I just finished listening to Cook on the stand but haven't heard legal argument between the judge and attorneys. Cook refers to interrogatories from December 2006 forward. I'm surprised they didn't go back to the mid '90's when the first interrogatories were done to see if OJ has EVER claimed owning the memorabilia. Back to the initial court order approving the "leaked" pending LE removal of assets at Rockingham listing what items were to have been seized. If these items were listed to be picked up OJ surely had to answer to the court at that time where they were. He would have had to either declared them stolen at that time or declared he didn't own them. If OJ had declared them stolen to that first court they'd have asked if they were insured and collect any insurance reimbursement for them. I agree with Yale that the current interrogatories are snapshots of what OJ currently owns. I'd trace it back through the civil court records.

Yale says "If there was an interrogatory that said 'Have you ever claimed to have had property stolen from you in excess of $500' and he (OJ) answered that question 'No', and swore to it, clearly that would be relevant to impeach Mr. Simpson's prior testimony in that interrogatory. But here it has nothing to do with the issues in this case." I think this suggests that Yale knows OJ never reported the items stolen on any court interrogatories.

As I'm thinking about it, it almost seems to me that putting any of the interrogatory stuff in send a wrong message to the jurors - feeding OJ's defense that he was going in there to get his own "stuff". They should instead pound home the law: it doesn't matter whether Fromong and Beardsley had his stuff or their stuff in that room. It'll illegal to inveigle and entice anyone to a hotel room for the purpose of robbing them of stuff. It's illegal to hold someone in a hotel room through intimidation, and it's illegal to take items under those conditions instead of seeking civil legal recourse. I think it might be a better tactic to blow off OJ's "it was about MY stuff" defense at every turn.

So Cook testified last night. thanks for the posts, ann. i agree with you, trace it. but i also agree that yale knows.
between this case and now they have release 600 more pages of the caylee investigation i'm going nuts! i'm onlhy on page 117.
who's the next witness today?
we were going to have more blueberry muffins this morning but bearwds must have been up snacking on them last night, lol. so i made biscuits with strawberry butter for this morning with some coffee. help yourself!
He was questioned by the judge and attorneys. He didn't testify in front of the jury yet. I think they'll have him on to testify today - shouldn't take long.
I have cinnamon rolls & coffee and keep trying to get over to check out the new Caylee documents.

There is a document somewhere that OJ signed thru the legal system (I don't even know what it's legally called) but it's to the effect that a) Nothing was stolen b)to the best of his knowledge he owns nothing else of value. c)everything he had was turned over.
Man, it's getting tough to look up past OJ stuff - there so many documents uch out there spanning his different court charges thru the years.

IMO, they're trying to do all. Show motive - Simpsons frame of mind and why/how these items came to be in Fromongs possession.
I recall Galanter trying to make a point with Det. Caldwell of how he checked to see who was the rightfull owner. (IMO - trying to prove they were just out for OJ and nothing was checked regarding OJ's statements of it's his stuff.) Caldwell testified that was not one of the criteria's for determining a robbery. Somewhere I've read that in actuallity Caldwell did contact Goldmans attorney to determine ownership although it was NOT before OJ was arrested.

LOL Ann...The group also spoke about the criminal backgrounds of the two witnesses..Rizzio and Erlich and how Yale was attempting to use that fact to show these guys would NEVER get invlovled with anything against the law and risk getting re-incarcerated..Humm..I wonder how he can then say that same spin about those other witnesses who have records..to make it seem they Did break the law.!!.aka..McClinton..as one example..hum??or Walter Alexander..who Yale tried to dirty up during the preliminary hearing..

I live in Maryland and have been on the Grand Jury since February. In fact, tomorrow my obligation expires. Hooray! But, we did have a case brought before us regarding a robbery and murder and we had to find cause to indict. We were instructed that one could indeed be found guilty of robbery when force is used to take something, even if that item or items belonged to the person doing the taking. If that is true, then whether or not these items belonged to OJ seems to make this a moot point. Anybody want to clarify that for me?

That's funny! Riccio reminded me of my fat, silver and white brown eyed husky that always has an impish look on his face and everything in life is a game! And they apparently have being a runner in common (Riccio's past prison escape)! Husky's are notorious for being hard to obedience train, and Riccio had trouble monitoring his mouth on the stand without constant reprimand.

You are right on that point..OJ had no right to take abunch of guys to that room and intimidate the two marks to take anything..however the defense (Yale and Grasso) are attempting to nullify the jury to feel sympathy for OJ..and that OJ felt it was not against the law to get his stuff back..LOL
The other thing is that OJ didnt think these two marks would ever call the police..but they did..and the guns brought into the mix enhanced that robbery to felony's. I do think that IF no guns..OJ would have been charged..but with far lessor crime and no jail time..given the sleeze factor among all parties here..

I take from your concerns..that is why the coined phrase arose.."A Grand Jury will indict a Ham Sandwich"...I guess where you were concerned..that Ham Sandwish would survive to be eaten another day!!
I agree with you tho.too often G.Jurors just want to get it done with..pro prosecution..etc!!..One question for ya..Do the group of GJurors discuss the evidence??Is there any real debates..and devil advocates?? I find it very interesting..i love learning from other's experiences..

There was a comment on InSession likening this case to the movie "My Cousin Vinny". I was thinking of Joe Pesci's examination of Marissa Tomai when when Yale was cross-examining Ehrlich their friendship and familiarity with each other led to a lot of the talking over each instead of the typical, and required, question and answer. Another comment was that everyone expected the criminal reputations of these witnesses would call into question their reliability. Yale, as Erhlich's friend, instead tried to turn it around as a "plus" for the defense.

Yes, Lynda. In fact, we had a case of murder where there were two young men, (19 and 21), and we were asked to indict of first degree murder. One used a baseball bat to kill another young man during an argument. The other boy drove them away. I truly agreed with the charge on the boy who did the act, but really wanted a second degree murder charge on the second boy. I lost. There was only one other person in the room of 23 who voted the way I did. There were one or two who abstained. Again, the argument was, "Well the State can still bring a second degree charge, or the jury can find second degree." Although that is true, I believe the charge should fit the crime, and I don't think the second boy could absolutely KNOW what was in the mind of the first boy. I don't think there would have been any miscarriage of justice had the second boy been indicted of second degree murder. BTW the photos were horrendous! I'm glad the whole thing is over, but I did learn a lot.

I do see your point. This robbery was wrong on so many different levels no matter which level you argued on. I guess just stick to the basics and let the state of california deal with the other level of who the stuff actually belonged to.

Cook's testimony is not necessary as I think this witness along with Gilbert will be able to serve that same purpose..OJ's mindset was to keep this stuff out the Goldman's clutches..
As to the gun's in the mix..this witness along with McClinton.is going to clarify who really wanted them there..

I served 3 months on the grand jury in Massachusetts where we take gj duty very seriously. I remember the very 1st day hearing 8 different sex abuse cases. That opened my eyes. Anyway we did return a no bill on one case (rape case) much to the chagrin of the pro. Sorry about off topic.

I'm coming to believe this was much more about OJ getting this stuff out of Gilbert's clutches. If OJ could get it to Florida I think he thought he probably could have kept it out of Goldman's clutches by other means. I think he has a deep seated hatred of Mike Gilbert.

Las Vegas is the wild wild west, they look at guns differently out there. I still can see this going either way, most likely a hung jury. jmo
Actually having a gun in Vegas is probably the worst especially in a casino. Granted technically they weren't IN the casino but they take it very seriously.
Unfortunately I can see it going either of the three ways not guilty, guilty, hung ONLY because it's OJ. Man off the street guilty hands down.

This witness is succinct and giving us the straight story, (I almost wrote a straight shooter, no pun intended.) After Riccio and Ehrlich, it is such a relief!!! Been taking copious notes but cann't post or I'd be banned! On the bs-o-meter this guy isn't imo -- and OJ can't unring this bell (as Loni just said.)

I stopped watching her at exactly 9:25 a.m. (EST) on Monday (when they had the four-panel thingie). Her voice, and this time her grimaces or whatever they were, permanently turned me away from EVER watching her again. Bad enough she's on between 11:00-1:00, but this was waaaay too early, and not even her time slot. If she's on, I turn it off. Period.

I wish Judge Glass would reign him in, but she doesn't seem to be able to. Lonnie, who is a lawyer, was saying how inappropriate it is for Yale to be setting ground rules & taking charge of the courtroom. If Judge Glass isn't going to control her courtroom, I can't expect Yale to behave.
Also I think Yale was extra heated today because Alexander did a lot of damage to OJ's defense.

We found stuff from Edgar Allan Poe The Raven in his handwriting the paper is old, now I have got to try to authenticate it, also found some things from Glen Curtis, know that's authentic because he was my roommates relative, also found stuff from Longfellow that is also authentic, found an article that it was given to my roommate's relative by Longfellow's grandson Dana. Do you think Fromong would be interested in buying some of this? It's not stolen.

I think even without it being admitted, it'll become pretty obvious to the jurors, if it isn't already - they know there was a turn over order, they know that Fromong and others talk about stuff being hidden, and they know that the stuff in the room was worth some pretty big bucks. Absolutely - he was quoted a few years ago as saying, he would rather throw valuable things away rather than give the Goldman's one dime. (well, that's a paraphrase). Anyway, just heard on Lis Bloom's show (yes, I am behind) that majority opinion (minus JF, of course) is all were at Rockingham after the civil suit to ship his stuff off to various warehouses. Mike Gilbert was in charge of some of the load(s). So, if MG stole it, it was while on the way to the warehouse to be hidden anyway. That's why OJ never called the police to report anything stolen. MG (for whatever his testimony is worth, we don't know yet, supposedly will testify to the same thing)

Actually, OJ says Mike stole it on the way from the warehouse to OJ after OJ moved to Florida. It's on the tapes. Mike dropped off some stuff but not everything in the truck.
Gilbert will probably testify that stuff was OK once it got safely out of California and into Florida, and that the stuff he "kept" was given to him as a form of barter in payment for money OJ owed him. Gilbert will probably also say that he in turn later bartered it to Fromong. Just a guess, but I've read that before this case ever started.

They took away Alexander's prop bible. I never trust anyone who uses it as a prop - if he believed he wouldn't need it to read, and no one else gets a book to entertain them.
Yale's attempts to bring Alexander's other job into the questioning vehemently denied by the judge - after review, Alexander's mention of his realty job was in answer to questions of his motivation to take the deal, so as not to have something on his record that would kill that job - so his failure to mention his (legal) brothel is not an omission nor something that impeaches his honesty or testimony from the prelim. - my interpretation anyway.

His argument was that Alexander talked about his job in another hearing, and mentioned his realty job, and that this is a lie, since his main income is from the escort business, and thus it's a valid point of discussion as a method of impeaching testimony.
The counter to that was that the discussion of the realty job was Alexander's motivation for pleading, not Alexander answering some question about his entire income. Since that indeed was the context of the questions and answers about the realty job, it was ruled that this was not something admissible nor relevant.
After a great deal of arguing, judge ruled it was not relevant, Yale wouldn't sit down, wanted to reargue the point over and over again. And just now he tried to introduce it again by trying to get the witness to list all of his sources of income - was smacked down again - not relevant. Yale really wants it in, to slime this witness.

SeptemberI'm sure he was hoping for Alexander to do something to appear violent to the jury - but in the situation, Yale appeared equal or a little worse than Alexander in terms of slightly violent behavior (yelling, refusing to move back).
It's a common trick - prosecution and defense use it. If the witness gets violent, the jury figures (and rightly so) that they've seen the person's true colors. No luck this time - Alexander definitely wanted him out of his personal space, but "used his words" - no shoving, no nothing.

thelegaledge.com only shows highlights. but they do have a re-cap of the days proceedings which is good.
Come to think of it. He should just go down to the parking lot and look in the back of CJ's Navigator. Maybe there still a box there from the "alleged" robbery at the Palace and someone threw in the Bible from Riccio's room.

Record the online feed. At least on my computer, if I hover at the top right of the "tv" frame (not the Window) a popup comes up that says "download this video". Microsoft Real Player records up to four (4) hours.

Try KTLA I think they have recap vid's I don't think their in the entirety but may have some highlights.

This would be a completely different type of trial with Judge Fidler on the bench. This is actually painful to watch her ineptitude. She herself is the catalyst to this chaos, by her childlike behavior. I can't stand to watch her in action.
I couldn't disagree more. I consider her very professional. She only responds - child-like- to the childish, petulant behavior of the defense attorneys, for the most part. I really enjoy her take-charge attitude.

I can't blame him for not admitting he is a ****.... it is NOT the same as saying he's not a milkman! That admission would definitely be the end of his real estate license.He's not doing anything illegal. He and his wife run an escort service is the impression I get - or maybe a brothel at a location where that is legal (prostitution is legal in much of Nevada). He's not admitting to any crime when he talks about that, nor would it kill his realty license, since it's not a crime.

I wish there were transcripts or video of the preliminary hearings. I thought Alexander did say his income was derived fron his real estate dealings because that was when his real job was brought up.

I suppose she could instead have the bailiff remove them - but that would cause trouble for the defendant.
I don't see another choice - Yale does not respond to the reasonable, "objection heard and overruled" a lot of the time.

He runs an escort service now, but I think his other job was actually in California where it was definitely illegal.

Escort services aren't illegal in California. The Yellow Pages has pages and pages of them. Many, if not all, are not very subtle covers for prostitution, which is illegal - but if the managers of the service are not arranging sex for money, it's legal. They purport to provide a private sensual dance, not sex for money, and that is legal.
I had an aquaintance who worked for one once. Interesting stuff. You start out dancing, as contracted, then if you choose, you make your own arrangement with the client for sex for an additional fee paid to you, not the agency. She always had self-image problems, which lead her to that - she tried it, made money, but couldn't stand the way she felt about herself, doing that.

This guy so far seems very bland - looking for work, etc. - wonder if he's got any record, what the defense has on him. So far, he seems like a total nobody.
Poodle - he's a random aquaintance of Stewarts, looking for work, called to carry stuff for OJ - at least that's our story so far.

This guy is a pretty good witness too - he's not involved until the last minute, very matter of fact, not much of any motivation for him to lie - he didn't have the gun, he wasn't involved in planning it, etc.
Hysterical listening to the witness and attorney cleaning up the language. "They don't know who they are, do they".

When Yale used the word p-i-m-p I thought he was talking about something illigal. And I didn't see anything about any conviction for that.
The relevance Ann is that Yale wants to show that Alexander is scum and a liar as well.... and therefor the jury should not believe what he says.It's prejudicial, and a way to make the jury weigh the testimony differently, based especially on loaded words like "p i m p".
Prejudicial and irrelevant - two good reasons not to include it. Attorneys aren't allowed to go fishing in your life for everything some juror might not like and judge you on. It'd be the same if you were gay, a defense attorney might try to get you to mention your boyfriend, in hopes there is a prejudiced juror, and refer to you as a sodomite.
Sounds like he may have been doing something illegal, and may have been in CA - I don't know much about that - but it is all irrelevant - it has nothing to do with this case.

but my only outlet, Headline News, isn't showing much....I waited with much anticipation, this a.m., waiting to hear if the good Judge would allow testimony from the Goldman camp.
Pulling teeth and hair hours later, I think the good Judge, however, did certainly make the correct and right decision to keep out testimony from another trial another decision another time and place regardless how all of us want OJ's juice squeeshed. Allowing that spells, to me, a-p-p-e-a-l.
If this court wants a conviction to stick....gotta do it the right way.

I don't know what his charges were - I'd expect them to be a little lesser - no conspiracy at least. I'm sure we'll hear about that.
