It's been reported that there would have to be 1)a lack of resources to investigate or 2) a conflict of interest, before Maderia could turn this case over to the Atty General.

Isn't the fact that Patty (the person closest to Gricar and the *last* known person to be with him) is also an employee in the DA's office somewhat a conflict of interest for Madeira?

I'm truly trying to understand here....

Self-policing of any group is a conflict of interest.

JMOWithout implying anything untoward regarding PF or anyone else in the DA's office, have any of you researched the petty tripe which routinely makes its way to the AG's office? This is like the "poster child" of all referable cases...but there it sits with the local PD. May God bless Tom Corbett...because no one else will.

I would assume that the "conflict of interest" would have to involve the DA directly, not tangentially because someone he knows works for the office. It might have been different between RFG and PEF, because they had a personal relationship, just like it would have different if TG or EG were suddenly a defendant.

You, of all people, should understand that principle.

Exactly, and Patty isn't just someone Madeira knows....she is *his* employee and the last known person to have seen Gricar.

I do know the principle, and it really doesn't apply here, except as a PR gimmick (to help Madeira). There is a lot that Madeira could have done to foist the case on the AG's Office. He's hinted at a lack of resources. He could use that as the hot potato. He could claim that because he and RFG were "close," someone more objective should be handling the case; that would be the only real conflict of interest. He could call a grand jury. He could have done or currently do a lot of things. He hasn't, except for the PSP/CIA review.

"His employee" just doesn't cut it, especially since PEF wasn't "his employee" at the time.
