No previous record, and the family wanted this resolved.

He stopped - didn't flee the scene, was driving 50 in a 40 (not huge speeding), and the pedestrian was not in a crosswalk - sounds like there may have been fault on his side as well. He's been cooperative and apologetic the whole way through.

I can see it. It's more of a tragic accident, a combination of two factors - a construction worker in a hurry to get home after a long night of work, a guy who made an apparently rare (never had a DUI before, just got a huge bonus he was apparently celebrating) mistake of drinking too much and still driving home.

This isn't some habitual DUI, massively out of control hitting someone who was just where they belonged. A lower sentence makes sense to me.

I'm not usually for "leniancy" in drunk driving cases but the description of what happened does sound like he is taking responsibility for what happened and has from the start. He stopped, did not refuse to speak to LE without his attorney, voluntarily took a blood alcohol test, etc. He cannot undo what happened and I think he has done the most that he can under the circumstances. Putting him in jail for a long time where he is unable to financially help the victim's family will solve nothing.
Now, if he is ever again caught DUI, I think he should be put under the jail!

He better not be caught driving ever again.. he gave up his license for life is what I heard on the news this morning. Goddell has suspended him indefinately from the NFL.. not to sure how I feel about it. Sounds like the family was paid off actually... but I don't blame them for no wanting to go through a trial. Been there done that.. only it was a malpractice case.

I agree he does seem terribly sorry it happened and the man was not in the walkway.. I don't think drunk or sober anyone would of expected him to be in the road where he was.. it's just the money.. just kind of sounds like he bought his sentence... I don't know...

Just a very very sad situation for all those concerned.. both sides lost.
