JB said I have seen media here.

State: Media cannot speak for themselves. They need legal representation.

Judge: The media can file something or request something and they need to be heard. Judge says it could be heard next week.

JB introducing Andrea Lyon by doing her entire bio for the court and reciting case law. She has been admitted at least 3 times in the State of FL in the DP. JB are faxing a motion for something re: her qualifications. JB wants to know if the State has any questions about her qualification.

State says they appreciate the commercial, but they are still awaiting documents before they comment.

JB said he does not like the State's comment about the commercial.

Judge said JB brought it on because of his comments about Ms. Lyon's success rate.

JB address them one by one:

Kronk: JB has contacted Mr. Evans prior to interview Mr. Kronk. Mr. Evans was told it would not happen unless it was by depo. They are seeking January 2008 - present for Mr. Kronk's phone records.

Mr. Evans, Kronk's attorney: Mr. Kronk is a witness in this case. The original request filed asked for all of his cell phone records with an indefinite time. Written communications with JB have limited to January 2008 - present. Mr. Evans reciting case law protecting phone records and providing the Judge with a copy of the decisions. This is a cell phone case regarding ping register. The telephone number an individual dials or transmits is not intended to be 3rd party information.
They are protected when a witness becomes a part of a criminal case. Citing from another case: a person's private conversation over a cordless phone is protected.
Mr. Kronk does not object to a reasonably crafted request for phone records regarding calls with LE, the Anthonys........ The defense needs to supply a list of what calls he would like to have and it should not include Mr. Kronk's friends calls, personal calls, etc.

Judge: You think they are entitled, but not entitled to everything. What do you think is appropriate?

Evans: A list of phone numbers for particular people and why they want them. As a fall back, regarding timing, the date of the (something) victim.

Judge is going to hear from each attorney before JB has the opportunity to object. Next up Amy's attorney....going to skip over the items Mr. Evans presented. Amy's attorney said she has had no contact with Casey since Casey was arrested.

You're right Ell, green is support for the OC, purple according to george at the memorial service is Caylee's color.

Amy's attorney said JB sent him a letter that JB really only wants January 2008 - present. Amy's attorney thinks it should be denied because it is too broad.

Attorney suggests setting a reasonable time period of Jan 2008 - October 18 or 14, 2008, the date of Casey's arrest.
Any calls after the October date would be in the jail records.

If JB would provide Amy's attorney with Casey's phone numbers, he would provide JB with the calls. IF JB wants everything, they have a problem with it.

If the court wants to look at the phone records to determine if anything is being withheld from JB, they do not have a problem with it.

Jesse Grund's attorney now speaking - They object on several postions - right to privacy. JG is a formal LE and he has the right to privacy. Being formal LE (recites status) protects LE from certain items being public domain. The status does apply to former LE.

The attorney provides case law protecting former LE.

2ndly - the motion regarding the defense having materiality. Defense has shown no materiality.

This cannot be a fishing expedition. JB has contacted the attorney wanting any and all beginning with Jan. 2008. Again the argument that includes personal info that is not connected to the case...reciting more case law.

Casey is writing JB notes and he is smiling.

Judge agrees with the overboard nature the other attorneys have mentioned.

JB: lst off many of these with the exception of Mr. Kronk, LE thought it important enough to seek these records including Mr. Grund. Mr. Grund was a suspect in this case and he took a poly in this case. We have an issue where he has already been turned over much in discovery, but very tailored in discovery. Same with Amy. The records are incomplete. The materiality is quite clear as your honor can see. JB thinks he should have the same leeway as LE. As to who we are looking at and why goes beyond the line of what we have to disclose.

JB: No issue on Kronk except time frame. JB is quite shocked that LE makes certain notations of Mr. Kronk, but does not request. LE should have done this and the defense should not have to.

Judge: You are straying. I don't want to hear what LE has done wrong.

JB: Mr. Kronk does not have standing of where we are going with the defense.

Judge: I don't think that is what they are doing. I don't think..their complaint is they want anything and everything.

JB: When I communicated with Kronk's attorney, they discussed JB signing a non-disclosure agreement. I don't have a problem with that. I do not handing over phone records to the media. I can assure the court that I will not release the phone records.

Ms. Drane - He uses the argument he will not release them. If he gives them to us, we are required to release them.

Jesse had never been considered a suspect, according to LE. I remember in one of Cindy's videos with LE, she kept bringing him up, trying to push him as a suspect, and harping on his 'discrepencies' from one statement to another in different interviews. When LE countered with Casey and/or Cindy's numerous contradictions in statements she kept trying to ignore that and keep pushing Jesse. (can't remember exact words used, sorry)

That was a really stupid move on Baez' part. Not only are they bringing up Cindy's attempts to implicate innocent people, but also drawing attention to the lie detector test Jesse took. Didn't members of the OC's family refuse those same tests, including her? Great move :sneaky:
