How do you know the investigation of the crime scene wasn't done by then? Even though the bodies had been removed, DPS was on the scene in around 4 hours from what I recall and they were there into the early morning.

When did the defense team ask to see the scene? I don't know of one defense team that is allowed there until the crime scene has been released by LE.

dps didnt show up till 9am the next day they told the cheif to have the bodies removed so they had policemen watching the crime scene and deputies at the funeral home guarding the bodies. i just watched that tape with wood commenting that by the time they got to go in the police dps had be in about 4-5 times and then the police came back after no telling what evidence they destroyed

Since Roca would likely be the sitting judge in the trial and the trial would be a bench trial, it is unlikely he would dismiss one charge with prejudice, but find the boy competent. If he did that he would be slapped with a charge of unethical behavior, probably by both sides.
