I think there is just something terribly wrong with this kid.
I have a son (10) who has always been incredibly athletic and extremely coordinated. He could physically do it without a problem at 8 I'm sure.
Linda, I would agree with you IF it is proved that he did this then something is terribly wrong with him.
Just because your son was physically able at 8, does not mean that this child has the same ability. Also, being physically able to do it is not the same as being emotionally able to do it.
I still cannot grasp the "why" of it. I think it takes a lot of motivation to commit murder and there are other people out there with a lot more motive than the child. JMO.

My X husband comes from a long line of hunters. He always had all guns locked up in the glass case. A flip out part of it had ammo, and a different key to that. Then there was stuff in the bottom drawers that had yet another lock and key. NOW That is safety. When we visited his parents, you never saw a gun, they were all locked up in a hugh gun cabinet with all kinds of guns, bows and arrows, a gun powder thingy, ect.
The only time we saw a gun was when one of them opened it as a Christmas present.
Even the handgun I carry is in a locked case.
You would think that would be common sense, wouldn't you?! JMO.

Most posters have probably already read Mr. Brewers comments in this motion. He states his case extremely well.
Maybe if Joel Barr had Mr. Brewer as his advocate he wouldn't be in prison now.

I have no idea what was going on in that little boys head.
Maybe it was usual for them to come in separatly? Maybe the kid just got lucky and they did?

I suspect it is more BS. They say that the child was with his Gma the night BEFORE the murders, clinging to her,etc. I think they are referring to the night OF the murders.

I don't know how reliable this is.But I have always thought there was abuse to this little boy and I have always wanted to know " IF " this little boy killed them.I want to know what provoked this or led up to this.I'm sorry but I really think 1000 swats is very excessive.NO ONE better EVER touch my kid this many times.

That blog really confused me. Unless we have read wrong and the grandma stated she thought he did it NOT because he was crying that night but because he was crying and clinging to her the night before?? She thought since he was so upset about the spanking the night before thats why she thought he had done it. Makes way more sense than she thought he killed his dad because he cried and clung to her right after his dad was dead. That just never made any sense to me, now if she would of said he had no emotion whatsoever and that is what made her feel that way, well that would be different.

Swat is a word used to make parents feel better about spanking their kids, sounds better than spank. Your right, when you say I swatted his/her hand sounds like you might have not even made contact just made a motion toward the hand...now when you say you smacked a hand, well there is no other way to take that LOL

Dad and step mom probably.Maybe friend.I think the bio mom Eryn said she thought the step mom was abusing her son.I do think that should be looked into because honestly she was the one hitting the little boy.But the little boy does say in the confession I believe his dad told her to do it.He got a little emotional.I really don't want to look at the confession again.It really bothered me.I am wondering what did they or she hit him with?

I ain't buying it. If the child had been severely beaten the night before there would have been marks on him and we would have heard about it by now.

I am with you on that, Linda.
If he had been severely beaten just the night before, neither the DA nor his own defense attorney, would have been saying they had uncovered no abuse and were saying that five days after the murders took place on the following Monday, and then the gag order was put in place.

I read the whole thing through again. That Avila woman is frightening. It must really take some smarts to get a false confession out of a traumatized child. Not.

When I asked his 12 year old sister the same questions she didn't know the term 'Juvie'. She is aware of Juvenile Detention. She said she learned about it in school.
Anyway, I suppose the St. Johns boy could have heard the word anywhere. It's certainly within reason that he could have been threatened with it, "If you don't straighten your a.. up and stop telling lies we're gonna send you to juvie". "It's an awful place. But you deserve it."
Just an observation.

Kids 8 and up talk about "juvie" around here. It is no big deal. Bad kids go to juvie.
If you watched the St John's Video tour posted yesterday, the St John's "Juvie" detention center is dead center in town on the main street.

I tell my daughter that if she doesn't put her seatbelt on and the police see her she will go to kiddie jail...

I've been reading about the Mossberg 702 Plinkster and the chipmunk rifle. I don't know if this means much but the Mossberg's manual says: "Because the rifle can be used as a single shot, it will fire whether a magazine is in the rifle if a cartridge is chambered." It also says that "if desired, the rifle can be single loaded with a cartridge directly into the chamber." And the"702 features an automatic bolt lock."
What do these statements mean? I don't know anything about guns but this info sounds like the Mossberg could be used as a single action gun if so desired. Is that right?

It also says the Mossberg 702 Plinkster has a capacity of 10(magazine) +1 so 11 shots, I guess. If you're saying that 11 shots were fired, the Mossberg may still fit......if I've been able to make any sense of this.

The boy's mother, stepmother, aunt and grandmother have visitation rights, but Brewer said the boy cannot talk openly with them because they could be called as witnesses.
If she is maybe she is also not sure that he has done it??
