You're right. No one should take this motion or its contents as the truth of the matter. I would bet Hub's right arm that the Jail had a medical professional observing every move the OC made in that waiting room.
I'll see you that arm and throw in my hub's leg...... :tonguewag:

<snipped for space>
Does this mean the state is okay with it being released, because they don't intend to use it at trial?
Is this more an argument of the media (and in turn, us) wanting to see it instead of the SA releasing it? I could care less to see her reaction to them finding the remains (sorry George).
Same here. If this really was a set up by the OCSO and jail personnel, shame on them for making a big, ugly deal out of absolutely nothing, and providing a distraction which Baez has managed to milk for weeks on end. Casey is a completely insincere human being. Her reactions to situations can't be trusted any more than the words she utters.
This whole video tape thing is just annoying. It means nothing in the big scheme of things. imo

Had to go check, I've got hundreds of pics on this case in PB. Unfortunately I didn't add a date or note reason for hearing. I'm usually bad about forgetting to do that at the beginning when I first start following a case. I do recall this was early on, and casey was not in court that day...I'm thinking this hearing had something to do with reducing bond.

English is obviously NOT his native language. I know Hmong people who can write better than that. All of his quotes by the corrections officers are gotten gby asking leading questions by Baez himself. They do NOT volunteer the information so I aquestion it's legality. He keeps referring to a Captain Warren. Does anyone know who this man is? Baez claims he is with the Sheriff's office, but I don't think a Captain in the Sheriff's Department has the authority to tell officers at the jail what to do.
There's some OTHER reason that he wants that tape sealed and it has NOTHING to do with Casey's behafvior because they already have that in depositions.
Also, remember, Casey Anthony is a manipulator and all of her angst could have been fake to get sympathy from the guards. jmo
The OC displayed physiological symptoms that you cannot fake, such as sweaty palms and red blotches on her neck. Nope, she clearly was demonstrating consciousness of guilt, imo.

If Cindy wouldn't wear a mic, threatened to file harassment charges against anyone that touched her to put on a mic and did not know LE was going to make her raise her right hand and swear to her statements, I do not think Cindy would allow being hooked up to a poly and answering questions. If you find it, please post a link, I had it saved to my old computer and it's one of my favorites. Cindy, sitting in the peanut gallery, was acting like she was messing with her hair, with her right hand on the side away from George, and sneaks it up as Judge Strickland was ending the hearing. The look on George's face is, well, eXtremely similar to the look Cindy gave Conway on LKL regarding visits to KC.

I think LE is loving that JB is making a stink over it. He is so wrapped up in this alleged cruel thing they did to his poor girl he is wasting valuable court dates and time he could be working on real issues or taking depos.
I say show the tape, show it now, let people dissect it and comment on it all they want, by the time this actually gets to trial (after all Lyon needs 15-20 hrs prep for every hour she will be in court)it will be old news. It may not even get in to the trial as evidence.

Cliff Notes Version:
Hearing Tuesday about whether Cindy, George, and Lee would have to answer the unanswered questions in their depositions. Postponed because Brad Conway threw out his back. <wink, wink>
Hearing yesterday about whether they would release the tape of Casey as the remains were found. Postponed because Bozo filed his motion too late for the county to be able to respond, also to include the media and get their opinion.
Introduction of Andrea Lyon as DPQ lawyer, but she's not yet approved to speak in court.
Matter of Bozo wanting unlimited phone records for Jesse, Amy, and Kronk - judge told Bozo to limit the time periods, report back later.
Gossip Wed/Thur: Bozo and Casey were indeed bumping uglies while she spent all day in his office when out on bail. Jail tape shows too much familiarity, which is why Bozo doesn't want it released. Really is some family in Connecticut who's paying for all this and the Anthony's living expenses. [Idiots!]

Yep, when it's personal, it tends to change everything. We'll have to wait and see what Ms. Lyon is made of. But she can't have it both ways, imo. If she wants to save the OC's hide on principle, she needs to stand on that principle and not play along with any outrageous theories of defense which point the finger of blame at innocent people. If she does that, in my mind, she has no credibility, and if I were on the jury, I would dismiss her out of hand.

If Casey's defense team foregoes the weak InvisiNanny defense, they might go to 'Cindy made Casey go something something with her bossy ways' excuse and that puts Mr Middle Finger in a very bad spot. I don't see HOW it could be a set up. Everything in jail goes through channels and it would have had to come down from the top. There wouldn't have been enough time for this information to filter through channels in time to get Casey to the waiting room in the medical facility. Remember, she has to be chained and shackled to move from her cell to another area of the jail. That takes time.
Also I don't see how Baez can blame the delay on his getting there on the jail. Had they reached him immediately, it still would have taken time for him to get to the jail. I also do not believe there is any requirement to immediately notify the prisoner's attorney of every detail of what goes on with the prisoner.
As for privacy, there is NO privacy in jail. Most toilets are right inside the cell door where the prisoner can be seen for cell checks.

I have been reading up on Ms. Lyon and by all accounts she is a very passionate opponent of the death penalty. She has been known to cry in closing arguments. Some criticize her for those dramatics, but I disagree with that because in my limited experience, many of the most successful attorneys have been dramatic.
Racehorse Haynes, Johnny Cocharan, Bruce Cutler, all dramatic in different ways. I think drama in an attorney fighting for your life is a good thing.
I don't think she cares one whit about her win/loss record, I think she wants to save this babykiller's life.
Casey's life isnt worth saving imho. She is lost to society as is her family. None of them can be redeemed anymore. They think they can be by turning to religion but it wont work unless you have a truly sincere heart and are truly repentent which they anthonys and their lackies arent.

Has Jose (Waterboy) told Lyons she will learn to respect him. She obviously did not see that last motion before she flew all the way down from Chicago. I wonder if her track records is similar to Jose's - you know the 45 out of 47 cases he won in 2005 (as a paralegal). Maybe he should go back to his old job. He is so disgusting.

I doubt that she is chained and shackled every time she leaves her cell, the medical facility is within the secured area so there would not be a reason for it. The whole thing could have been setup within minutes with a couple of phone calls.

Much as Casey and Baez want to believe it, I seriously doubt it was a huge super secret set up. She's really not that important...no matter how important she'd like to think she is. I think Baez is raising a stink for a reason. What reasons could he really have for not wanting "Casey Anthony and her Attorney Jose Baez together" to be seen. It's all about "seen" not heard. He doesn't want something seen.
If it were her reaction:

whatever it is it has Jose's boxers all twisticated up.

Baez (aka Defense Waterboy) doesn't have a CLUE how to handle a murder case, let alone a high profile case such as this as become. I saw him yesterday snickering in the background while LKB was answering questions, as if to say - "don't mess with us Kathi Belich. "
I also noticed how FAST the waterboy handed off to LKB.
He's a waterboy. He's not ready for the pros. He's a waterboy... Say it with me - WATERBOY.

The choice of the new DPQ attorney is interesting. Most of the talking heads on TV have agreed that even if convicted Casey stands little chance of getting the DP. This is one thing that JVM and NG get worked up about. Cute, white girl no DP, not so attractive, minority gets DP. I think Lyon has the experience to realize that the odds are way in her favor with Casey Anthony as far as the penalty phase, and the attention Lyon will get for her book will exceed any other publicity she could garner if she is able to represent the "most hated woman" in FL and "save her life".
Ego is reason most of these lawyers are helping Casey, I think Lyon is passionate in her anti death penalty stance, but she has an ego also and it must be fed. Another win for her and untold publicity for her book. A satisfying meal for a hungry ego?
You have truly hit the nail on the head....all of these so called experts are in it for 2 reasons....the challenge...and the publicity....and they wont let Baez take taht away from them....
I agree that Casey would not have received the death sentence...for one, she was turned in by her mother...that alone will get the DP turned into LWOP...no judge would impose the DP and leave that on her mothers conscience that she was the one who pulled the switch......JMO

Bold is mine. ITA. He has a lot of work to do and all he's worried about is the jailhouse video. This case will never go to trial at this pace. IF I were Jesse I would make it my business to be in that courtroom every single day of the trial (unless being a witness bars me) and If I could not be there I would have my family there very visible to the jury. It is easier to cast a shadow on some person who is not sitting right there is the courtroom for the jury to look at and evaluate. I hope he and his family are in court front and center along with anyone else the defense might take a shot at.
How sad that the good Grund family got dragged into this. Everything Casey touches is damaged, tarnished or destroyed. She has brought grief to so many people, probably permanent damage to some emotionally or financially--and of course, all of that on top of murdering her 2-yo daughter and partying like there was no tomorrow.

I would imagine at this point that would be the only reason to join this team, in the hopes that you could make lemonade out of lemons. Three months ago, nationally known death penalty attorney Andrea Lyon spoke in Orlando at a seminar on capital punishment put on by The Florida Association of Criminal Defense Lawyers.
Lyon was back in town Thursday, this time garnering the spotlight as the newest addition to Casey Anthony's defense team.

I just don't think ANY of them are knowledgable enough to deal with Kathy Belich. She really seems to do her homework on everything. I am impressed with her. Could Todd have run any faster from her?
Belich is as serious a journalist as Lyon is a defense attorney, imo. She's a force to be reckoned with, and imo, doesn't in any way fit the stereotype of the tabloid types. She's careful, accurate, and fearless.

I'm sure he, like the rest of the world at that time, had a great deal of sympathy for the grieving grandparents. I don't know if the judge has lost any sympathy for them at present, but I think most of the rest of the world has.

It had something to do with the gag order. The pros was requesting it, Baez was arguing against it. Somehow, Judge S brought the Anthonys' name into it (they were not in favor of it, either), but he did not ask Cindy a question. She heard her last name and thought it was her cue to put her 2 cents in, because after all, we should all hear everything she has to say. I remember the judge shot her down quite quickly when she attempted to speak. Twas the highlight of that hearing, for sure.

Interesting that this new Lawyer is against the DP, yet she defends and gets off the people that have already given the DP to someone.
What a waste of a human being , imohoo.
She believes in "redemption" and I'm sorry, with sociopaths I see no possibility of redemption. I see there can be great actors in jail who "get religion" (what else do they have to do there?) but there is no possibility of redemption for a sociopath.
Surely she must know the makeup of sociopaths.

You're right IMP, you have summarized Lyon's hurdles in this case. Because of her experience with criminals facing death, she may be able to get thru to the OC, where jose could or would not.
I cannot wait to read her first motion as to why the State is wrong to seek death, it may give us a clue as to her thinking and she promised us that it would be well and clearly written.
Don't you wonder why she found it necessary to say her motion would be well and clearly written in this particular case, LOL, where everything has been so badly prepared and written  I wonder how many of Jose's motions she had read by that time. I thought I had hit upon something big the other day while searching court records for Cynthia Anthony.
Right there in Orange County, there was a Cynthia Anthony, a Cynthia Maria Anthony also, that had arrest records for:
Prostitution, Child Abuse, and possession of Meth.
But, alas, it wasn't Casey's mom, Cindy.
Must be awful to have that name now, for Cindy. NOT!

Yes????????? We will see about Ms. Lyons. She will have to find a way to clue the As as to what is truth or fiction. The As were acting a little upset at the hearing this week so maybe she is telling them that smell was not a pizza. No Way, Jose - is that going to fly or the Nanny bit either.
IMO she has no obligation to speak with the A's at all. She works for the OC. I think that is part of Cindy's anger, she is no longer in control of her daughter. Her attorneys are more important than Mommy & Daddy. moo

No one. This is part of Casey's problem, IMO. She grew up in a family that didn't have normal bonds, but very dysfunctional attachments.
Casey didn't know how to make a normal bond and probably wouldn't trust very easily, because she learned not to do that either. Trusting someone would be dangerous.

I have no idea really, but something was said on JVM's show tonight that kind of answered another question I had about this. Somebody said it's possible that Jose & LKB will handle the guilt phase of the trial and then after Casey is convicted, Lyons will step in during the penalty phase.
If it were her reaction:
a. she got upset...perfectly normal for a Mother
or
b. she didn't... ties into the whole 'she copes oddly' excuse.
whatever it is it has Jose's boxers all twisticated up.
a side thought: I don't think it's a coinkydink that Casey's legal team is becoming all female, does anyone else?
I don't think it's so much of a coincidence as a strategic move on the part of Baez. He knows she has impulse control issues and takes a huge risk in having any men around her or younger attractive women even because I believe Casey is a true sociopath who will use anyone of either sex for immediate gratification, sexual or otherwise or to get whatever it is she wants at any given moment without a conscience, guilt or remorse.
I totally agree that Baez' fight for the tapes is because he wants to hide something and I don't think it has anything to do with her reaction, but more likely something more along the lines of inappropriate.

I actually think it might be too far-fetched to try to pin the murder itself on Cindy. My thought (at the moment) is that Casey's best chance is a story involving the fight w/Cindy on June 15th, followed by the accidental death of Caylee at Casey's hand (yes, involving duct tape and heart sticker, though I haven't noodled through all those details yet), precipitated by a lifetime (Casey's) consumed by the dysfunctional and debilitating relationship with Cindy.
I don't see how the defense can get around Casey being responsible for Caylee's death, unless they're willing to stick with phanny or concoct a new, utterly fantastic tale to tell. And with Lyon onboard, there seems less likelihood of that. So the next best thing, in my mind, is to construct a scenario in which either Casey went temporarily insane, or one in which she was so crippled by her upbringing she did the best she could with what she had.
Just my own musings, and I'm sure they are so full of holes they're leaking all over the place, lol.
Good points, and given that Lyon is on record as saying that all criminals' actions can be located in the roots of their dark childhood pasts, may be enough to show us what her strategy may be.

I am talking about jails, not supermaxes. There are different pods. The medical facility is ususally in a separate location and prisoners are excorted through halls in cuffs. Don't you think, though, that the already shaky credibility of the defense would be blown completely apart if Baez and company mount a theory of defense that doesn't fly with the jury, and then Lyon comes up the rear with her mop and bucket and tries to clean up after them with a story that doesn't have a thing to do with what they presented as a defense during trial?
Example: Baez goes with either the nanny story or he tries to pin the murder on Jesse. The jury doesn't buy it and convicts Casey. Then Lyon comes in during the penalty phase and says ... what? Never mind, we were just kidding about the invisi-nanny? What really happened is this ... ??
I think they need a coherent story that will flow from the beginning of the guilt phase right through to the penalty phase. And imo, in order for that to happen, Lyon has to take charge. I don't see any other way to make this dog hunt.

We're just waiting for Jose to bring us our water.
and years from now? a menu at the local Howard Johnsons...
But seriously folks, I think Andrea Lyon is going to have her hands full, with Casey. CASEY is never going to admit to the fact that she killed her kid with premeditation, even though she did. How does a lawyer defend their client without knowing the truth. They don't. Just ask Mark Geragos. The proof is in all the discovery that's been released so far! It's evidence that she wanted to be a party girl! Fusian(sp?) Night Club. Everyone come and see me look good at Fusian... I'm.... working there... I think I'm working. Well...
Caylee died, the last person to see her alive was Casey, because there was no Zenaida Gonzalez in Casey's life. It was a fabricated person, a combination of names from mailboxes, guest cards and whatever. And a month later, Casey's car shows up smelling like something died in there. Well.... yeah...
I'm all over the place here, but it would take a MULTI-MILLION dollar defense team to even have half a chance of getting Casey off (see OJ Simpson Murder trial). There is premeditation, there is motive, and there is means, and there is opportunity. And, there's that dang car...

Imo, as far as premeditation goes, the duct tape and heart sticker will be much harder to explain (as in, impossible). The internet searches, not so much. "Shovel" is a band, for example. And posters here have found hiphop type definitions for some of the other terms she searched on in the Urban Dictionary. I completely agree! Since Casey's statements to LE involve the "invisi-nanny" ZFG being the kidnapper, don't they have to stick with this or else admit to the jury that Casey lied to LE? And if she can lie to LE then can't the jury consider everything else she says a lie? Hmm.... yes, the duct tape and sticker, and triple bagging little Caylee like she's trash, that's going to be difficult to explain. However, she could have been dead when she did the duct tape and the sticker. WE don't know. Casey could have made it look like some else did it (although she was not meticulous or real smart about it). I was thinking more in the lines, of evidence of premeditation before the 15th of June. I have thought since we found out about that fight with Cindy that somehow Caylee got in the way of those two fighting and something happened to her. It has stayed at the back of my mind.
Sorry, I just don't think Casey is smart enought to even figure out how to dispose of the body with out someone's help. She was never smart enough to do this and not get caught but I don't think she was smart enough to even dispose of that child's body. Just my thoughts.
On an off topic, no court next week, perp took the plea, Yea!
Well, she didn't dispose of it "smartly." I think Caylee's body was in the trunk the day George was doing the gas can thing, and being so close to caught, Casey panicked and threw out Caylee's little body the first place she could, after peeling out of the Anthony driveway.
She wasn't smart at all about it. I'm sure she was amazed that it took so long for Caylee's body to be found. As time went on, and helped by rains/hurricane, Casey thought she'd lucked out even though she put Caylee in such an accessible place, and so close to home.
She must have thought she had a great run of luck.

Imo, if Lyon can convince Casey to run with it, Casey will have a "moment of clarity" at some point before the trial, during which a much more plausible story of what happened to Caylee will emerge. It will HAVE TO involve Casey, however, but it can be spun to make her look much more sympathetic than she does at the moment. Think accident. Think terrified of her mother. Now, it won't have her looking angelic by any means ... the way that baby was dumped will put the OC in a terrible light no matter what the new story involves. But I do think there are ways to spin the tale of what happened that could be much more favorable in terms of the jury's opinion of Casey. I think she'll still be convicted, but I think her life can be spared if that's what Lyon's goal is. However, Casey MUST go along for the ride. She's no longer in charge. She needs to go along with the program, unless she's angling to be put to death some day by the state of Florida. imo

I've long thought she was dumped right after George retrieved his gas cans, just by Casey's reaction to him that day. I do think the place where Caylee was left, though, was partly due to her knowing the area and to spite her mother by having the remains so close to the house. But what I can't quite figure out is Casey telling one of her friends, before Caylee died, about a smell in the car. who knows why LKB said that casey is no ted bundy... as if anyone was accusing casey of being a serial killer!
iirc, LKB is the one who made the comment about a one armed 'nanny'? (paraphrasing, so i hope someone remembers exactly what it was that she said)
weird
I think she was talking about the evil factor, not necessarily a serial killer factor. Perhaps that Casey is being perceived as evil as Ted Bundy. But I'm not so sure that's incorrect; I don't know that there are identifiable, discernible "levels" of evil when it comes to murder, and especially not when it comes to the murder of your very own little helpless 2yo daughter.
OK, I convinced myself, Casey is every bit as evil as Ted Bundy.

I guess they do things differently in Florida... Here in California, the few times I've had to be at depositions, lawyers for ALL sides are there.. Not all asking questions, but all are there observing...

In all probability if Casey could have figured out a way to do it, all three of them would have been gonners ---- not only Caylee, but Cindy and George, too. If Casey could have gotten away with Caylee's disappearance, George and Cindy might have been her next intended victims.
