:patriot:thanks soo much athy (hah - did you forget a letter?)
that's the absolute best news i've heard! . . . we can finally start singing . . . when cesar comes marching home again, hurrah hurrah . . . or should i say oorah!
edit . . . it's also in the jdnews
A Mexican court judge has ruled that Cesar Laurean will be returned to Onslow County, according to information received by the Onslow County Sheriff's Office. Laurean's return could be expected within one week. Federal authorities will handle transporting Cesar Lauren back to the Onslow County Jail.

lol - i'm out of practice here & didn't make the 10 minute edit!
let the confusion begin - again!
dadewey says he won't be back next week and he was . . . quote . . . "blindsided" by Brown's announcement, and based on the information he has, the earliest Laurean could return to face charges in Onslow County is mid-October."
cesar's lawyer is saying . . . "I do not know whether my client will appeal the extradition or not," he said. "But we are at least a month or more away from his return."
it also says cesar has 15 days to appeal the extradition decision that was granted on september 4 . . .

gmorning ivysterling . . . i'm guessing he'll be safely in sbrown's jail before we hear anything. but i'm sure lkay will give us the scoop :) - or, at least the parts of it he wants us to know!
he/lkay did mention on his blog recently that . . . quote: The last sentence in the now infamous note Laurean is said to have left to his wife the morning he fled Onslow County - the one she turned over to authorities - asks her to burn the letter after reading it.
wonder why he's letting that one out of his pocket now? also, it'd be interesting to learn how he "discovered" this little tidbit . . . iirc, that note has not been released by LE.
here's the link to the quote above

"Laurean will not be singled out; he will receive the same humane treatment all the inmates in the jail do," Brown said. "Humans are humans; if you mistreat them for any reason you are not who you are supposed to be."

Well, very interesting. What I have always thought......
If the last line on the “note” instructed Christina to burn it, and she actually had done that, Cesar might be as free as a bird now. She did the right thing by taking the notes to LE, although the personal cost to her has been heavy, both socially, and emotionally.

Hey Martha!
Yes, I think they are going to bring him back and give no prior warning that he is coming. Sheriff Brown is a very fair minded man and he knows that it is his duty to do the right thing when it comes to seeing that Laurean is not harmed. I am sure they will keep him away from the other inmates and he will most likely be put in a cell by himself.
Now the trial? Laurean will just begin to have contact with his lawyer for the first time there so I think it will probably be at least 9 months to a year. Unless Laurean wants to get on with it. He hasn't even been arraigned yet. After then he can opt for a speedy trial. His lawyer has already stated though that Laurean will plead Not Guilty.
Wonder if he is still married and if so will she come to see him and bring their daughter?

Hi, bay!!!
I hope Cesar looks haggard also and that freedom will seem such a distant memory to him! He will have a warm welcome in Onslow County Jail!!! People will still be furious at him and reality will again set in.
Wonder if Christina will take their little girl to visit him? I would think that he will be able to have visitors. When/if he sees his little girl again, I hope he is just eaten up with remembering that all he had to do was keep his pants zipped, go to work every day, come home and enjoy life with his little girl.
But no, Cesar could not do that. Maria and Gabriel are dead. I hope that he never has another peaceful moment as long as he lives!
I wonder how long we are going to have to wait for a trial?

this is the latest that i could find, dated 9/12/08. (emphasis added)
http://sprocket-trials.blogspot.com/2008/09/cesar-laurean-extradition-approved.html
from the article:
DA Dewey Hudson said the earliest Laurean could return to face charges in Onslow County is mid-October, as Laurean could appeal the court decision.
Laurean's court-appointed lawyer, Dick McNeil said he doesn’t know if Laurean will appeal and we are at least a month or more away from his return.

He won't be returning anytime soon....
Laurean fighting extradition
Jacksonville attorney Dick McNeil said his client has filed an extradition appeal in a Mexican court.
Local prosecutors ... but now say the wait could be more than a year.
The Onslow County District Attorney said his office has made inquiries about Laurean's extradition appeal status through the U.S. State Department, but has not received an official reply from Mexican authorities.
"I trust what Dick McNeil says about it. He is a good attorney with a solid reputation," said Dewey Hudson, the district attorney for the 4th Prosecutorial District, which includes Onslow County.
And in news on the DNA front:
Federal investigators have property that contains Laurean's DNA, but were waiting to perform a paternity test when Laurean returns to North Carolina to ensure a clean sample...
However, Ciccarelli told The Daily News on Friday that if the extradition process drags on, NCIS will consider serving a search warrant through Mexican authorities to get a DNA sample from Laurean.
"We need to get this critical investigative step taken care of," Ciccarelli said of the paternity test.
http://www.jdnews.com/news/laurean_59998___article.html/extradition_attorney.html
Also the reporter Lindell Kay has posted that a federal source has told him that Christina Laurean has been denied requests (made by her) to visit her husband in Mexico by the Marine Corps.
So it appears that we are in for a long wait.
Hi everyone. Wish I could have brought better news.

oh crap . . . was just able to get into jdnews & lkay's blog (it's still taking forever to load) . . . lkay posted an update last nite that i wish i hadn't read . . . quote:
Another thing I meant to say is that McNeil said he thinks the Mexican government looks at life without parole (the only sentence allowable for first-degree murder in N.C.) as cruel and unusual punishment. So he doesn’t see the Mexican high court allowing Laurean to be extradited at all.

No, you didn't misread a thing Ms. GPeas. LKay has posted that his "source" (federal-wise) has said the possibility exists that the baby wasn't Laurean's. (And remember she recanted in November 2007 that the baby wasn't his.)
Just my opinion here but I agree with Ivy, NCIS wants a clean sample and it's easier to get the sample directly from Laurean than attempting to obtain some of his DNA sample that's stored in the military databank in Rockville, Md.
Hope you are doing well! LTNS.

Well my goodness what a nice surprise. LTNS Nuttin!:seeya:
Well I cant believe they would wait that long to know their case evidence. A clean sample can certainly be obtained from a toothbrush, hairbrush or even from the steering wheel on his truck. It no longer takes much to get a full DNA sample like it once did. Forensics are getting more fine tuned everyday and really I think if Gabriel is not his child then it will change their theory of the case.
The only thing that I can think of is they did run the sample and it came back not his and they now want to make sure that the profile they have already done is matching up with what they will take from him when he returns, whenever the heck that will be.
For LKs inside sources to even say that then they have to have something (i.e. dna sample) to bring them to that possible conclusion.
JMO tho.

I am beyond anger and disbelief that NC hasn't forged ahead in broadening our fetal homicide law. As it stands now, the baby would have had to taken its first breath outside of the womb in order to constitute a double murder charge.
There have been several attempts to update/change the fetal homicide law, but none have been successful as of yet.
One would think with all the murders of pregnant women in the last several years that NC would move ahead with the times. How many more murders of pregnant women in NC will it take for this change to happen?

Or, if all else fails "God will get him for that!". (remember Maude - way back before Golden Girls?)
Thank you I am with you I hope he gets punished for what he has done and you or right he will not get away with it because God will see to that. The only time I ever seen Maude was on the golden girls. I hope someone will let me know when they bring him back to the usa.:rose:

I live about fifty miles from Jacksonville, NC where the murder occurred. NC makes a lot of people angry about the lack of laws to protect women and children. Yesterday, a newborn baby girl was found dead in a waste dumpster by the garbage man. LE suspects who put the baby into the dumpster. I can guess that nothing will be done about it. The baby was full term with no abnormalities. What a shame. All the mother had to do was take it to a safe haven.

Hi Martha!
The only news I get (and I live in NC) is from periodically checking Lindell's blog.
No word on if she is taking the little girl with her, I think most of the comments lean towards if Christina will even come back to NC and whether the trip is mainly so they can "get their stories straight" prior to his return to NC.
My question is "Why now?" Why is she just now going to see him?
