
Thanks
