Judge sets February trial date in torture case

A February trial date was set for four adults accused of torturing a 16-year-old boy and holding him captive for more than a year inside a Tracy home.

“I am concerned about this case getting a little stale, and authorities would like to see this move along,” said San Joaquin County Superior Court Judge Terrence Van Oss in a brief hearing today.

The judge also extended until October a deadline for attorneys to file any pretrial motions, including those challenging a 17-count indictment handed down by a grand jury in March that accuses the four defendants of brutally torturing, cutting, beating and starving the teenaged victim, called Kyle Ramirez in court records. So far, defendant Michael Schumacher's attorney John Casanave is the only one to have filed a written challenge.

The four defendants are Kelly Lau, her husband Schumacher, their houseguest Carén Ramirez and their next-door neighbor Anthony Waiters. If convicted on the charges, the four could spend the rest of their lives in prison.

Nearly 1,000 pages of transcripts of witness testimony from the grand jury hearing earlier this year details the horrific abuse allegedly inflicted upon the teenager. The four adults allegedly beat the boy with baseball bats, burned him, sliced him with a meat cleaver and openly plotted his murder.

The defendants were ordered back in court on Nov. 9, when their attorneys will present their arguments challenging the indictment.

The trial is set to begin on Feb. 1 and last about two months.

Get this case to trial so these monsters can starting serving their sentences for what they did to this young boy and how they destroyed his childhood... I hope they all rot in prison.. they should endure what they did to this young man... it's disgusting.

Have any of these freaks actually made bail? Do you know Jen? I went back to the older articles & couldn't find any mention of whether they have or haven't. TIA

I know Waiters bail was set at $1.9M, I would hope the others were set higher. I find it hard to believe he could even come up with 10% cash given he was still living with mom and dad.

Nope... they are all sitting in San Joaquin Jail... they aren't going anywhere.. not sure if Michael Schumacher even made a plea yet...

I still can't believe people actually defended the one guy that was the youth football coach, Tony Waiters... hopefully this case isn't delayed and they all are sentenced to long long long sentences.

I believe the Schumacher's kids are still in foster care also.. if they could do what they did to Kyle.. can you imagine what they kids think.. or saw...

Glad to see they held a grand jury.. moves it along faster.. there shouldn't be any excuse for anything that they did... IMO

A new attorney needs 10 months to prep?!

Personally, I'd like to see these guys held accountable as soon as possible. And I have to think that would be best for Kyle as well, to face these people and move on. But, the wheels of justice frequently grind slowly.

Yes, but in a way, its poetic justice...let them sit in a confined space, held prisoner, with no idea what their futures will be like. Granted, they won't be physically starved or tortured, but at least its something.

Trial delayed 'til October 2010 OMG I guess the only good thing is I seen they are still in jail but I sure wish this child could get the JUSTICE sooner
