I didn't even know he was trying to appeal. What was the basis? "I was drunk when I stood there and squeezed out a tear and told about how I killed Jessie by accident". PUH LEASE.

I wondered why it said Tara I knew it was Jessie and her unborn baby Chloe and I also think of little Blake poor thing his father should never be able to see him leaving him alone in a place he had no regard for his safety ..ugh wont even get into it...good news.

He must still be out of his mind. He must have written up the papers himself, surely no qualified attorney would waste the court's time.

I just read the Appeal Court's Opinion.

Attorneys for Defendant-Appellant: Carolyn Ranke, Myron Watson and Fernando Mack.

They raised 13 assignments of error by the trial court. All overruled unanimously by the appeals court judges except one. One judge's comments attached to the opinion read that he would "sustain appellant's first assignment of error as to counts one and two but overrule it as to count three." The first assignment of error is - "The Trial Court erred in failing to instruct the jury on the lesser included charge of involuntary manslaughter".

Count One of the Indictment - Agg. Murder Jessie Davis
Count Two of the Indictment - Agg. Murder Termination of Pregnancy
Count Three of the Indictment - Agg. Murder Baby Chloe

Wonder if Ole Bob will take it to the Ohio Supreme Court?

I had no clue he was trying for appeal either. When I spotted this headline I was like... w h a t............

I wonder how little Blake is doing and if Jessie's Mother has taken him to visit Bobby?

I don't recall involuntary manslaughter being part of the jury instructions at all.... where was that buried? AND why didn't the defense speak up prior to jury deliberations, instead of sending him down the river? OMG just the thought of that Ranke's voice and courtroom antics gives me shivers. lol

They did as to counts one and two. Trial court denied the request.

Taken from the Opinion:

"Appellant requested instructions on the lesser included offenses of murder and involuntary manslaughter based on counts one and two."
Involuntary Manslaughter provides:
No Person shall cause the death of another or the unlawful termination of another's pregnancy as a proximate result of the offender's committing or attempting to commit a misdemeanor of any degree..."
In this case, Appellant submits that the predicate misdemeanor offense was domestic violence under R.C. Section 2919 which states:
No person shall recklessly cause serious physical harm to a family or houshold member.
In order to warrant an instruction on domestic violence, Appellant would have had to present some evidence that he engaged in an argument with Jessie that resulted in him recklessly causing serious physical harm to a family member.
The trial court gave an instruction on murder but refused to give the instruction on involuntary manslaughter. ...

and most specifically...

"Appellant made the tactial decision to argue that he had no culpability for the deaths in this case. To later argue that Appellant was culpable for such deaths, but to a lesser extent, would have been wholly inconsistet with the defense theory."

This is good, but to think that the woman that helped him dispose of the two bodies is already out and raising her daughter again makes me ill
