I think the anthonys fear Dr. G's report on exactly how the tape was found on the skull and in what position the tape was in relation to the "mouth." Dr. G will also speak to the residue left behind by the heart shape sticker. Conway will be exposed as a liar when he stated the heart sticker was not "found" on the tape. I think Dr. G. will confirm that the heart sticker was on the tape, around the mouth area of the skull, but thru time and water damage, it fell off.
I hope Strickland allows the release.
Right. But what BC said could be looked at as the truth. Because it was not "found on the tape". The residue is what they found, in the shape of a perfect heart. Then they found the sticker. So, he could always say he was not lying.

That's a very good point, Sun. I have my doubts that they have legal standing, as grandparents. They just keep inserting themselves right into the middle of this case, even though supposedly, they are not principles, just relatives.
Unfortunately, according to the motion:
"As custodians to Caylee's remains and (as) her grandparents, George and Cindy Anthony are respectfully asking this court to restrict the release of the autopsy results."
Doesn't cut the mustard for me, but that's what they're using.

ITA. I just wonder if George and Cindy have any legal standing to argue against the release of the autopsy. Casey is the parent, not Cindy or George. The State has already successfully gotten all crime scene photos of the remains and autopsy photos sealed, and for good reason.
If the autopsy is release now to the public, then this will be just one thing that the Anthonys can't use as an excuse to "breakdown" during the trial and try to get out of testifying. JMO

I just hope the judge approaches this from the standpoint of not wanting to set a precedent. If he opens up the door to the Ants' desire to keep evidence out of the public domain, he better block out lots of time to read BC's motions. And Conway better get ready to file motion after motion after motion.
I really don't think the Sunshine Laws were intended to be circumvented by family members of criminals OR crime victims with agendas.
With regard to your *urge* ... let's just say the Ants' antics tend to bring out the cra-za-zy in many of us. :w00t:
Like you said earlier, it's not about them. When will they finally realize that this a a murder trial and their daughter is the murderer? Where is the outrage? Why aren't the looking for Zanny the killer? They make me sick. imo

Since it is evidence in a murder case, it is property of the state of Florida. I don't see why either Casey or G and C have any say on whether the autopsy report is released to the public.
I'm sure they will all yell and carry on, but I don't see the decision being theirs.

I can see the As telling the court when Casey is being sentenced that DP or LWOP is going to cause them great distress. Who gives a hoot!
Having a baby murderer coming up for parole and possibly on the streets would probably cause the people of the state of Florida more distress, and they count, whereas G and C......not so much.

He can in Florida? If he feels it may jeopardize the case. I think he would only consider it if the defense put in a motion. I really don't want to look this up.

She has a right to counsel but she choose to remain silent. You guys are going to make me look up the statute aren't you? I don't know but I can't wait to read it. I think sometimes the Anthonys make a big deal out of it so everybody will read it and it's nothing. Like last time.

The counter argument is that when The People are prosecuting someone for First Degree Murder and seeking the Death Penalty, then the supporting facts need to be public. Basically the same rationale as why we have public trials in the first place i.e. to make sure government is not abusing its authority and violating the rights of the citizenry. This is particularly true where the defendant has already proclaimed that the prosecution is being done "on a whim" and has sworn under oath that she believes the death penalty is strategically intended to coerce a false confession and to force the defendant to plead guilty to a crime she didn't commit. Even Cindy herself recently claimed that Casey was being prosecuted just because Casey lied about her employment. The public has the right to know whether the justice system is being abused as described by the defendant (and Cindy), or whether there are facts - such as may be included in the autopsy report - which support the ongoing prosecution for First Degree Murder and seeking the Death Penalty.

What will upset me is if the judge allows this and stops
the release of the autopsy report...just for the fact that it will give more entitlement to the Anthonys and there will be no stoping them from here on out.
I resent the authorities allowing them any slack considering what liars they are and how they have tried to blame this whole travisty on others.

No disrespect intended, but I interpreted the news article differently i.e. that the report will NOT be released tomorrow but instead release will be delayed until a further hearing on the motion after the media who are the Real Parties In Interest get a chance to respond.

Orange Circuit Court Stan Strickland issued an order late Thursday that will delay the release of the autopsy reports, which were expected to be made public on Friday, until the issue is addressed in court. He wants to hear from the media about the Anthonys' request.

If you watch Dr G medical examiner show she does use any clue in her autopsies to form a matter of death, which must be proved medically .
She will not make a decision on a manner of death unless it is verified with facts.
Her autopsy on Caylee must have had proof that it is a homicide. Her show sometmes listed manner of death unkown so she must have some verifilable facts to say homicide.
I didn't even know she had a show on TV... Dang. I don't have much of a stomach for those autopsy shows on TV. When they pull out the hack saw, I'm running for the door - go cut the grass or something.

Thank you Kat. Always good to be reminded that the people of the great State of Florida also have an interest/rights in this case. They have a huge burden of proving murder one beyond a reasonable doubt.
I'm sure Lyon's motion to dismiss the DP in this case will be public.

G&A have no standing in this trail, they have not been arrested. They only have an interest, to sue. I have loads of case law on this.

You're right. They keep saying "we" don't know the whole story. I guess we'll have to wait til the trial to hear the big secret.

In a motion filed by their attorney, George and Cindy Anthony argue that "the information contained within in the report will cause great anguish to the Anthony family."
Perhaps George and Cindy should NOT read the report. Perhaps they should NOT watch/listen to the news. They have a choice.
Perhaps George and Cindy should pack up their belonging and move to some deserted island. Or, go into a recovery/rehab live-in program. They need to learn to deal with it.
I really need to stop reading here, these folks (Anthony's) actions really annoy me.. I am so sick of this being a three-way criminal trial: the State, Casey, and the Grandparents who keep inserting themselves and asserting their rights as VIPs in the criminal trial.
Can anyone claim "too painful"? What if someones aunts, uncles, siblings, spouse, WHOEVER, started saying "this stuff will cause me pain"?
I am sorry about the horrendous loss of their grandaughter, what an awful thing to go through, but the criminal trial is, in many ways, a separate event that must go on according to the law.
I have never seen the grandparents of a murder victim insert themselves so prominently in any case.

The good news is - Casey will be in jail while we wait.

I'm not sure she feels guilt. She might ... I'm just not at all sure. Guilt would be a normal response under the circumstances. I haven't seen a normal response out of her yet. And I have never seen her so much as HINT at any level of responsibility for what has transpired. Just the opposite, in fact. When she's backed into a corner with her ridiculous accusations about people outside her home, she just as quickly finds someone INSIDE her home, other than herself, to point a finger at. Given enough time and a tight enough corner, she'd finger Caylee for bringing on her own murder. I truly believe that.
If it is guilt causing her behavior, I still have little sympathy. At the age of 50-51, as a wife, mother, grandmother, career RN, she should have a much better developed skill set for dealing with crises. Trying to deflect blame onto others, lying, being deceptive, attempting to manipulate, being combative and rude and disrespectful, destroying mementos other people have left NOT on her property ... these are not the behaviors of even a marginally functioning adult. If this is how she has dealt with trouble in her life, she should've sought counseling long, long ago.
I give a certain amount of leeway to young people who act out like Cindy has, but not to full-grown adults who have failed to ask for help with their own personality or emotional issues. As adults, it's our responsibility to get a clue before we hit middle age, imo. How could she hope to raise normal, healthy children with so many personal issues of her own?
Makes me NUTS. :mad:

But as others have said, this case isn't about "them." (As much as they think it is.)

No disrespect intended, but I interpreted the news article differently i.e. that the report will NOT be released tomorrow but instead release will be delayed until a further hearing on the motion after the media who are the Real Parties In Interest get a chance to respond.

Am I off base in thinking Conway sure knows how to work the system. Perhaps intentionally omit serving the "media" (it's pretty obvious) knowing there will be a delay? Then on the day of the hearing, uh, maybe hurt his back again or come down with acid reflux?
It could be months before this is heard. How many times does Judge Strickland get played?

I didn't even know she had a show on TV... Dang. I don't have much of a stomach for those autopsy shows on TV. When they pull out the hack saw, I'm running for the door - go cut the grass or something.
Dr G's show is a good one... You might get a glimpse of the "tools" she uses, but for the most part, you don't really see anything. She talks a lot about how she comes to a conclusion about how someone died.. It's fascinating how she does it...

Orange Circuit Court Stan Strickland issued an order late Thursday that will delay the release of the autopsy reports, which were expected to be made public on Friday, until the issue is addressed in court. He wants to hear from the media about the Anthonys' request.
"For reasons unknown to the court the motion was served only upon the State Attorney's Office," Strickland wrote in the order. "The real party in interest in this matter is the various news media."

The counter argument is that when The People are prosecuting someone for First Degree Murder and seeking the Death Penalty, then the supporting facts need to be public. Basically the same rationale as why we have public trials in the first place i.e. to make sure government is not abusing its authority and violating the rights of the citizenry. This is particularly true where the defendant has already proclaimed that the prosecution is being done "on a whim" and has sworn under oath that she believes the death penalty is strategically intended to coerce a false confession and to force the defendant to plead guilty to a crime she didn't commit. Even Cindy herself recently claimed that Casey was being prosecuted just because Casey lied about her employment. The public has the right to know whether the justice system is being abused as described by the defendant (and Cindy), or whether there are facts - such as may be included in the autopsy report - which support the ongoing prosecution for First Degree Murder and seeking the Death Penalty.

I doubt if there's going to be a bombshell in the report either.. From what Dr. G said at the news conference when the announced that it was Caylee, for the most part the remains were just bones.. What can the autopsy report say about bones that would so cause so much "anguish"?

Judge Strickland is very experienced, and I expect that he's dealt with all types of attorneys and such. So far, he's mostly been very, very patient.... and professional. He's got far more patience that I do, but with him leading the way, Justice should be served. Eventually.

I would describe it as very "non-scientific," as opposed to her highly scientific choice of career.
She seems very extroverted, which kind of surprises me. And while her job is very technical, her explanations are extremely easy to understand and she's just very interesting and fun to listen to. imo

Theoretically there could possibly be legal reason to withhold the report, for example if there is something really inflammatory in the report. I wouldn't expect skeletonized remains to show signs of sexual abuse like is apparently present in the autopsy report of poor little Sandra Cantu (whose autopsy report has NOT been released for this reason.) However, something outrageous like tool marks on the bones which indicate that Caylee was butchered and eaten, something horrific like that, could possibly constitute a legal reason to withhold the autopsy report.
NOTE: I do not have any information about such outrageous, inflammatory circumstances (other than the already universally-known duct tape on the skull). I am merely trying to state examples of what the court might deem "good cause" to grant a protective order not to release the autopsy report.

I really need to stop reading here, these folks (Anthony's) actions really annoy me.. I am so sick of this being a three-way criminal trial: the State, Casey, and the Grandparents who keep inserting themselves and asserting their rights as VIPs in the criminal trial.
Can anyone claim "too painful"? What if someones aunts, uncles, siblings, spouse, WHOEVER, started saying "this stuff will cause me pain"?
I am sorry about the horrendous loss of their grandaughter, what an awful thing to go through, but the criminal trial is, in many ways, a separate event that must go on according to the law.
I have never seen the grandparents of a murder victim insert themselves so prominently in any case.
I love the way you put things and the bolded by me is the best way to word this situation. They are literally making this a three-ring circus - I hope Judge Strickland catches on soon.

Well, I t hink this has gone too far as far as the A's and BC and this autopsy report. Plain and simple, the public has the RIGHT to know and the media in my opinion will get it released thru the judge. They can stall all they want but the law is the law and I do believe the G nd C had better get used to it. Their daughter is getting a good dose of what the law is.

If someone elce killed Caylee then le would be out looking for them. c and g need to stay out of this until trial time and then they can get on the stand and tell as many lies as they want to only the pros.will call their hand on it. Getting on tv shows now and telling lies or not doing them any good. As long as casey is in jail that is fine with me. I think c and g or trying to make enough money to get her out. I guess the foundation is not bring in enough money yet for them to get her out. I am sure casey is mad at them for doing all they or doing and not working so they can get her out that may be the reason she is not seeing them. Hi Miami, ITA The A's, imo still believe that THEY are in charge and I believe that the judge needs to set them straight as to how the law works not how things may work in the House of Anthony. No one cares. All we want is justice for this precious baby who their murdering daughter took the life out of to get back at her mother imo as always

Judge Strickland will be holding a hearing next week to hear arguments from both parties and then make his decision on whether or not to release the autopsy report. Sorry to say wesh just announced on the 6pm news that the autopsy report will not be released tomorrow with the rest of the discovery in tomorrows release. Judge Strickland will be holding a hearing next week to hear arguments from both parties and then make his decision on whether or not to release the autopsy report. Sorry no link to the update yet on wesh.

All of the lawyers or doing it trying to find a way to delay. They have no big bomb shell to get casey out of this and they know it. If someone elce killed Caylee then le would be out looking for them. c and g need to stay out of this until trial time and then they can get on the stand and tell as many lies as they want to only the pros.will call their hand on it. Getting on tv shows now and telling lies or not doing them any good. As long as casey is in jail that is fine with me. I think c and g or trying to make enough money to get her out. I guess the foundation is not bring in enough money yet for them to get her out. I am sure casey is mad at them for doing all they or doing and not working so they can get her out that may be the reason she is not seeing them. I think there is money going to jb and the other lawyers we just don;t know where it is coming from. jmho

I really believe this is a move by Conway and his clients to aid Baez and his client.
I mean, it's silly, unless as Kat said, the report contains information that is inappropriate for public release, but I doubt this is the case here for Caylee's remains.
And if all docs were to be sealed because they cause anguish, why don't they just rewrite the Sunshine Laws to say something to the effect that:
From here on out, no information will be released to the public if it hurts somebuddy's feelings. :rolleyes:

Sandra Cantu's autopsy report was not released, but the new, unrelated criminal charge of "rape with a foreign object" was added to the murder charges against Melissa Huckabee after the autopsy was performed so it is not that difficult to figure out what some of the unreleased autopsy report's findings must have been.
In Casey Anthony's case, the Death Penalty was added to the First Degree Murder charges but there are many possible circumstances that could support seeking the Death Penalty.

Am I off base in thinking Conway sure knows how to work the system. Perhaps intentionally omit serving the "media" (it's pretty obvious) knowing there will be a delay? Then on the day of the hearing, uh, maybe hurt his back again or come down with acid reflux?

Alert Alert being exposed to Jose Baez may cause idioicy, mental block, or loss of body function. It has been reported that people exposed to Baez have become in almost a vegetative state. If you have been exposed to Baez and are having memory problems start reading you still may be able to save a few brain cells.

I think he's exactly as smart a Baez. Reminds me of a friend who would "forget" to sign her checks when she sent them out. She'd try to buy time and claim that she forgot but she did it on purpose.
Conway did it this way on purpose,he didn't forget who to send it to or who to notify. He did it to make things get held up until next week.
He's playing immature games with a court of law and I find it very disrespectful to our legal system..

EXCEPT: I don't believe it is because they would feel great anguish. Really, how much worse can it get? I think it is because they insist on being important to this whole process.
So, how about: No criminal investigation information is to be made available to The People of Florida unless Cindy Anthony says it is OK.
Because, after all, she is the only one with any rights in all of this.

For reasons unknown to the Court the motion was served only upon the State Attorney's Office. The real party of interest in this matter is the various news media.
Pending formal notice to the media, including the Orlando Sentinel, this Court will enter a temporary stay of the autopsy reports and findings set to be released....
IIRC, in the last motion hearing re the 12/11 jail video held on 5/28, Judge Strickland said he could hear the media's motions the following week, but LKB and Lyon said they would not be available until after 6/22.
IMO, the attorneys for the "media including the Orlando Sentinel" was all over this as soon as they became aware of BC's motion. Hopefully Judge Strickland's calendar will allow this to be heard quickly.

There may be a difference between the autopsy report and the autopsy photo's...personally I would prefer not to see the pictures...but think he should release the written report.
I would think the report would contain info in regards to insect and animal activity on the remains, and like Pru mentioned, items/articles found with the remains, etc. While it wouldn't be visually graphic like photos are- reading it could still be chilling.
I think it should be released as well- if only to show that it's not pretty-won't make great one liners for Casey's my space.
My internet speculation is that the Anthonys were hoping to use this report for some sort of PPV they'd be shopping around, under the guise that the money would help go to their foundation or to buy a new rudder or some such whim if folks clicked on the pay link to view the autopsy report from their own "authorized site".

I'm saying I think the motion was filed to benefit the defense case. I think the two of them, Conway and Baez, are operating in tandem, in cahoots if you will -- because I don't believe for a minute that the Anthonys will be anguished over the release of the report.
I think however that it's possible if not likely that Baez' case will benefit by the delay. Casey will benefit, that is.
And since Everyone's Goal is to Save KC Anthony's butt, Conway helps our "young Hispanic attorney" out whenever possible.
Like this motion which causes another delay. I don't know why Baez wants a delay, I have my ideas, but he wants most things kept out of public release, and Conway's motion on behalf of the Anthony Duo accomplished this for Baez.
Probably Baez didn't want to be the one to file another motion asking for more evidence to be sealed because he's already got that tape in question, and that's causing lots of speculation. He doesn't need more speculation.
So Conway deflects the attention to himself and those Anthony people.

I'm saying I think the motion was filed to benefit the defense case. I think the two of them, Conway and Baez, are operating in tandem, in cahoots if you will -- because I don't believe for a minute that the Anthonys will be anguished over the release of the report.
I think however that it's possible if not likely that Baez' case will benefit by the delay. Casey will benefit, that is.
And since Everyone's Goal is to Save KC Anthony's butt, Conway helps our "young Hispanic attorney" out whenever possible.
Like this motion which causes another delay. I don't know why Baez wants a delay, I have my ideas, but he wants most things kept out of public release, and Conway's motion on behalf of the Anthony Duo accomplished this for Baez.
Probably Baez didn't want to be the one to file another motion asking for more evidence to be sealed because he's already got that tape in question, and that's causing lots of speculation. He doesn't need more speculation.
So Conway deflects the attention to himself and those Anthony people.

Pam Bondi and Mark Eiglarsh both agree that autopsy reports are rarely sealed so we will have to see if the Judge does some homework. I find it extremely rare with a Prosecutor AND a defense attorney agree on something on the shows. They both agreed - autopsy reports are an integral part of a murder trial and they are also part of the Sunshine Law. I'd say the Anthonys are trying to rewrite law ONCE AGAIN.

There may be a difference between the autopsy report and the autopsy photo's...personally I would prefer not to see the pictures...but think he should release the written report.
Autopsy photos have already been sealed. I have to assuem that G&C dont' want to kniow that Caylee is dead still.

They'll show up BUT most of us believe Caylee died on June 16th so we'll see when they show their faces. After all, they spent months saying she was alive and sighted and the kidnappers were being watched.

I think you're right ~ the 16th will be just another day. If they were to commemorate it in any way they'd be acknowledging the DA is right and Caylee died in June and that's opposite of what the defense is going to theorize at the trial. MOO

County jails have a much higher transient, turnover rate than state and federal prisons, and I can't speak much about jails, but in state, the prevailing attitudes in her pod will be dependent on whatever the alpha females opinions are of her. They can make her or break her. That's why I always say a lot of her experience will be due to luck, for lack of a better term. Prisons are just like a huge hierarchy of an extremely dysfunctional family. It's gonna depend on who her "Mom" and "Dad" are like in prison and the prevailing attitudes and behaviors that are formed by those prisoners who mold the personality of the group to a great extent. It WON'T be the Cleavers, lol.

If that were true I don't think a motion would have to be filed to prevent it from being disclosed. Doesn't make sense.
I think there is an exception for autopsy photos, not for the autopsy itself. (The Dale Earnhardt autopsy photo issue?)

Well, I should say she looks "blank" in court. Just stone-cold blank. Dead eyes. Feeling nothing. I thought it was the drugs. Guess it's just the perp.
I don't think the perp feels anything ... at least not for anyone else. I think part of the stone-cold appearance is a practiced tough-chick look she's been sporting since she was bailed out, round 1.
It's quite mature, don't you think? Much like the Grinch grimaces her mother makes, and those odd eyebrow movements of G and Middle Finger.
