Morning All!! :seeya:

I received this e-mail last week. I don't know if y'all watched any of the Spector trial, but if you did you will remember Marta and Loni. Well, they are takin' on OJ:

Dear Starbright,

I have the greatest news!

Marta Waller, from KTLA,will be hosting the OJ Simpson trial with live feed on the internet, again!

In a late Monday afternoon conversation with Marta, she said that she had just been assigned to anchor the OJ Simpson burglary trial and believes that Loni Coombs will be along side her as they give us their legal commentary.

Be sure to sign up, at KTLA, and ask your questions about the trial while chatting with us at Jurorthirteen!

Go to http://www.ktla.com/pages/main and click on Blogs & More. Then continue to the message boards and scroll down to "Trial Talk".

Commentary and live video will begin when opening statements begin.

Spread the news!!!

Addendum:

If you go to the above site. Click on NEWS, scroll down to OJ Simpson, then it will open and you can click there to watch the trial live starting at 8 AM (I am sure that is LA time). Enjoy.

AnnInOhio

As he should be. O.J. has the perfect appeal already unfortunately. No African Americans on the jury.

imo

:flamemad:

Wasn't that the defense's choice? My understanding was that the judge normally, and in this case, wanted ALL of the jurors - including the 2 black alternates - to sit as jurors and to have the alternates picked after the trial prior to deliberation, meaning that OJ COULD have potentially had two black jurors. Am I misunderstanding this?

Good morning everyone! Looking forward to watching this trial with each and every one of you. I am relieved that Judge Jackie
Glass is presiding, she will rule this courtroom with an iron hand, eliminating all the potential nonsense from the defense team, imo.

If the evidence supports it, and I think it will, I am looking forward to seeing simpson going to jail for a long time. IMO. :patriot:

We are not the jury and we are here to post our thoughts and opinions - based on the information we have read already....and the years of watching this thug act up in public and in print since his NG verdict (not to be confused with innocence). THis fella thinks he is above the law and above the judgements against him. Many of us would like him to be corrected about that.

That said, if, after the fact, people want to opine on whether this jury's decision is "right or wrong" discerning what the jury hears and sees versus what is public knowledge makes a difference. That difference is legal justice versus vigilante justice.

AnnInOhio
09-15-2008, 11:31 AM
"Vigilante" would indicate some action or power to actually do something - look it up. We are simply expressing our opinions. It does not affect the outcome of the trial - for instance; Spector would have been put away already if my opinion had any power.

True enough. Let's call it the verdict of public opinion?

http://www.thelegaledge.com./ For live coverage...the chat doesn't look too great tho LMAO

AnnInOhio
09-15-2008, 11:49 AM
That is what it is - and some of the public are here. I will say that OJ sincerely doesn't think he did anything wrong in this instance. (or maybe any other instance) I'm sure he always feels that he is just driven by circumstances to do the things he does. IE: If his women would just act right he wouldn't have the beat the *** out of them.

I wonder what would have happened if he had just asked for his stuff (without guns)?

Or even without a "posse". My guess is that he didn't want to argue about whose "stuff" it was - he knew where it came from. If OJ had a good argument he'd have followed the civil route suggested by law enforcement to Riccio.

AnnInOhio
09-15-2008, 11:58 AM
Which was civil action. If he had followed that course then the civil judgement against him would have kicked in and he would lose the stuff - or the value of it - to his victims' families for sure.
He is not dumb. Well I don't know what is the right word - he's ignorant, but not dumb?

I recall judge Glass having had the same problem coming up with the proper word to describe OJ's actions....

But my main question is; did they do this with the sole intent of getting OJ busted. I have questions about that; and how this tape all came to be in the first place. I think there is a huge possibility that OJ was in a way, tricked into this situation; but he is so lame he fell for it. Too bad so Sad!
I say....

Dots

I think clearly Riccio did just that. He set OJ up to watch him fall and OJ swallowed hook, line and sinker. He knew how OJ would react and by golly, he was right! The co-defendants were just OJ's chumps who followed him right into the trap.

That should make it even more interesting. Why does Stewart have to be tried with OJ? Is it because he didn't plead out or turn state's witness like some of the others?

Because the state would not let him make a deal as the others did. Also state would not let him sever. The legal aspects of this trial will be very interesting.

You mean on TV?? I can't stand how they're always interrupting right in the middle of testimony. And for goodness sake, they close up shop at 3 pm (eastern time) while this court is going to run on until about 6 or 7 pm (eastern time). I think TruTv has really cheated us out of a lot by ending live coverage at 3 pm. Giving us little clips the following day just doesn't cut it for me. I'm wishing we had live coverage until at least 5 pm (eastern) even if that means we have to put up with the likes of Nancy Grace or someone equally annoying.

Simpson also smiles to himself and is talking and muttering under his breath to himself--and not to his lawyers--just to himself--I have noticed that for a long time now--whassup with that?

Many times he does whisper to his lawyers but many other times just mutters to himself. You can see his lips moving like he is talking to himself.

Is he planning his next lie?

Is he showing signs of dementia?

Looking forward to when the witnesses take the stand and from what I gather Defense is going to really try to dirty up their reputations..To me that is somewhat counter-intuitive..as these are the same guys OJ has been associating with for years!..What does that tell you about OJ?..I'd say, in many ways, we are judged by the company we keep!

I think thats why the description by the Pros. of all these people is very important to take all the testimonies in CONTEXT.

Well ... they went in that room armed with guns, ordered everyone against the wall, and took boxes of stuff out of the room. Sounds like an armed robbery to me.

I do wonder if this jury can *REALLY* be impartial, though.

Very true. Armed robbery.
As for 'getting OJ back in prison', I would hope not. But if it happens, I'll be happy. Just so long as the jurors are convicting him of the current crimes and not murder.

Well, it was a robbery, and they were armed, so I guess that's what it is.:)

The prosecution wouldn't have charged if they didn't feel they had a case against him, imo.

No doubt about it, there is a spillover effect from his being accused of the murders in Los Angeles -- but the jurors said they could get past that and look at the facts for *this* case alone, so we'll see how it goes down the road.

Tapes proving exactly what was said, OJ's own words, attempting to make a witness change testimony - this is a slam dunk case. The level of the charges can be questioned, as I see it - but guilt - that's a given. He's right there on tape directing the robbery. And right there on tape trying to tell a witness to say there were no guns. Doesn't matter how he got to that point (although I don't think anyone other than OJ set OJ up - his buddy made a tape either for OJ, or because he wanted proof of what he did and did not do, or because he wanted to make some easy money - but OJ chose what he did).

I do appreciate your need for hearing evidence actually allowed in any trial..but of course you just have to realize the term "Unringing the bell". It just so happen, many here have heard testimony in the preliminary hearing along with media spin..and you are correct, the jury will have to make judgement on WHAT THEY HEAR in court..but many do question lawyers comments that make one scratch their heads..We, here are not jurors..thankfully..so we do and will react..Human Nature!

Having said all that, I also want to comment on many post trial juror's who have commented on such things as.."If I knew that I would have changed my vote"..that can go both ways..and IF evidence is suppressed both legally and non-legally ( hiding inculpatory/exculpitory evidence)..makes some wonder..Right or wrong..it is in the eye of the beholder to make their individual opinion.

Um, if OJ wanted his "stolen" stuff so bad, if getting it right away was so important to him that he couldn't wait to get it thru civil means, why did he have Stewart keep it? Stewart apparently wasn't one of his best buds. How many times was OJ willing to leave his valuables in the care of somebody else? Methinks OJ knew it was "hot" and getting it away from Gilbert/Beardsley/Fromong so they couldn't make money on it was more important than him getting it "back" for any sentimental reason.

I think it may have been a little difficult to carry all that on the plane. Why would Stewart keep it if he knew it was stolen?

and what do YOU think happened....it seems pretty clear to me, in an effort to avoid paying on his judgment, a tip off....(talk about corruption) led oj to have all his valuable things taken out in the middle of the night.....he swore he had no more valuables....therefore...they weren't his things anymore...he disavowed...he disowned....gone...poof...

our system presumes innocence, which means that legally speaking, even the obviously guilty are treated as though they are innocent, until they are proven otherwise.

The concept of the presumption of innocence is one of the most basic in our system of justice. However, in so many words, it is not codified in the text of the Constitution. This basic right comes to us, like many things, from English jurisprudence, and has been a part of that system for so long, that it is considered common law. The concept is embodied in several provisions of the Constitution, however, such as the right to remain silent and the right to a jury.

a few more thoughts about waiting until all the evidence is in on a message board....

1. the attorneys on both sides have taken positions. the paralegals for them have taken positions. the only ones not allowed to are the judge and the jury (maybe not the judge)

2. innocent until proven guilty is a legal concept for the court/justice system only. it does not apply to message boards. if someone wants to stick their neck out and make a premature prediction it is just discussion as we don't make the call.

Didn't OJ think about what he was gonna do with his "stuff" before he went to get it? Stewart's attorney says OJ picked Stewart to participate in part because he had a big vehicle and OJ knew there would be a lot of stuff. I also find it interesting that OJ didn't carry any of his prized possessions out of the hotel - he had everybody else get their hands dirty! Did he really think nobody would dare turn on him when push came to shove?

It's just the paralegal in me I believe in fair trail. I believe in the constitution.I believe in the truth, and a fair trial is one that arrives at the truth. A fair trial that convicts an innocent is wrong, a fair trial that frees the guilty is wrong (although sometimes both are unavoidable). In this case we do have a lot of the evidence, admitted evidence, that is public - the tapes are incontrovertible - they aren't eyewitness testimony that could be wrong, they aren't in question in any way. And from that, a reasonable person may indeed come to their own conclusions.

Innocent until proven guilty in a court of law is a saying with precise and limited application - it applies only to how the jurors are to come to their verdict - nothing else - a juror can even believe a defendant guilty in their hearts (as many have) so long as they will base their verdict on whether or not guilt has been properly proven based on the evidence. I remember many a juror saying after the trial that they thought the defendant guilty - but could not find it as their verdict. IPUG is about one thing, and one thing only - how the jurors are to consider the defendant in the context of rendering their verdict. Nothing else. As many a law journal, judge, and other article writer has explained, over and over again.

I think it may have been a little difficult to carry all that on the plane. Why would Stewart keep it if he knew it was stolen?

The short answer is that Stewart didn't have a choice...OJ just dumped the stolen goods on him (what a pal!) No wonder Stewart was sick...he probably realized he'd been had by OJ - that would leave a sick feeling in anybody's stomach.

It's kinda funny to me that the end result of all this is that OJ STILL doesn't have "his stuff" and never will!
