I don't know who the manipulator and the manipulatee is in this sitch, but the inmates are past masters at manipulating those who are to staff the prison. I've seen more than one nurse escorted off the farm due to "falling in love" with an inmate. My very best friend, in fact. :crying:

I went to BJ's today, cut the grass, prepared dinner for tomorrow so I can be here for the hearing. I thought bloggers were overweight and lazy. According to one of our posters the A;s are not taking care of their yard anymore. That foundation must be taking up too much of their time. When the cams were in front of their house they couldn't stay out of their front yard. :confused:

That always cracks me up when I see a professional dressed as Formal Dressy like they are going to an event such as a wedding.
When I used to work at the phone company we'd have technicians that were told to dress in business attire if they were to accompany a sales man to a job site and sure enough they'd come dressed for a wedding - hanky and all!

He doesn't use any case law or statutes he just says it's in violation of the fourth, fifth, sixth and seventh amendments of the constitution, including right to counsel? As a paralegal I wouldn't hand this in never the less an attorney.

I would never give something like this to my boss -- who is Judge Strickland, in this case. I wouldn't give it to anyone, it's rude to expect someone to try to read that. I don't know what's wrong with the person who wrote it, or the person who submitted it, but it's bad.
And if I were Judge Strickland, I'd shoot this thing right back to Attorney Baez' office, with a big red F on it, along with DO OVER! at the top.

I've lost count of all the motions that have been piling up since the last court date ... it looks like Jesse's lawyer filed a motion for protective order yesterday ...

If he believed it was telling and proving of NOTHING what's the problem?
Asking jail personnel what they thought, their opinions is also telling of nothing.
I do contract work for Dr's and I have some strong OPINIONS of what I think is right or wrong or redundant or a plain waste of my time to do LOL but as long as it's NOT ILLEGAL I will do as he wants as he IS the person I work for. Should I hire someone they will do AS I SAY or be replaced.
This is a loser of a motion and though I didn't make it thru it I was so irritated with what I did read with no case law or other statuettes mentioned I'm sure Strickland will be just as irritated and just may bounce it back or just plain reject it.

It looks like he is grasping for straws here. Using the officer's opinions as proof of policy with the jail. Is he required to verify that what happened that day is not only legal but what is done in that type of circumstance? Or is he allowed to just take someone's "feelings" and run with it? I would like to be able to read the complete set of transcripts from these depos. :confused:

I agree but then he also realizes that it is dramatically different reaction from the Blanchard Park search. She just walked away from the TV then. So in contrast, why was she not emotional about the Blancard Park search? Because she knew Caylee was not there. Why did she have such a reaction on Dec 11th? Because she knew that is exactly where Caylee was. Not sure if I made my point clear.

Actually at the bottom of one of the pages that part with Baez he's noted that State is NOT USING so this motion doesn't address that at all.

Can you imagine the litany of complaints or thoughts you'd get from any worker asked their opinion of what they were asked to do at work. Can't stress it enough but this is a loser of a motion.

Your right, I see no legal explanation, you just can't say well it violates this and that constitution. You have to have a statute or case that backs up your motion. I wonder if he even has Lexis Nexis? Even if he doesn't have money he could use findlaw it's free.

I agree but then he also realizes that it is dramatically different reaction from the Blanchard Park search. She just walked away from the TV then. So in contrast, why was she not emotional about the Blancard Park search? Because she knew Caylee was not there. Why did she have such a reaction on Dec 11th? Because she knew that is exactly where Caylee was. Not sure if I made my point clear.

Is he required to verify that what happened that day is not only legal but what is done in that type of circumstance? Or is he allowed to just take someone's "feelings" and run with it? I would like to be able to read the complete set of transcripts from these depos. :confused:

Nor do I. Nor am I comfortable that when he chastises, he chastises both sides. Baez is hardly on a par with the state's attorneys, and he's acted like a complete a$$ in the courtroom more than once. I have to believe Judge Strickland is just so appalled at what he's hearing/seeing/reading, he's at a loss to know exactly how to handle Baez without making him look like a bigger fool than he already does.

I think it is rather sad and depressing that people are putting stuffed animals there leaving them to nature. Rain has ruined them. I completely understand the gesture. If only something better could be done. Like maybe have a drop box for new toys that any agency or hospital could use.

For sure, but what's weird to me are the tapes of interviews that he keeps arguing shouldn't have been released, yet his depos have not been released, but he's quoting parts of the depos in the motion ??? Does anyone know if the tapes of jail personnel interviews were done by OSCO?

The guards had never done this before. They took her to medical and the television was playing this had never happened before. She was not seen by medical despite the fact that the doctor was standing right there, this has never happened before. They were instructed to take notes, this had never happened before. They were told this was being done at the request of LE, this was never done before. The video had never been saved before. They had never zoomed in on an inmate in medical before. They had never transferred the security to video and saved before.

Like you said it's a gesture. Who's to say that these same people don't give to other charity's also. This could be a statement that the only thing they're willing to give the Caylee Foundation is being left in the direct location that she was found.

They seemed to have left that portion out and made it a general we dont do this. I'd like to have a count for these inmates of the Orange County Jail that have been indicted under these same circumstances ie: murder indictment, body found afterward.
They do have Casey's reaction to bones found at Blanchard. I'm sure there's quite a contrast.
What do you do with a prolific liar? Compare reactions?

What if these two officers had only been working there for lets say 6 mos. and had never run into the exact same set of circumstances (not saying this is the case). I can understand that these officers had never encountered this before but does it happen fairly often? Enough for these two officers to encounter it regularly? I'm not questioning whether they donate to other charities. I really don't think they are making a statement about the only thing they would give the foundation. I believe they are giving of their hearts. I probably would have done the same thing if I lived nearby. But, now, we all see that they are just being thrown out because what else can be done with them? This is all about memorializing Caylee. It would be great if there was a dual purpose in what is given from this point forward. I hope you understand that I am respectfully posting my thoughts.

I am president of a teeny foundation. We support education in our local area by funding projects for other organizations and by giving scholarships to students in our school district. I spent the day writing letters awarding scholarships to this years graduating seniors and writing checks for other projects.
It occurred to me that Cindy will never know or understand the wonderful feeling or the responsibility of giving. She expects those she donates to to fall on their knees and kiss her ring. It doesn't work like that, so she will be disappointed no matter how much is contributed or how many of those bears she forces on unsuspecting children.
She's really missing out on a lot.
We are fully funded and do not solicit donations.

I would think if Casey was so distraught Baez would want people to see that. If she needed medication and was having a panic attack this shows some kind of emotion from Casey
Wrong time to show emotion, IMO. She showed no emotion when bones were reported @ the park. Because, IMO, she knew Caylee was not in the park. She should have held her emotion in until the remains from Suburban were id'd, instead of showing her hand when they were discovered. I would think, if she truely had no idea where Caylee was, she'd have been just as upset about the bones in the park, or equally NOT upset about the remains on Suburban. Jose knows it is the TIMING of her "emotions" that is the problem. IMO

I would never give something like this to my boss -- who is Judge Strickland, in this case. I wouldn't give it to anyone, it's rude to expect someone to try to read that. I don't know what's wrong with the person who wrote it, or the person who submitted it, but it's bad.

I thought I had heard that she already had heard about the discovery on her radio in her cell ? I think there's a little bit of truth to both sides of the story ... bottom line is I have no idea what's SOP just basing my opinion of Jose and KC expecting special treatment and privacy that is not given to other inmates. Also, I don't know what the laws or rules are for an inmate with charges that are still being investigated or how much is allowable for LE to do by law...

I think we'd have to know how many inmates were in Casey's exact position to know if anything they did was unusual. Maybe it was done before but these 2 guards weren't involved. We are not privy to that info.
Personally I want them to use any "legal" methods they can to prove her guilt. Seemed like a good tactic to me. I hope some jail personnel are on hand to testify about it.
We'll see how it works out tomorrow. The DA may not even object to the tape being sealed.

To hear Cindy tell it, Casey wouldn't even have had to study those law books. Right after one of the first hearings (where the A's were in close proximity to Casey and Baez during a pc) Cindy was ever so proudly stating how smart Casey is--she even gives advice to her attorney!!!! Of course, I think he could USE the advice of even a layperson in some of the things he does!!!
If she's been studying, she sure hasn't learned much to help him. IMO :chicken:

My guess would be that they needed an instructor and right away. My son's teacher last year was hired the day before school started. I knew they just had to have a body in there. It was too bad for all the students in that class because she did not have control of that class and the ones that do behave and do their work are the ones that suffered.

There is no protocol for this case to be compared to. No wonder none was cited and it was written in generic terms. Jose sure thought the opinions of the jail house guards were very important. I bet these guards are ticked as it morphs into the "stepford" guards acting like sheep was the impression I got.

I also noticed that he mentioned several times that they wanted to get her down there before her attorney arrived. I can't find anything wrong with that. They never said, get her down here so her attorney can't see her. They just wanted to document her reaction and they assumed that her attorney was on his way.

I understand what you mean. Of course prison is different than jail, but our medical was in NO way used to further any investigatory work for the prison or LE, not mete out punishment as an agent of anyone. What an inmate told me was between me and him unless he gave me permission to use his words to change a circumstance for him. It is not the job of medical staff to participate in any shenanigans for the prison staff, IF, big IF, they were advised to. I also noticed that he mentioned several times that they wanted to get her down there before her attorney arrived. I can't find anything wrong with that. They never said, get her down here so her attorney can't see her. They just wanted to document her reaction and they assumed that her attorney was on his way.
ITA! Jose does input that conjecture without proof! Did he verify these statements by the guards. Isn't that unusual that the persons giving these requests/orders to the guards weren't deposed? I see a lot wrong with what Jose entered without verifying more facts from higher ups and the Dr's,.

Based on the testimony of these two guards the burden now shifts to the state/jail to show that this is in fact SOP. Baez has met the burden of showing that the jail did not follow SOP and were working as agents for LE. Jail personnel should not be used for this purpose. I know that sometimes it is difficult to separate this case from the general principles. Casey is in jail accused of a crime not convicted. Suppose that she was out of jail. Would LE be allowed to put a camera in the house absent a court order to memorialize her reaction? Its just as probative, just as relevant. But the answer is no. So too, it should not have been allowed here.
The jail does not create special rules for each inmate. If in fact in the past they have done all the things alleged here with other inmates, they should be able to point to the cases. If in fact this is SOP they they should be able to produce the written policy and demonstrate how it was followed. Whats good for the goose is good for the gander as they say. Have the Sheriff come in and testify this is the jail policy and it was created before this case. Not just some lawyer flapping his gums as NG is fond of saying.

There is no protocol for this case to be compared to. No wonder none was cited and it was written in generic terms. Jose sure thought the opinions of the jail house guards were very important. I bet these guards are ticked as it morphs into the "stepford" guards acting like sheep was the impression I got.
Just wanted to add my disclaimer AGAIN I had a hard time reading this without being irritated and I may have been jaded and not read it correctly I was so annoyed.
Know what else I got from it? I realized that the answers Jose gets are from how he words his questions. I am getting a feeling that he may just be trying to get a good quote to argue his point without asking all the really pertinent questions that he should be asking in order to literally save Casey's life.

I understand what you mean. Of course prison is different than jail, but our medical was in NO way used to further any investigatory work for the prison or LE, not mete out punishment as an agent of anyone. What an inmate told me was between me and him unless he gave me permission to use his words to change a circumstance for him. It is not the job of medical staff to participate in any shenanigans for the prison staff, IF, big IF, they were advised to. I sometimes got crossways with the prison staff because they wanted me to mistreat, undertreat or not treat an inmate as a punishment. That was not my job, nor would I have taken a job that would do that.

The testimony is the proof which now shifts the burden to the state to rebut the testimony. If in fact they keep her from her attorney that is per se a violation of her fifth and sixth amendment rights. The following orders does not absolve the jail and/or LE for the violation. JMO

My issue is who is validating what these guards have said? I did notice that in the issue of whether Casey collapsed into a chair or sat down the collapsed was stated and rectified is the word used for lack of a better word.
How much of these guards depo was opinion and NOT a direct request?
The guards said it therefore it is? IMO Jose needed to depose their superiors to substantiate this. I don't see that being entered. I see alot of opinions written without fact.
This is not just a case of a loved ones death. This death is what the perfect inmate is in jail for. It was already presumed Caylee was dead hence the indictment. I still see apples and oranges when it comes down to the technicalities of the events here.

As much as I don't want to agree with you, I do. After reading the motion, I see where Jose may have some good points. Look, we all know why these actions at the jail that day were taken in the case of Casey Anthony. LE felt compelled to "memorialize her reaction" to the finding of possible remains of Caylee. We all knew it was Caylee, at least I knew in my heart it was. Perhaps Jose may be able to prevent this from being released. However, the question that still begs to be answered is why? If in fact the video shows an "emotional" Casey, why on earth would Jose want to have it sealed? It doesn't make any sense. The argument could be made that she obviously knew (as she is the person who put the remains there) the remains were that of Caylee and therefore reacted but it could also be argued that, just like the rest of the viewing public and media, she assumed it was Caylee because of the location, so near to the Anthony home.
I'm still dying to know what the Anthony's and Mr. Baez have to reveal to the world when this comes to trial. If I recall correctly, "all of the actions of the Anthony's will become crystal clear at trial".

I'm taking this depo and possible release of the video differently. In his poorly worded paperwork, he talks of standard operating procedure in officially notifying an inmate of the death of a loved one.
Well.... Only one person knew AT THAT TIME knew that Caylee's remains were put there. Casey. It wasn't a revelation to her.
However, it wasn't official for 8 days or so that it was Caylee, so therefore this was NOT an official notification.

He does state in his motion that these depositions have uncovered others that need to be taken. He is under no obligation to validate anything. That's their testimony. Now the burden shifts to the state/jail/LE to come forward with the evidence or testimony to disprove the statements and the court will decide who is credible.
It is not opinion to state one's experience. In their experience this is not SOP. Anything that is opinion will not be allowed to be presented by the state including anything that may tend to help the state such as their characterization of her reaction. It works both ways.

It's funny because I can talk badazz til the cows come home, but when a human is in my ER gasping for air or crying for their mother because they are in such pain and/or scared, I'm the biggest cream-puff that ever lived. I worked with nurses who got glee out of it but I never could harden to that and if I would have started to, I would have left before I did. I'm too soft for my own good. I can talk a mean game though! :laugh:

Good point! However, we are not privy to all of LE information. There may have been "physical proof" that the remains were Caylee at that time. Obviously, LE had to wait for DNA results to be completed before formally announcing that the remains were Caylle, but information they may have had convinced them without the DNA.

How much time have they allowed for this particular motion? It seems like they have a ton of stuff to get through. The new DPQ attorney, whether or not the tape can be released, the motions about phone records that JB wants from the meter reader, Casey's family, and Casey's ex-friends and associates. I hope they have enough time to fit everything in!

See I feel there is a problem with these depositions. Although not saying it, it was certainly alluded to by the guards stating what their opinion was of the matter. It comes down to substantiation of their claims/opinions. IMO this was not professionally done for this criminal case. Sounds like Jose is trying the preponderance of evidence with no substantiating it aka the Jose way.

In the case of Casey's reaction to the scene of LE discovering Caylee's remains perhaps Jose would have preferred Casey to have been "shocked" "horrified" and perhaps questioning that the remains were that of Caylee. She should have proclaimed, "Caylee is still alive!".
I know that personally, if I were innocent of any wrong doing, I would have made statements to that effect right then and there. "Who did this to my daughter?" "You have to find who did this to Caylee!". Oh my gosh, this can't be my baby!" Sadly, no words to that effect were spoken. She did however ask to be medicated.

Addressing Ruth and Neffy:
Based on the testimony of these two guards the burden now shifts to the state/jail to show that this is in fact SOP. Baez has met the burden of showing that the jail did not follow SOP and were working as agents for LE. Jail personnel should not be used for this purpose. I know that sometimes it is difficult to separate this case from the general principles. Casey is in jail accused of a crime not convicted. Suppose that she was out of jail. Would LE be allowed to put a camera in the house absent a court order to memorialize her reaction? Its just as probative, just as relevant. But the answer is no. So too, it should not have been allowed here.
The jail does not create special rules for each inmate. If in fact in the past they have done all the things alleged here with other inmates, they should be able to point to the cases. If in fact this is SOP they they should be able to produce the written policy and demonstrate how it was followed. Whats good for the goose is good for the gander as they say. Have the Sheriff come in and testify this is the jail policy and it was created before this case. Not just some lawyer flapping his gums as NG is fond of saying.
More importantly and if I were the Sheriff I would be concerned about, is the allegation by the guards that this was all done in a deliberate attempt to keep her from her attorney. This demonstrates they knew that they could not videotape her with her attorney.
I have stated that this may be SOP to have an inmate notified in medical of a loved one's death. The question becomes is it SOP to video it and keep the video?
If in fact this is the first time they have done it this way, they need to come clean admit that to the court and let the court decide if it violates the inmates rights.

In the case of Casey's reaction to the scene of LE discovering Caylee's remains perhaps Jose would have preferred Casey to have been "shocked" "horrified" and perhaps questioning that the remains were that of Caylee. She should have proclaimed, "Caylee is still alive!".
I know that personally, if I were innocent of any wrong doing, I would have made statements to that effect right then and there. "Who did this to my daughter?" "You have to find who did this to Caylee!". Oh my gosh, this can't be my baby!" Sadly, no words to that effect were spoken. She did however ask to be medicated.

For some reason they felt it should be documented, remember they had never done this before, maybe they were afraid she would claim she was abused later. Somebody at the top felt this was necessary. They weren't sure how much information she heard over the radio and I think they were observing her. He looked bad. Yeah. He's been through alot, poor fella. The human side of me feels for him, he's been through a significant emotional event, which are usually life changing moments in one's life.
Part of it that I'm sure weighs on him, is his lack of having control, or at least sharing the control of raising his family which has crumbled. I'm sure he blames alot of that on himself.
He is a fish out of water with the media, and he's just being led around by the nose by the ringleader Cindy.
"This is a Caylee Bear" - I'm glad to see they are DONATING them, and that they have the money from them Connecticut folks to do so.

I'm taking this depo and possible release of the video differently. In his poorly worded paperwork, he talks of standard operating procedure in officially notifying an inmate of the death of a loved one.
Well.... Only one person knew AT THAT TIME knew that Caylee's remains were put there. Casey. It wasn't a revelation to her.
However, it wasn't official for 8 days or so that it was Caylee, so therefore this was NOT an official notification.

It's funny because I can talk badazz til the cows come home, but when a human is in my ER gasping for air or crying for their mother because they are in such pain and/or scared, I'm the biggest cream-puff that ever lived. I worked with nurses who got glee out of it but I never could harden to that and if I would have started to, I would have left before I did. I'm too soft for my own good. To use as evidence. There is still a murder investigation going on even though Casey was indicted. I don't know the legalities of what they did but it sure will be interesting. If Baez does have a leg to stand on IMO he presented it horribly in this mickey mouse of a motion. It's horribly written and has no teeth to it in accordance to the law. As I said before, is any one in that office of a professional capacity?
Perhaps Strickland will keep it sealed and give Jose some leaway to take another bite at a motion but I can't see that motion doing anything else but being offensive to a Judge.
I'm more interested to see what Strickland has to say about it then in which way he'll rule. I believe whole heartedly it will be entered at trial and not seeing it now is really no big deal to me. Baez's pseudo lawyering is really a fascinating sight.

I would hate to give unneccessary reasons for appeal based upon a little overzealousness by LE. Some where in that loser motion I believe Jose may have a case. Not presented like that though. That was pathetic. I'll have to listen to the Pros to decipher what the dang law is there and why what was done and for what reasons and if the put their feet to the line or went over it.
It is not clear, concise. Her rights were violated according to what? What amendments match up to what was done. I have a junk drawer with more order and footing to finding things than that has.

I agree. But the omission is glaringly obvious, and when coupled with them going on and on and on about THEMSELVES, serves only to further inflame the public against them. It's disgraceful the way they simply don't ever mention that CAYLEE was the victim -- they talk instead of their own "victimization" -- a group of adults who had choices and options and screwed up royally, every one of them. They can barely say the child's name. It's sooooo obvious. And so WRONG.

As much as I would reallyreallyreally like to see this video (the voyeur in me!), I'd rather the video be sealed and the trial proceed in a purified atmosphere with no grounds for appeal.

My intellect agrees with what you say about the defendant's rights, but my emotional side at the moment is more concerned with Caylee's rights. I just hope someone is watching out for them.

Oh nooo don't say that.
We had 2 younger couples over for memorial day and they were saying they "discuss" purchases before they are made.
I told them I discuss it too - I say, Russ - I bought...... That's discussion right?
My husband says that when I have money in my hand, it just evaporates!!!

I wish the news would mention and have a caption at the bottom of the screen to let us know where all of these wacky cases are taking place. When reporting that a mother and 9 year old are carjacked, wouldn't it help if most of America knew the location?
Speaking of this case, they were found at Disneyland!!!!

I do think the Anthony's will eventually fade away. Listening to NG right now about the Coleman tragedy. That is so very sad, sick and will probably capture a lot of attention.
I'm sure they will, too. Let's face it, they just aren't that interesting. And being infuriating only gets you so far in life.

They have evidence she bought 2 one way tickets to FL but have they been physically talked to yet by LE?

You are right , why didn't she reclaim her original statement " I know she's alive I can feel it." You think she would have said that's not her my gut says so. I don't see anything wrong with the way this was handled. The staff had to do something, bringing her to the mental health facility was the best place for her at this point. Suppose she hurt herself, then the staff would have been in deep trouble. They couldn't wait around for Jose suppose he couldn't get there. I think their main objective was to keep her safe and that's what was done. She did sit a little long by herself but she was safe. I really don't think she cared that much about Caylee and she already knew what happened to her, and where she was. I believe she was shocked because they found her. JMO.

IIRC the guards knew she had heard the news of 'remains' being found on her little radio and she seemed a bit upset, that's why they moved her to the waiting area in case she might need medical attention. Please don't ask for a link, you will have to call on desmon...or Cury...BTW, where is Cury? for that. I don't remember when or where I read this, but, believe me I'm not making it up.
So, I also believe what they did was proper and called for. She seemed upset in her cell, they moved her to a place where they could keep a close eye on her in case she freaked out. Well, it seems she did. She just happened to do it in a common area under constant video surviellence (sp? sorry doesn't look right to me). As you said legal, they were actually protecting her as well as themselves.
And I don't see a problem with that tape being released. Course, I'm also nosey as all get out and want to see it.

Since this case, I signed up for news updates at a few tv stations. I used to keep tabs open of all the stations, the webcam, newspapers, etc. Is it me, or did anyone else notice all the crime in Orlando? How ironic when they have so many tourists coming there.

They said it was a kidnapping hoax I believe they were from Pennsylvania or somewhere around there, but they were found at the Grand Floridian..that is the best I paid attention between typing and the snoring in the room

I have doubts about this story of the generous family. It costs money to give away money. If you give a married couple more than 26,000 per year you must pay gift taxes. So a 1/2 million dollars is a bunch to pay gift taxes on let alone give away to strangers. I don't believe the story. With all due respect to Peter.

How messed up is that? Do you know she has two other children. I believe one older and one younger. Can you imagine how this will mess them up for years to come if not forever.

I believe Peter was probably told all this. But I tend to take it with a grain of salt. It seems easy enough for us all to believe it. But we need proof!

My intellect agrees with what you say about the defendant's rights, but my emotional side at the moment is more concerned with Caylee's rights. I just hope someone is watching out for them.
ITs not easy but it is what the law requires. In the end her rights will be protected if her accused murderer gets a fair trial the first time and is convicted. JMO
