Article I, section 6 of the U.S. Constitution provides:

"No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States, which shall have been created, or the Emoluments whereof shall have been encreased during such time."

I'm fascinated by it but I think with the Democrats in total control it will go no where. But perhaps it will set some kind of precedent. At least no one is saying President Bush did it first. imo

Didn't Obama teach Constitutional Law before entering politics?

Why wasn't this caught before now? There has to be some kind of exception that allows appointment.

Teaching and understanding are two very different animals. Just look at most public school teachers for supporting evidence.

IMO


I have a hard time believing that no one caught this before now.

Members of Congress, well aware of the "emoluments clause," attempted to evade this clear constitutional prohibition with a so-called "Saxbe fix" last month, reducing the Secretary of State's salary to the level in effect on January 1, 2007. This maneuver, first used in the Taft Administration, has been more frequently used in recent years by both parties, allowing Republican Senator William Saxbe to become U.S. Attorney General in 1973 and Democratic Senator Lloyd Bentsen to become Treasury Secretary in 1993. A similar "fix" has been enacted for Senator Ken Salazar to join the Obama Cabinet as Secretary of the Interior.

I think BO was well aware of, and understood it. I believe BO wanted to remove HC as a threat and opponent by appointing her as his SoS, and removing her from the Senate. ("Keep your friends close, but your enemies closer".)

I can't help but notice the diminished role HC is playing when compared to her predecessor. Condi Rice went everywhere with GWB. Was HC, who had always been viewed favorably by Jewish groups, strategically chosen to chide Israel in favor of the Palestinians back in February/March?

Today, a meeting of Asian leaders in Thailand turned into the set of "Mean Girls": North Korea called the Secretary of State a "funny lady" who "looks like a primary schoolgirl and sometimes a pensioner going shopping." Ouch. To be fair, Clinton stirred it up earlier this week when she compared North Korea to "unruly teenagers."

I seem to recall that her salary had to be lowered to a Senator to have this appointment. She was not allowed the increase in salary due to the jump in as Secretary of State. Unless it was my imagination.

You recall correctly, it came up after he was elected, and the TH's talked about it, and it was shown it's come up before and the way around is to not take the pay increase.

From what I have read, he taught a course in constitution law at University of Chicago. Not a Professor and any claims or credintals of being a Consitutional Scholar are thin at best.

Lawyers for Elizabeth Colton filed suit yesterday in US District Court for the District of Columbia alleging that Hillary and the State Department violated her rights by enforcing a mandatory retirement age and denying her a job at the US embassy in Algeria.

Actually, the requirement for Senator is to be 35 and a Native Born American is a Presidental requirement only.
