I think that Judge Strickland is following the law.
To date, he has ruled fairly on motions before him regarding this case.
He is very careful to make certain that all facts are in and all parties involved have their say before making a ruling.
His order to temporarily stay the release of the autopsy results is scathing in it's criticism of Conway:

Strickland makes it clear in his order that it is the media who are the true parties of interest in the release of the autopsy results.
I have yet to see any order from Judge Strickland that grants special treatment of any sort to the Anthony's.
I do think that he is very cautious in striding through all of the BS not to step into any himself. He strikes me as being very concerned that the court's proper focus on the case not be swayed off course by the sideshow.
I guess what confuses me, blu, is why the Sunshine Laws don't seem to be uniformly applied. Are those laws only in play if no one objects to certain pieces of discovery being released? Could you or I have filed a motion to withhold release of the autopsy report, and Judge S would have responded as he has to Conway's motion, by requiring the media to make, like, an "extra special" request for this particular report?
I'm quite confused. :huh:

I'd like to know how the Anthony's attorney, Brad Conway got a look at the autopsy report. He does NOT represent Casey so how did he see it?
(He admitted on the Today Show that's he was given a copy of it.)
This brings up an interesting point ... aren't the Ants a part of the public that should be able to view this report? :confused:

It is SO hard to believe that it has been a year since that little princess left this world. All of the things that have gone on since we all learned about her disappearance has been mind boggling, hasn't it?

NeJame flat out refused to have anything to do with Casey's defense.
Conway considers himself a member of the defense team, IMO.
I want to go even further and say that I have heard Conway speak of supporting the defense, but don't want to look for the link...:confused:

okay so, in light of all the threads started by one poster .... each being a question of other posters thoughts..... isnt that against the whole one thread a day thing we voted on .... at least until trial.
personally I like the one thread gig, and most are polite when questions are re-asked because no one can be here to read the whole thread each day....

If you're referring to all the "single subject" threads cropping up on the main page of this forum, my recollection is CW gave us the option to keep everything on the daily threads, or ... to have this situation that's going on now. I think we decided, way back when, to stick with just the daily threads, with the occasional additional reference-type thread, if necessary. In fact for awhile, CW was automatically merging any "single subject" threads that cropped up into the daily threads if she could, or alternately, closing them quickly.

You know, didn't BC on some morning show appearance or LK claim there was no tape around Caylee's mouth? Seems I recall that, but yet I recently heard an audio clip wherein RK said he just found a skull with tape around the mouth. Somehow, I believe Mr. Kronk on this one.

ITA. I don't think the two camps are estranged at all. At least not yet. No matter whether they look at each other in court anymore, it's obvious they're still thick as thieves.

Underneath all her public support of Casey I believe is a whole lot of rage built up over many years. The same rage that she takes out on inanimate objects in her backyard. When that guilty verdict is read Cindy may appear devastated but inside I think she will finally have that self satisfied feeling that she told Casey for years some day your lies are going to get you into big trouble. and she will leave that courtroom thinking Casey is just getting what she deserves. And then she will talk to the reporters about appeals and new evidence and all the usual things.

Evidentally you can say anything to the media. Confuses me because weren't crucial pieces of "evidence" (not sure what to call it) in the Scott Peterson case his media interviews where he flat out lies? And his lies were proven?
I guess attorneys can lie to Larry King with no consequence but I don't understand how George, Cindy and Mr. CMA! CMA! get away with it.

Following a written response to the motion by interested media the Court will either rule on the pleadings or set a hearing as necessary.

Thanks for clearing that up, I was getting the media involvement for the video mixed up with the autopsy one ... so Strickland will make a decision based on written request from the media and the video argument from the media will be heard at the end of June hearing?
Do you know what will come of the state's objection to the 60 delay on the video hearing? Is that also something that Strickland can decide without a hearing?

I've been mostly pleased with Judge Strickland's rulings. In the last court hearing, he allowed Baez access to all of George and Cindy's phone records (they didn't have Conway argue against Baez's overly broad motion). The Anthonys may have made a huge error, by their decision to not object to Baez's motion. Time will tell.

Well, yeah, it is confusing.
I am not an attorney and certainly don't claim to have any grasp on FL's laws regarding release of discovery, Sunshine Law, etc.
However, I think that C&G's status as legal guardians of Caylee's remains distinguishes them from any other citizen who might file a motion related to Caylee's autopsy report.
So, I am just guessing here, but if Strickland made an error in responding or disregarding this motion's request, could that potentially prevent the autopsy from going into evidence at the trial?
Because, if that happened, it would be a disaster!
I see Strickland as guarding the integrity of the this case and potential evidence. It must be like walking through a mine field.
I guess it doesn't show that I am a fan of da judge! :wub:

What questions will the Prosecution ask Cindy? i.e. When was the last time you saw Caylee? When did you discover Casey's car was towed? How did you find Casey? When did you discover Caylee was missing?

It is my understanding that although cindy and george are/were legal guardians of Caylee's remains, they were NOT legal guardians of caylee AT THE TIME of the murder of caylee, and the AUTOPSY RESULTS being evidence in the prosecution of the MURDERER of caylee does NOT give the Anthonys the right to even ASK for anything to be withheld....

It is completely "kosher" for attorneys to talk to each other about the facts, evidence, witnesses, litigation strategies etc. in a particular case, even if the attorneys don't represent the same client. Doing so is a form of "Attorney Work Product" which is not discoverable.
I have often collaborated with attorneys representing clients whose interests were aligned with my own client's interests, sharing confidential information about the case. By way of example, let's say I represent a central California school district as a defendant in a lawsuit arising from an accusation of intentional misconduct on the part of a school district employee i.e. a principal, a teacher, a janitor, etc. Let's say a different attorney represents the employee. The primary reason these two parties would have different attorneys is because if the accusations are true then there might be a conflict of interest between the school district and the employee because the school district might assert its right to equitable indemnity (i.e. to be reimbursed by the wrongdoer.) On the other hand, if the accusations are not true then the parties share a mutual interest in disproving the accusations. There is no prohibition against sharing investigation expenses, sharing confidential information and otherwise cooperating with the defense of the case (with the clients' permission, of course).

Those are good questions. The State is requesting that the Judge rule on the jail video, the Media is requesting that the Jail Video be released, and ....I'm sure that a hearing will have to be held to allow them to argue this. And, Baez wants everyone to just forget about the jail video, until he has the time to go fishing. This could be an interesting day in the courtroom. LOL
Shucks.... it was clear back in early March, baez hadn't yet seen the video, yet he filed something then..... it's now mid June, and the issue is still not yet ruled on. So much time, so much effort, so much expense, all for something that may or may not ever be used against Casey in a courtroom. When is enough enough?

I don't think that they will get away with their lies.
Why do they lie?
To cover for Casey.
Who will their lies sway?
No one.
The A's have no credibility and it will be obvious to the jury.
The prosecution will show them as unable to tell the truth.
I think that the first thing the jury will do when they go into deliberations is throw out every single bit of testimony from those 3.

Seriously though, everyone knew on December 11 that a skull was found and anyone with a pea brain would deduce there was no flesh left after 6 months; and anyone who's watched forensic shows knows hair stays a long time. He was twisting the truth to influence the public.

I'm no expert, either. But it seems to me one of the judge's roles is to move things along, and not allow a lot of dithering around like we've seen so far in this case.
I mostly expect the foolishness on the defense and Anthony sides of the fence (which is essentially the same side of the fence) to ramp up the closer we get to trial.
It would seem right now Judge S is willing to entertain anything and everything they throw out there.
I'm sure he's being cautious and careful. And I'm grateful he's not an orator like Rodriguez, nor does he seem ruled by his ego. I just hope he can get things back on track, because right now it seems the inmates are running the asylum.

thank you ~layla~ for bringing that up. I thought the same thing- and could recall there was a poll up at one point on how should the forum be.
So when I do have time to log on (and thinking "oh" when seeing all the separate thread subject lines) I stick with reading what's being discussed on the daily thread and the links thread.
I'm surprised there hasn't been merges/deletions yet- I typed too soon, IRRC one got moved to OC.
Does anyone know if the local media plans to do any coverage of any public plans for marking the year's passing tomorrow?

I think that's why the state made its motion. Enough already with the ridiculous distractions. I just wonder why the state had to be the one to say let's move this along. I would think that's the judge's role.

When Dr. G read her report she stated, and I believe truthfully she did not know how she died, but it was ruled homicide because of the circumstances. She did not have certain reports back such as toxicology.
There may be something in the final report that would seal Casey's fate...but I won't hold my breath...I don't know if we will ever see a smoking gun in this case...but when you put all the little pieces together it becomes one big piece. A very strong circumstantial case.

Sorry to confuse the issue but the defense filed a motion to delay a hearing on the video which means if he grants it, the video issue will not be heard at the end June hearing ... the state filed a motion against their motion ....

Seriously though, everyone knew on December 11 that a skull was found and anyone with a pea brain would deduce there was no flesh left after 6 months; and anyone who's watched forensic shows knows hair stays a long time. He was twisting the truth to influence the public.

I've wondered if that might be part of the reason Judge S seems to have no particular sense of urgency. Maybe he's waiting for Baez to be removed from the case and/or disbarred, which could save him the hassle of hearing or ruling on some of the current stupidity (though not the autopsy report).

You're right Sun- NG mentions it a lot in her shows, about the light colored hair found with the skull.
Last year I thought that the reason Cindy was quizzing Casey was that there were 2 (?) witnesses that said they had seen bruises on Caylee's face and had taken cell phone pics when Casey was at the hair salon.
I thought she was trying to dispute anything that others had to say about her DD and GD with that questioning.
But since time has passed- and we've learned more of how pics were deleted from the computers and the FB/MS sites and gosh knows what all was found in the car or in the home that was tossed so as not to bring more suspicion - who knows if Casey "on a whim" decided to alter her daughter's hair color- she herself went thru a blonde phase (badly, imo).

Yes, I remember that too, but when they said light colored hair, they may have been referring to light colored hair as opposed to dark or nearly black hair...such as hispanic hair or African American hair.

I think the lack of urgency is the fact that this will not go to trial for at least a year. Grins can complain about discovery not being turned over in a timely matter but I believe that there is plenty of time. jmo

O/T but speaking of hair, remember the scalp with braids that was found in, Colorado IIRC. The young woman who had gone missing many years before and they found her skull and hair worn the same way in photos. It's been featured on several programs and it was truly amazing that she was located.

Notice of intent to seek the penalty of death was filed by the State on 4/13/2009. A Motion for determination of Counsel prusuant to FL rule of criminal proceduce was filed 5/7/2009. And FINALLY, June 12th was when Lyon was admitted ad hoc vice. ....who is delaying and dragging things out, I ask?

I'm no expert, either. But it seems to me one of the judge's roles is to move things along, and not allow a lot of dithering around like we've seen so far in this case.
I mostly expect the foolishness on the defense and Anthony sides of the fence (which is essentially the same side of the fence) to ramp up the closer we get to trial.
It would seem right now Judge S is willing to entertain anything and everything they throw out there.
I'm sure he's being cautious and careful. And I'm grateful he's not an orator like Rodriguez, nor does he seem ruled by his ego. I just hope he can get things back on track, because right now it seems the inmates are running the asylum.

I'd like to see some proof that the Anthonys are legal guardians of anything. You cannot be a "Legal" guardian just because you say you are. There has to be some paperwork to prove this, and I doubt they have taken this step. I know that Casey apparently told them they could make arrangements for the remains, but that does not make them legal guardians, and without this, they have no standing to have filed this motion. I hope that if Conway did not attach these papers proving guardianship that the judge will throw the thing out.
Furthermore, I think the Anthonys would have to be court appointed legal guardians, and I have heard nothing about that. If Conway has not been truthful in his pleadings, I hope Judge Strickland throws the book at him.
I assume everyone recalls when Conway stood up in court and said that the Anthonys were too distraught to be deposed and they had not appeared on TV since the remains were discovered, yet George had been on Graldo Rivera as well as sticking his nose into the Cummings case and speaking on camera. Conway did not know what he was talking about or he lied to the judge. He needs to be called to account for this. :cursing:

IIRC, the only thing the A's were in charge of was the remains. Casey was incarcerated so she signed her rights over to let her parents be in charge. They did not follow her wishes (surprise) and I think that's why there is a major rift in the Casa de Anthony. jmo

If justice is not handed down in a good fashonable sentence in the case..then truely the american justice system CONTINUES TO FAIL children and americ accross the world!!!!!

I think Judge S is being very methodical to do everything by the book so nothing in the trial can come back to bite. However, this neglecting to notice the media was clearly a stalling tactic by Brad and I think Judge S made it clear that he knew that.
I think Judge S will get the proper notification from the media and will rule that the autopsy report should be made public (like it's supposed to be to begin with).

I'll never understand how they are legally parties to this case. Conway has insinuated himself openly as an arm of the defense. I know the parents of any defendant are highly interested in an ongoing case for obvious reasons, but I don't get how they have legal standing. I don't get how they can be allowed to even file the motion to hold the autopsy back. I don't get why their motion wasn't refused straight away! Isn't their legal standing as significant as, say one of us? Technically?
I think it wasn't refused straight away because Brad conveniently neglected his duty to notice the media at the same time as the SA.
He's buying time for the Ants--and my guess is that even if C&A know they can't prevent release of the report until trial, they wanted to get it past this first anniversary of Caylee's death. There's something in the report that they think (know) is incendiary, coupled with the anniversary of her death, IMO. It could cause a negative media explosion "at this time" and that's what they're trying to control.

I think Cindy wouldn't know what to do if she didn't have all this hate inside her. I think she'd slow down to a stop. I think her hate protects her, and she knows it, and she holds it close to her heart, because living without hate is the one thing that scares her more than the devil himself.

Because Cindy didn't plan it, Cindy can't control it, Cindy will not associate Caylee's "terminal event" with June 16th, Cindy wants to plan one on Caylee's birthdate, Cindy wants to be able to prevent anyone she doesn't like to attend, Cindy can't be the attention of a memorial that she doesn't orchestrate, etc. etc. etc.
OH and PS: good luck Cindy if you try to stop them from planting a tree in Caylee's honor ...

I think that Judge Strickland is following the law.
To date, he has ruled fairly on motions before him regarding this case.
He is very careful to make certain that all facts are in and all parties involved have their say before making a ruling.
His order to temporarily stay the release of the autopsy results is scathing in it's criticism of Conway:

Strickland makes it clear in his order that it is the media who are the true parties of interest in the release of the autopsy results.
I have yet to see any order from Judge Strickland that grants special treatment of any sort to the Anthony's.
I do think that he is very cautious in striding through all of the BS not to step into any himself. He strikes me as being very concerned that the court's proper focus on the case not be swayed off course by the sideshow.

I'd like to see some proof that the Anthonys are legal guardians of anything. You cannot be a "Legal" guardian just because you say you are. There has to be some paperwork to prove this, and I doubt they have taken this step. I know that Casey apparently told them they could make arrangements for the remains, but that does not make them legal guardians, and without this, they have no standing to have filed this motion. I hope that if Conway did not attach these papers proving guardianship that the judge will throw the thing out.
Furthermore, I think the Anthonys would have to be court appointed legal guardians, and I have heard nothing about that. If Conway has not been truthful in his pleadings, I hope Judge Strickland throws the book at him.
I assume everyone recalls when Conway stood up in court and said that the Anthonys were too distraught to be deposed and they had not appeared on TV since the remains were discovered, yet George had been on Graldo Rivera as well as sticking his nose into the Cummings case and speaking on camera. Conway did not know what he was talking about or he lied to the judge. He needs to be called to account for this. :cursing:

I had planned on being on the board all day, for Caylee, but ended up with my 18 month old grand daughter most of the day.
Her little hugs and her little kisses, reminded me of the preciousness of Caylee. Sweet pure lovable innocence.

When she was alive they could have helped her survive, and they didn't.

Something that has stuck in my mind and is still making me wonder. Cindy once said during a media blitz, something about the kidnapper could have dyed Caylee's hair blond. In a jail visitation video, Cindy made a point to ask Casey who had worked on Caylee's hair (Casey denied that anyone ever had). Sometime after Caylee's remains were found, I recall mention of a skull and light colored hair. ......I want to see the autopsy report and findings.
Sun, I've wondered about the light-colored hair comment too, because in all the photos of Caylee, she appears to have chestnut-brown hair--a pretty brown, but more on the dark side than the light side. I thought the "light-colored" statement was strange.

I wish they would start off the interview with asking the Ants about the wonderful memorial that is taking place today and why they wouldn't want to attend it! I'm sure Richard Grunds blog about the memorial and all of the money that's been coming in and how the extra is going to be used to plant a tree in Caylee's name are making Cindy really, really mad! Maybe she will just come right out and say that people should be making contributions to her foundation not some vigil in the park ... you know she'll be thinking it!:mad:

I had planned on being on the board all day, for Caylee, but ended up with my 18 month old grand daughter most of the day.
Her little hugs and her little kisses, reminded me of the preciousness of Caylee. Sweet pure lovable innocence.
Today I am furious with Cindy and George for betraying Caylee.
When she was alive they could have helped her survive, and they didn't.
In her death they have betrayed Caylee, and for that I am beyond words and filled with rage towards them.

Making gingerbread houses... driving her around at age 3 in my convertible blasting fun sing-along music on the tape... Ah.. those were the good ol' days. She is a wonderful person now. I'm not a lawyer, but some others here have said that BradC based this on C&G being legal custodians of Caylee's remains, and that's how they inserted themselves into Judge Strickland's courtroom. I don't think it will hold. I think the autopsy will be made public as soon as the correct i's and t's are taken care of.

well, they are going about this whole thing the wrong way that is for sure. And no matter who would be at that memorial, they would not have to mingle, simply show up to show that they honor that little girl.
They are going to talk against it on the Early Show -- after all, it wasn't authorized and planned by them.
And they'll be furious that a memorial is being treated as the day Caylee died, because they will spin that Caylee wasn't dead all those months, they had reports and sightings, and her body showed up at the dumping ground when Casey was in jail. Casey couldn't have done it.
I just betcha that's their spin ...
I'm not getting up to watch the show.

They are neither pure of heart, nor clean of hand when it comes to working toward justice for Caylee. I know a lot of you folks have joined the bandwagon more recently that the Anthonys are in this for money, after the fact. I, personally, joined this case when the 911 tapes came out, and stated at that time that I thought they were in this for the money. Reality has supported this.
These people are scum, IMO.....

I agree with everything you say, Imp. So it's OK for you to be crabby. I think Judge S will throw it out as soon as he has the required response from the media--and I hope he slaps BradC's hand for using such an obvious delay tactic and being unprofessional in not noticing the media. I think Judge S is just making sure nothing can come back to bite.
However -- the Ants may have gotten what they wanted anyway -- to delay the release of the autopsy report until AFTER this anniversary of Caylee's "missingness" (death) because they want to get past the anniversary -- there's something incendiary in the report (Dr G's conclusions based on the later tests that came in) and they want as much separation from that news and the "DATE" as possible. Damage control.
I agree that it's sickening that Cindy gets her way in all these actions. She's infuriating.

Was there not some theory that Casey may have sprayed Caylee's body with pool chemicals to slow down the decay?The chlorine in the pool chemicals could have bleached her hair.

I just know that I will not sleep tonight.....Just thinking about Caylee....I can not help but think about what she must have seen....what she must have heard.....what she must have been feeling......she must have been afraid......
It was 9:30 a year ago that only God and those people know what was going on in that family.......I TRY to take comfort in knowing that now, God is taking care of caylee....THEY can NOT harm her any more....I just pray that once with God, the memory of that horror is wiped away.
My husband works with crimminals and all sorts of lowlifes and he too is upset....but he is also numb to a lot of the things that upset me to the point of being physically ill!!

IMO, they're not going to show up for 2 reasons (at least 2, maybe more). Main reason is that they're not going to admit the possibility that Caylee was killed around this date. They're going to go with a much later date for the murder (while Casey was in jail) or they're going to maintain that Caylee is still alive.
The 2nd reason they're not going to the vigil tomorrow is because promoters of the vigil are friends of Richard Grund and they're still trying to throw suspicion onto Jesse.
I guess a 3rd reason might be they would miss their luxury trip to NY.

Hey Kella! I love learning new words and "maundering" isn't one I was familiar with. It certainly fits with what JW does. She irritates me to no end.
I don't know if it's an official word but it's brilliant. Kinda like a combo of marauding (as in marauding bear) and meandering, as in wandering pointlessly.

Well, it looks like an early night here at IS / Caylee. I'm going to head to bed early -- lots to do tomorrow, so must get up early (not my favorite activity).
I'm lighting a candle for Caylee. Poor sweet baby, I can't imagine what she was feeling one year ago tonight. RIP sweet angel. :rose:

My family is all from down south. My sister married a man from Michigan. They planted a beloved red maple in the backyard. I came down to visit with my dog, and he promptly chewed the red maple down to a nub, much to my sister's dismay.
Long story short.. .that red maple grew into a wonderful tree, and the "pruning" that my dog did actually led the tree into a great shape.
So never fear... if the Anthonys try to chop down that tree... it WILL come back.

I'm so glad that trees are being planted for her. CindyA is a control freak, and sad to say, there is a tiny shred of me that really understands how CaseyA must have felt being raised by such a manipulative sociopathic mother.
I fully expect Casey to put Caylee in Cindy's presence last she was alive.
I fully expect her to throw her parents under the bus. Case in point, her refusal to even acknowledge them in the court room. That spells trouble for Cindy and George, if ya ask me. And, I need those questions answered:
Cindy was out in the yard that whole week, yet never smelled a dead body in her own yard? The dogs never started sniffing like mad around that playhouse? They didn't bark like mad trying to alert their "owners" that this child was dead?
Sorry, I don't believe them. I do not believe the problem with their mix up in dates, I don't believe they never called 911 to alert LE that their childs car smelled like a dead body, and I do not believe their story about the dates they received the notice for the tow of the car.
Sorry Cindy and George, but I don't believe you. I believe it's highly likely that Cindy, George, Lee and Casey all had 31 day's to come up with their story.
And it stinks, to high heaven. So does the way in which this child was discarded. I believe it was made to look like a Pedophile took her.

Ummm, ya think? I wonder if Baez will stay the "Lead" Attorney, now that they have Death Lady on the team. Baez has been out of the loop for awhile now. He is only a detriment to the Defense Case. Why is he still "leading" the Defense?
She is now officially the lead attorney. This should free him up to get some other clients maybe?
If he DID have any other clients this past year, they should demand a refund.
He's spent so much time on this case, time he apparently hasn't used wisely that he could not have given much attention to anyone else.

I post on here once in awhile.. lurk mainly, Have been here since the beginning, having a greatgranddaughter Caylees age and today receiving pictures of her so happy and enjoying her life...the life Caylee should be enjoying.:rose:. Anyhow was thinking if all of you back east would just turn your TVs off the moment the Anthonys appear on the Morning Show, would it have any effect? And then turn it back on after their part was over. Can't do it here because of the 3 hour delay. Numbers mean alot. Just a thought. Thanks for reading.
