View Full Version : Videohelps clear convicted child abuser 21 years later
It was held back from the defense. This poor guy was considered the worst of the worst in prison for 21 years not just a child molester but a gay child molester. only edited portions were shown to the jury, one of a child saying repeatedly "wheres my prize, i want my prize" and all the many interviews with kids saying he never touched them...well they were hidden
Convicted in 1985, Baran lost his first appeal. For the next nine years, he had no lawyer because his family couldn't afford one. He was transferred from prison to prison after being beaten, sexually assaulted in the shower and having his eye split open by an inmate's fist.
"If you're considered a child molester, you are the bottom of the barrel," Baran said. "To be considered a gay child molester? That's the worst of the worst."

I'm not an advocate of litigation, but this is exactly the case that screams for it. 19 when convicted, 40 when released, how is this man supposed to put a life together for himself and secure a future for his old age?
The editing of the tapes, and oh so convenient loss of the unedited tapes for so many years, makes it clear the prosecution was wrongful to begin with and they knew it.
He needs to sue if only to provide for himself in the future.
From the article:
Baran knows he could sue Berkshire County, home to expensive vacation estates and breathtaking views, alleging wrongful prosecution. He doesn't know if that would make him feel any better.
"It doesn't seem like it's enough," he said. "Unless there's some kind of change in the system that would make it impossible for this to happen to someone else."
I can't imagine this man is going to transition to life outside of prison easily. How is he supposed to get a decent job lacking any experience at 40 years old?
Without the emotional distress of his experiences that would be nearly impossible, with all he's been through, he needs to be taken care of financially. Free of financial concerns, he could advocate for the changes in the system he needs to see, which will help heal his soul.

From an ethical point of view (not a legal point of view) justice would be that the person who once falsely claimed the abuse has to spent almost as long jailtime like the one who was jailed on the basis of false allegations. One should count the years from the age 18 of the lying abuse victim on imo.
While children can't be called to account in most cases because sometimes they act in behalf of their parents they are able to reflect on the situation and injustice when they are an adult. Justice is on them and their responsibility. There are no excuses for those who don't come up with the truth. They should suffer the same way the victim of false allegations had to suffer imo.
False allegations should be punished harder.... - only then these cases would stop!
All the above is my opinion only.

One can see on the pic that the soul of the man is broken.

It is heartbreaking. He looks so defeated, and no wonder. The level of misconduct in this case ..astounding.
