There is supposed to be a hearing tomorrow on the motion for a new trial.
Thank you JBL. Curious though why McClinton will receive more years than the others.
Maybe he has a prior criminal record?
Could be. Thanks Victor.
I think he wouldn't have had the carry permit if he did. People who have the permit are supposed to know something about the laws and what you can and cannot do with your gun. Armed robbery - even if its your 1st one as a favor to a friend - really is beyond stupid - its illegal and he knew it.
"even if its your 1st one "

Ooh sorry didn't mean to rain on your parade. Thanks for the link, I could not find one.
He does. He was busted for pimping in 1998.
He also was busted for drugs and gun possesion, I think, in the 1980s.

I believe your thinking of Alexander that was busted.

I'd also looked up Grasso's court calendar WHOA - I thought OJ was his only client. He can't be doing to much babysitting for OJ with that docket.
OK - you made us go look! at 9 am Cashmore and Stewart are asking for new trials, and - interesting news: Lucherini wants out as attorney! I wonder if he thinks he is about to be charged for something related to this case. His name did pop up on the tapes!
I don't understand it; Lucherini wants out? heh heh

you guys rock when it comes to sharing info.
I remember the pimping came out in the trial - was it ever actually proved? The article didn't say anything about gun charge or drug bust, did it? As I asked; how could he have a legitimate carry permit if he had been convicted of those charges? The guy is really mad at OJ, isn't he? He just tried to do a friend a little favor.........lol
They're all FURIOUS! I would be to but hey they got sucked into that affable and may I add nefarious OJ persona.
Well except for Beardsley. He's not furious. Still hooked and in awe.
Anybody watching this hearing? I was in the kitchen when it started but if the allegations about the jury foreman are true, these men do deserve a new trial (and it really chaps me to say that).
I must admit I like the way OJ looks in jail garb though.
Motion denied. No hearing, no retrial...issues are preserved for appeal.
Yale asks for bail again, has a bail bondsman all lined up. Judge Glass says no again.

LMAO those allegations from a spiteful attorney (s) about the jury foreman.
More in line with grasping at straws.
They took the foreman's words out of context. If you see the whole tape plus several articles where the foreman came forward to speak on his behalf regarding the accusations against him - IMO he was credible.
Like the rumours that the foreman held the jury hostage until the 13th day of the 13th hour of the 13th aniversary. hahahaha

OMG remember last time he had a bailsbondsman set up. Jackie Glass asked who it was and he had to admit he really didn't have one and couldn't come up with a name. What a creature of the law. His proclamation not mine. Well there is one word in there I give credence to in describing him .

No New Trial for O.J. Simpson
Yale ---> hammer <--- Jackie
UH oh! I thought it was his comments following the trial - but the Pepsico thing - well that can certainly be checked to see if its true or not. Did Yale show or say he has any paperwork from Pepsico on that?
Grasso and Gallanter are on with Jami and they are just going over the jury interview, no mention of the Pepsico firing, unless I missed it.... I'm listening to Duffy's song "Mercy". I might sing it tonight but I need to hear it a few times if I'm gonna try it.
Any...on topic, I'm thinking if they had proof of the Pepsico firing, we would have been hearing more about that. If it's fictional, I would sue Grasso and Gallanter (if I were the foreman).

I get so frustrated listening to these defense attny's...What's with Yale claiming OJ is special..and should be considered..because of his status as a "Famous Person".?..
I do think that Yale forgets that his client is now a convicted felon..and Photo Ops in "Fine Dress" is not part of the "Human Rights" and just maybe Yale better start looking for a NEW CLIENT..
Defense dont want to play the "Race Card"...but keep dealing that card at every turn!! Geesh.. And just where does the Defense get off claiming that one person (Foreman) could force ALL the jurors to decide a case based on his belief OJ "Should have" been found guilty 13 years ago"....It does seem to me since Defense cant find legal rulings at issue....they chose to pursuit investigating the jurors...They also chose to seat the 12 jurors..and name the alternates before the trial...as there was 2 African American jurors on the entire panel...Why not gamble for the lottery of picking the "Diliberating panel" after the case was presented?????Their gamble failed..so now they want to investigate the jurors..and so far, the only one they find any fault with is that Jury Foreman..
I dont recall just how many verdicts have been overturned due to "Jury Misconduct"..Anybody?? know the stats on that?

Well these aren't the original ones but plucked from an article. If true I say 15 year minimum, maybe more. Is that kidnapping sentence x3 since victims are Fromong, Beardsley, Riccio and I'd say 1 more Cashmore was scared to leave he testified to GEEZ (and he came in with OJ)
http://www.lasvegassun.com/news/2008/oct/03/jury-still-out-oj-simpson-trial/
The kidnapping convictions each carry possible life sentences with no parole for five years.
The robbery convictions carry mandatory two-year sentences, plus an additional year, at minimum, for use of a deadly weapon.
The burglary conviction carries a mandatory two- to 15-year sentence and a possible fine of up to $15,000.
The coercion convictions carry mandatory one- to six-year sentences and a possible fine of up to $5,000.
The assault convictions carry mandatory one- to six-year sentences and a possible fine of up to $5,000.
Conspiracy to commit kidnapping carries a mandatory one- to six-year sentence and a possible fine of up to $5,000.
Conspiracy to commit robbery carries a mandatory one- to six-year sentence and a possible fine of up to $5,000.
Conspiracy to commit a crime is a gross misdemeanor that carries a possible probationable one-year sentence and/or $2,000 fine.

Yes - really.
There have been conflicting accounts of McClinton's criminal history in the media, which is what we were discussing on page 1 of this thread. The link reports the two different accounts and which outlets reported them.
One is from the Las Vegas Review Journal and one is from The New York Daily News.
Hope this helps.
imo
Well I follow the media for the "smoke". I see no back up to his criminal history in the form of court documents. Until I see one and knowing he had a permit to carry I'm going to go on the assumption he may have been charged but found not guilty. Purely speculating.
During sentencing that will be brought up if he does in fact have a documented criminal past that he was convicted on. Being accused and convicted is two different stories.

Nope and doubt we ever will.
They committed a crime together so it is most fitting they be tried together.
He wants OJ to apologize when he didn't have to participate in a crime. He's out of his mind if he ever expects OJ to say he's sorry for anything. OJ has no concious.
Please don't get me wrong I think all of them are quilty. I just wouldn't want to be tried with OJ. Guilt by association etc.
ITA OJ will never apologize.
Good point, but not sure he would have gotten a different verdict given his criminal history. You know what I mean?

Lawyer: OJ, co-defendant face 18 years
By KEN RITTER Associated Press Writer
Posted: 12/02/2008 04:36:01 PM PST
LAS VEGAS—O.J. Simpson and a co-defendant face a recommended 18 years in prison in the gunpoint robbery and kidnapping of two sports memorabilia dealers, according to defense briefs and Simpson's lawyer.
Defense lawyers for the former football star and co-defendant Clarence "C.J" Stewart filed briefs Tuesday asking Clark County District Court Judge Jackie Glass for minimum prison terms when she sentences the two men Friday.
"If the judge chooses minimum sentences but runs them consecutively it would total 18 years," Simpson lawyer Gabriel Grasso said after filing an 11-page defense brief in response to a state Parole and Probation Division sentencing recommendation.
"We would like the judge to take our recommendation to heart and sentence (Simpson) to the minimum, six years," Grasso said. . .
The brief refers to the confidential state Parole and Probation recommendation that the two men serve consecutive sentences totaling 18 years for two counts of kidnapping with a deadly weapon and two counts of
armed robbery with use of a weapon. The kidnapping charges each carry six-year sentences. Armed robbery charges each carry three-year sentences.
The brief indicates the other charges, including conspiracy, assault with a deadly weapon, burglary and coercion, would run concurrently. . ."

Simpson Sentencing memorandum
http://www.clarkcountycourts.us/media/C237890/2008-12-02%20SIMPSON%20SENTENCING%20MEMORANDUM.pdf
". . .Of course, the defense requests that each of the above sentences be run concurrent to each other. Under such a concurrent sentence structure, the total sentence in this case would be [B]6 to 17 1/2 years in Nevada State Prison[B]. Considering the above mentioned reasons and arguments, such a sentence would be a sufficient reflection of both the nature of the case as well as the first time offender status of the defendant. . ."

I hope they consider the request and go with the 17 1/2 years. Let's see that would make him 78 1/2 years old if he had to serve the time.
Anyone know when he would be eligible for parole?

Grasso's motion states "Even the harshest of Mr. Simpson's critics would agree that these were not the acts of a hardened criminal mind." Methinks perhaps Gabe has never read these message boards!
I noticed it also stated, "Our criminal justice system should not punish defendants to maximum sentences who are acting out of misapprehension or (space), as opposed to evincing an evil criminal mind." It appears Gabe intended to insert a word in that space, but forgot. I suspect he came up empty after searching his thesarus for a nice word for "stupidity" or "arrogance".
AnnInOhio
12-04-2008, 06:14 AM
Grasso's motion also states, "Persuaseively, the federal sentencing guidelines promulgate penalty considerations such as the seriousness of the offense, respect for the law, just punishment, deterrence, and protecting the public."
If I were Gabe, I think I'd have left that "persuasive" sentence out! OJ's lucky Fromong didn't die from his heart attack or that neither of the guys attempted to argue with him or resist. He showed zero respect for the law, has gone out of his way to avoid punishment by hiding assets and refusing to pay the Goldmans, has continued to become involved in legal issues. The public, in short, is tired of hearing about the exploits of poor, maligned, misunderstood OJ Simpson.

I'm thinking Stewart will get the minimum and OJ will get 1-1/2 what Stewart gets so about 10 years for OJ, out in 5 if he can maintain "good behavior" inside. You know what really kind of makes me sad though? My gut tells me OJ will try to play "smooth operator" in prison, and will get himself killed within a year. So far he's fallen from the day I heard about the murders years ago. I remember how shocked I was to see OJ Simpson charged with murder, how I hoped he would not kill himself in dispair on that surreal freeway drive. Now I see him as a man who has gone full circle, back to the street thug he was as a teenager. What a shame and a waste of so many people's efforts to help him rise from the gutter and then go right back.

So as not to show she's given one a stiffer penalty for being convicted of the same crime's I think she will dole out the same to both.
You don't think OJ had more to gain and played a larger role than Stewart? If not for OJ, Stewart would never have been there. Stewart wasn't "in charge" and had nothing to gain but OJ's appreciation.

Stewart had a choice just like the rest of them. He could have said 'no'. IMO

sometimes I think the 'followers' are even scarier than the leaders. at what point did stewart not know that this was wrong? orenthal and his buddies were giggling like school girls in anticipation of and after. do I think orenthal deserves the harsher sentence? yes for the same reasons you stated: he made the whole thing happen. do I believe stewart should be half that? no. we don't know what he would have been willing to do -- that's scarey.

I think she will follow very closely to the sentences the state recommends.
I believe they will have presented a very convincing brief to her that supports it and we're talking about a slew of mandatory minimum felonies here.
I don't think he'll have to worry about stealing cable for a long time and I am beyond ecstatic about it.

I gather the presentence investigation report wasn't of the fill-in-a-number-on-the-form variety Grasso expected. I was hoping it would be made public, especially the psych report. Not that everyone doesn't have a pretty good idea what OJ's psych report would say. Any thoughts on who will show up in court to support OJ?

I just saw a little while ago that ESPN will start televising the hearing at noon eastern tomorrow. That is 11 am central for us TX folks.

I don't think it will be a very long hearing. I hope I get back by 11, but its unlikely. I'm sure it will be replayed later by CNN or the Las Vegas channels. Funny there is so much media interest in this trial and none in the Spector Trial. Spector is a far more famous figure IMO. Gotta admit - this one is a fun 3 ring circus full of unusual characters.
Yes, this thing isn't much of a media event, and neither is the Spector trial. I disagree with you about Spector -- OJ is far more famous the Spector!

I agree that Simpson is more famous than Spector and I hope Stewart's sentence is less than OJ's. -- The one I really hope they go easy on (when they get to him) is Cashmore.
FWIW I don't think Simpson's appeal will be granted, but I think Stewart stands a pretty good chance. -- Can't wait to see Judge Jackie tomorrow! :patriot:
