Im here, present and acconted for...LOL..I am looking foreward to watching InSession this morning to catch up on the court proceedings yesterday..and between the posters updating me last eveng and seeing this mornings discussions..I will feel more able to contribute to the boards today!!

I really want to see Mike Gilbert's testimony, as he has been at OJ's side way back in the role of Agent and Promoting his image..thus was directly responsibile in getting OJ into the Memorabila Game way back when..Mike was resposnsible for getting Fromong and OJ together as well.

OJ can cry all he wants about people maing money off his back..but it he that uses these same people to make money for himself that cant be traced..thus kept out of the clutches of any Judgement repayment. You have to know if these people make moey..OJ gets a large piece of that action too!!

I will shut up now, and watch Lisa Bloom this morning to get mire input!!
Will also be watching this thread for discussion..

I don't care so much about Gilbert because I don't think the issue of whether or not OJ actually owned the items matters to anybody but OJ, Galanter and Grasso. The stuff and its value only goes to OJ's state of mind and the state of mind of the posse. I suspect that's why Judge Glass cuts OJ's attorneys short on that topic.

Riccio's going to be the wildcard. He's a real piece of work as a human being, but I think what you see is what you get with him.

Beardsley is so mentally unstable I wouldn't even put him on if I was the prosecution. He was just one of Riccio's pawns and so excitable I don't think his testimony would be credible.

just some friendly advice: all CAPS are hard on the eyes.

Well I'm old and wear bifocals, so reading anything online is an ongoing battle for me. IMO, all caps is harder to read than typing with proper capitalization and punctuation. Many people will simply skim over posts that are hard to read, especially if they are long. A few words in all caps is one thing; a long paragraph gets pretty trying. Same can be said for all lowercase typing.

ITA Only difference is I don't wear bifocals, just reading glasses for my presbyopia. :)

Poor OJ, he has to "endure" taunts on his way into court (along with the adoring fans). It could be so much worse, he's not in prison for murder like he should be.

He's out in the parking lot now; checking out the new paint job on the building, I think. He's really nice, has been very good to me since I've been sick and having to take time off and such. I don't think he would even care if I listened while he was here; other people have music on in their offices and he doesn't say anything.

I think it is so empty for this testimony because it is a video deposition by this FBI Agent who is not available to testify live in court today. and yes those flowers behind him are the same ones there now..today..and probably very dusty...LOL

they taped his testimony because he wasnt going to be available for the trial. he had tickets paid allready for something...plane tickets.

One decent point - that he listens to the recordings for sudden changes in background noise. No amount of theoretical ability to "upload" changes the fact that it's OJ and crew's voices, and with that to show that the recordings were not altered, I don't think the jury will buy the smoke and mirrors of a theoretical capability to "upload" with the right equipment.

I still cannot get the Las Vegas station to work without constantly rebuffering so I've resorted to listening to the cnn online feed while watching TruTV.

Especially when OJ walks in the door and says it's O.J. Simpson but what about Clarence Stewart we don't know what he said or what his voice sounds like. I wanna hear the tape of when they walked in the room that is when I can establish some kind of crime.

IMO, OJ should be on death row. However, he's NOT and this trial is a witch hunt. How many people care about "thug on thug" violence? Not many. In fact, the police usually leave these types alone and let them "work" their problems out on their own. The prosecutors are using this opportunity to put OJ behind bars (which is fine by me) but it appears they're abusing their power. We need judicial restraint. That's what this system is about. Judicial restraint.Police do care about thug on thug violence, the victims in this case are not thugs but reputable businessmen, and this is no witch hunt - OJ committed several real crimes.

I think Mr. Stewart is getting lost in this case...he is nowhere near as culpible in the planning of, nor orchestrating this sting..he is guilty of participating in an armed robbery..and thats about it..I rather doubt Mr. Stewarts voice will be decernable in any of these tapes or recordings..however, I do believe that the Simpson council are utilizing this guys knowledge base to do the cross of this witness...

Ignoring this crime because of some perception that the victims are 'thugs' and thus deserve whatever they get just encourages the idea that OJ can commit an armed robbery, take what he wants, and get to keep it, free and clear - without checking if it belongs to him (and it doesn't), without checking if this is stuff that was supposed to be turned over for a civil judgement, etc.

Even were this thug on thug violence (and it isn't) - any police department that ignores that helps it to spread - and thugs never limit their victims only to other thugs.

BORING.........For me anyway.
I can't see it getting any better either without any medical testimony or DNA. All I saw of the first OJ trial thank G_d was the Bronco chase and the verdict.
Then to top it off Jackie Glass appears to be having mid-life outbreaks and IMO much of the same cynicalism as Elizabeth Halverson. The way she rips off the jury instructions at each break screams to me she would rather be at the spa. These poor jurors!

I think the intent question is about whether the intent was to take by force right from the start, or if it developed into that. Were the guns there to intimidate, or were they fashion accessories being shown off just for the fun of it.

I don't think it's a really relevant question - you go in waving guns, intent is right there. You take stuff that isn't yours, intent is there. You tell the guy when he protests that this is his stuff, that you'll at least leave him his cell phone at the front desk - intent is there. Pretty simple.

I guess TruTv has played the judges out break one too many times for me to stomach. I understand the importance of having a no nonsense Judge and control of the courtroom. I would like to see the jury pampered and not confused by how fast the instructions are being read at each break, IMO it minimizes the importance of the jury's duties. I am sure Jackie Glass will read the deliberation instructions slower as there will be many for them to consider. JMO

I think the two defendants help with getting to the truth in the case. You cannot have one defendant paint the other as the complete villain uncontested because the other attorney is going to tell their version of the truth. There have been several moments already when one attorney or the other objects to something where they are painting what is claimed to be a false image of the events - with only one defendant, you can paint any illusion. With two, you have a harder time.

I'm with you. I LOVE LOVE LOVE true crime. I can't get enough. I read true crime books. I watch trials. My dad is a deputy coroner/forensic investigator and I question him to death about any interesting cases he does. I just can't get enough. Do you find yourself being suspicious about things you see because you have an investigative mind?? I do that. I probably shouldn't, but I can't help it.

I know of a person recently whose baby died. I thought her story about how it smothered in a blanket was just odd. My investigative work turned up that this was the second child in this family to have died this way. So what do you think MY mind is telling me? I just can't help wanting to investigate things. I guess my mind is now programmed to think: "Things are not always as they appear."

Lynda! I totally agree, every single Time I think of the Goldmans, or Nicoles family and how OJ has continued to profit off of his crime, off of their death, use their blood money, it makes my blood BOIL! I guess there is a part of me that could never sit in judgement of him on a jury. I think that he is a cold blooded killer, and it's his time to "go down" any way the state can make it happen. i know that sounds horrible, and I do have questions about how this tape came to be; and whether or not it was a set up from the start, but all that negates the violence in that room; on that tape that night. I've heard the tape, i dont care if OJ had a gun or not; he was an accomplice and I'm pretty much good to go as a guilty from what we've heard. I dont follow trials and pretend to be a juror, I just go with what I've seen and heard and read and from there I base my opinions. I cant stand OJ simpson, and I hope one day he feels the same pain that he inflicted on Nichole, and Ron Goldman. I think for him that can only happen in a cell. He's a dangerous man. That one juror that was excused put it best: Why after your last trial and then the civil case couldnt you keep your nose clean, but no you ended up here in Vegas, again on the wrong side of the law. Not verbatim but close. I feel the same way, How Come OJ? Are you just really a bad man and no matter where you go; eventually you show your "true colors?" I think so. Abusive, that's my label for OJ. He likes to beat people up, he thinks the world will Kowtow to him. He's so wrong; he will see. Dots

It all comes down to the "Blood on his hands"...kinda like "Out Damn Spot..Out I say" from Hamlet..Once it's there you can never get it off..and his demons are causing him to continue on...He will never ever be able to get away with what he did., ( especially when he reach's FINAL JUDGEMNT),however, what happened in Las Vegas will not "Stay in Las Vegas' much to the chegrin of naysayers..None of this would have happened IF OJ had not engineered it!!!!!

I think (for me anyway) that is the point. OJ AND his “posse” are not on trial. OJ is. His posse got a deal just so that they could get OJ. It wouldn’t bother me so bad if they had made the deal with others that were NOT brandishing the guns but they didn’t. They have done it this way for one purpose and for one purpose only. To do what Marsha Clarke and Chris Darden failed to do.

I had to run to the commissary….did I miss the slime?

Well, OJ could have turned on the others just as well, but then he'd have had to admit guilt as they did. OJ never just admits guilt. Everybody acts like they all got off scot-free. I believe they plead guilty and will have felony convictions on their records.

I find it odd that nobody thinks that Justin and Sidney don't deserve anything. They are the biggest victims of all in this. I think those children deserve everything. What are they going to show their children pictures on the internet.

Indeed Justin and Sidney are victims....not unlike so many people in OJ's life...even his relationship with his older children is strained and marred with allegations..not to mention his alleged abuse of his significant other lady friend..who by the way havent seen in the courtroom today...So many of his "Villagers" are deserting him.and he will be alone on his island..to enjoy his utopia of his own imagination..One can only get way with so much and so called friends will walk away...He deserves that..OJ is one nasty Puppy!!!

LMS..

BTW..Its not like the Brown's didnt try to shield them from all this from the giddy-up..but OJ revailed thus doomng those kids to a very ugly legacy!!!

What are they going to show their children pictures on the internet.Who has said that? But Justin and Sidney are not involved in this case - none of this was their posessions - not a thing has been shown. They might like to have some of their father's memorabilia - but that's not something that excuses armed robbery.

They are the closest family - but it's up to their guardians to sue for them until they are old enough to do it themselves, then it's up to them to do it themselves if they want this stuff.

But everything I've read says that first, they are not trying to get anything, and second, that they are being taken care of.

I don't know their thoughts - but I know mine. If my father killed my mother, I wouldn't want a thing of his! And if I believed that wasn't true, I'd still not find my memories of my father to be in momentos of his sports career, but in things that represented him as my father. I'm sure they can get a signed OJ photo anytime they like.

Oh please! If OJ didn't have sentimental family photos in his possession - if he and his sibs made mom responsible for safeguarding everything - he and his sibs should have made sure where they were when grandma Simpson died. Why would his kids want football stuff - reminders of the life their dad threw away? People lose ownership of stuff stored in storage facilities every day.

I will take the fifth.Hmm - right to avoid self-incrimination. So then, you are implying that you (or your spouse) are the ones who said that Justin and Sidney deserve nothing?

:D

Although, how that works with your statement that "nobody thinks..." - in order for the fifth to work, you'd have to be saying that everyone in the forum is either a double of you or your spouse. Very interesting. Am I married to you? Obviously if "nobody thinks", that means I have to be part of those who think the opposite, and to take the fifth about how you know what I supposedly think, I have to be either you or your spouse - that's all the right to avoid self incrimination applies to.

BG I really like the new medium. Tis one thing to read about a crime, or to watch a trial. To be able to comminucate with others, whilst watching said live trial is priceless. It's really addictive I think. I love the law, and enjoy watching all of it. I am a freak. But not really I just love true crime, live or not. I always have, but lately the cases of missing people have really really upset me. Really. (bops self)
----------------------------------------------------------
I love the law as well. Unfortunately when defense tactics changed with the advent of the first "Twinkie Defense," the dominoes started to fall against true justice. Then came "Jury Consultants." A defendant is supposed to be judged by an unbiased jury of his/her peers. Defense jury consultants advise which jurors ARE biased towards the defendant, and Prosecution jury consultants advise which jurors are biased against the defendant. Seating a jury that has been selected with the help of jury consultants is NOT, in my opinion, having an unbiased jury! The Voir Dire system should be drastically overhauled to weed out prospective jurors who are biased, have agendas, or could never find the defendant guilty, etc.. Jury consultants should be banned. I also dislike Jamie, and of her guests for many reasons. The most irritating is when she and some of her guest defense attorneys, during a trial where the defendant obviously has a motive, is caught with the weapon in his hand at the scene, confesses, but the confession is thrown out through some technicality, say the most outrageous things to justify acquittal for the defendant. Is it just me, or does Simpson's defense attorney seem like the epitome of a mob lawyer in looks, words, actions, and smoke and mirrors?

I know he has to push for his client - but boy is this annoying. So much nitpicking. And I think he's quoting one bit of the law that does not apply - he mentions that deletions are present - and I don't think the law he quotes is talking of the same type of deletion. There are no deletions in the tapes where parts of the audio in these recordings was deliberately deleted. There are deletions on the recording devices that are old deleted recordings.

And the experts say they cannot testify there's no way the tapes were altered - which is pretty much what an expert will always say - because there's always some way. But that's the difference between a scientist or expert and an average person's language. There's no reason to think these items were modified, it'd take some knowledge to have done so, and the recordings appear unaltered. But to say it is impossible is nothing any reputable expert would say.

So I don't think what he is quoting applies, nor should it.

Hi
I have been watching this trial unfold and think the Judge made a wise ruling on not allowing the transcripts of the audio tapes. It would leave the door wide open for appeal. This way the jury decideds upon hearing the tapes what they believe and hopeully when they go to deliberate if they are allowed they can listen to those tapes again if they want to. By doing this a defense attorney can not say that the transcripts have been altered as to what was said or have parts missing.

Love the great big styrofoam cup with straw the Judge is drinking from lol. No little glass of water for her. This will probably lead to several 10 min breaks he he.

I heard just the opposite that there were no jury consultants. I use to be a jury consult and no they shouldn't be banned. Preparing for trial is so involved that sometimes a lawyer may miss a bad juror. A lot of my friends still are jury consults. Our judicial system works 98% of the time and it's very rare that people don't go to jail. If an confession gets thrown out it usually is LE fault not the jury consultant.

Well, since you were the one who brought up Sidney and Justin Simpson and that you think "those children deserve everything" ...

Do/Did Sidney and Justin really need or want the proceeds from the book OJ was going to publish called "If I Did It" until the Goldmans succeeded in preventing OJ from making money off that?

Isn't the Brown Estate actually the estate of Nicole? Isn't the Brown Estate also part of the civil suit award? And are Sidney and Justin not the main beneficiaries of that estate? IF so, then it is their very own father, OJ, who with all the hiding of his assets is depriving them from their rightful inheritance.

It is my understanding that Simpson got a $700,000 non-refundable advance on the book. So he still made quite a bit of money, even though he lost the rights to the Goldman's...

Gee, can't help but wonder if some of that $700,000 book advance OJ got from his book "If I Did It" is paying for Sidney and Justin's college expenses.

That OJ ... what a prince of a guy.:flamemad:

Me thinks that 700,000.00 didnt see the light of day for those kids..I think most of it went to debts he owes to his lawyers and cash under the table...which IRS knows nothing about...Which I think they should if not audit Galanter's "In-Trust Accounts" and dispersals...HUM... I'd bet there are alot of shenanigans goings on there!!! Gives a new meaning to lawyers honesty...versus protecting clients!!!

I got it in her post - she said that it was just a show - I wasn't sure if you were taking it seriously suggesting a tissue. I was just saying, even as a show, I don't think the jury is that credulous to buy into a show with that type of evidence - it'd be too over the top, it'd look like a show - JMO.

No I was serious about the tissue, then he wipe his nose again with his hand and then licked his mustache. Yuk

Oh my Details, you have much more faith in the general public than I do.

As evidenced by the political situation today,

Fill out the following:

"The bridge to ________"
"Winston tastes good like a cigarette_______"
"If it don't fit, you must _____"

There, hand in your papers....lol Bet you got 100%

Point being, we have a society that has been dumbed down and looks for the slogan or quick fix. Lawyers have to realize that when they are presenting a show. Yes, I meant show. It's a production and woe be to the attorney that forgets that.

<offa soapbox>...lol

LOL....Up here it's termed "Creative Accounting"..in otherwords..there is always unscrutable accountants who can make magic happen...but claim don know nuttin..only go by info given..and so on and so on..I know..and chose not to follow that venue...but have witnessed it going on!!!..It's like waiting for the second shoe to DROP!!!..Unfortunately some rather large accounting firms have gone down the tubes over this practice..!! Trust funds where Lawyers are concerned can be abused like any other venue!! and I know for a fact it goes on..dont condone..but know it happens!!

OJ's association with Yale Galanter only solidifies those thoughts in my mind..There is no way people can hide big bucks like OJ has and not have HELP!!!

It's all "are you a linquist, special training in voice recognition?" junk - hmmm - how about the same training we all get - 18 years growing up, plus every minute of every day pretty nearly? You don't have to be a linguist to listen to a tape.

america's got talent coming on here in about 30 minutes. i know this is off topic but i want the two black male fiddlers to win, if not then the old guy who does the frank sinatra singing.

i don't know who this lawyer is who is questioning right now.

Bryson, for C. Stewart. You probably won't forget him after this!!

ETA - Why do some Defense atty's HAVE to be so confrontational? Do they really think that wins them points with the jury? IMO, it is just a put off, especially when doing so with a sworn law enforcement employee!

It's weird, but so far, Yale seems to be a good clean defense attorney - just trying to get the facts out. I'm sure that image, that presentation helps the jurors pay more attention to his cross than the other attorney who seems a lot more of a jerk trying to hide anything he can. We'll see how it goes - but so far, he seems pretty clean. A few little tricks, but nothing out of line.

why are they going home early?

Good question. I believe an issue came up per Yale that he wanted to take up to sidebar w/ the judge. From that convo, the Judge must have discerned the issue was too lengthy to keep the jury there & they must talk about it w/ ample time. Hmmm, what could it be?

and I agree w/ others that the dichotomy of Galanter & Bryson is very apparent. Wonder if that will affect the juror's view of their clients. I always liked Yale (as far as any Defense atty-and a bit shocked when he took on OJ as a client years ago). He does seem fair and non condescending. I was waiting for the veritable "other shoe to drop" before but maybe that is just who he is. He doesn't need to be obnoxious and stand-offish to get his point(s) across.

Well good night all. See ya in the am!!

The massive negative public response when news of the book was was announced was used as an excuse for firing the HarperCollins editor Judith Regan who put the repugnant deal together. It might be that her firing had more to do with the manner in which the huge advance was paid to Simpson, and hoping to avoid any liability on HarperCollins part in a conspiracy to avoid paying any of the funds towards the Goldman's judgement. Ms. Regan and Simpson worked out the details of the advance payment, both knowing that there was a huge judgement against his earnings. Both should have been arrested at that time for intentionally conspiring to avoid payment of the judgement. I do not believe that the statute of limitations for their criminal act has run out. There was a statement at the time that the advance was gone as soon as it was paid. They should both be charged, while this trial is still going on. If Simpson, by some miracle is found not guilty of the major charges of this trial, another trial waiting in the wings would be poetic justice...
