Not just for any criminal investigation, though. I remember that discussion and it said that it had to meet 2-3 of certain criteria.

I have not been online for a few hrs and have not caught up in this thread, but I do want to answer this.
Has anyone else here done any kind of criminal intake? Where someone reports an alleged crime to you? Or spent any time at all in court listening to witness statememts? Or, in this case, been involved in hearing rape survivors' accounts, in an out of court?
Because I have. I do. And those of you who have known me for a few yrs, know that is the case.
And there are things told to you that sound right and some that don't, right off the bat. As police describe it, you get that hinky feeling. I don't like that expression, but I do think it is descriptive.
ML's account, her actions, the times of reporting, who she reported to, her changing stories, her not being afraid of him, telling her mom she might go to a party where he is---all of that would be wearing out the hinky meter of any professional to whom she told it.
Add to that her history of lying and it just makes it even, well, hikier.
I can tell you that professionally, and in the rape counseling work I have done all my adult life as a volunteer counselor with rape survivors in and out of court, ML's story would have professionals saying oh, this one is going to turn out to be a false accusation.
Then you go ahead and do all the investigating, and all the tests, and all the reporting and all the counseling and, in about 99% of the hinky cases, you find out that your gut was right. [/*]
Daniel, I can't chop this post up as it makes far too much sense in its' entirety and some would be lost if I responded to it cut up. I totally agree with every word here.
There is no book that says false and positive, but there are certain things that will ring true and others that might set off alarms. While all reported allegations are not uniform I have a different theory for what we are seeing in this case.
From my POV we are seeing the alarms going off and when you look at each thing individually, you might find it not so alarming. It is the totality of the alarms coupled with the history of lying that should alert anyone who works with victims tht there is a possibility this may add up to a false allegation.
I think Aloha spoke out in the beginning about the number of false allegations that are caught before they ever become a statistic, as they are filtered out in the ER.
I believe with what we heard from Caejde about the thorough manner her roomies claim was handled in tho it was full of holes too, and what we have been told about Maria's claim, that the USMC did everything they could to help gather evidence to determine if a rape was possible.
I find the USMC was doing a thorough investigation and continue to hope they will reveal their findings.
Maybe tomorrow will be a new day and we will hear Cesar has been apprehended. This forum needs some real news for a change.

Thanks, Candy. I think that people who work with that just get a good idea of what rings true and what doesn't.
Of course, you have to investigate anyhow. But you KNOW.
I missed Aloha's post, but that is, indeed, the case.
A lot are filtered out in the ER. Others get filtered out by magistrates or DA's or any other reporting agency.
The marines did more than any civil jurisdiction I have ever seen in a case that flimsy. Way more.
( My one ITOLDYOUSO moment is that when I first heard, on the news, then on the phone by someone in the Durham judicial system, about the Duke LAX case and just had the gist of what the allegations were, I said 'that's gonna be a false accusation.' Before we found out about the crazy stories and pictures and the boys' alibi's, etc. Just on the first brush of the story. And every other woman I know who works with rape survivors said the same thing)

Thanks, I hadn't seen that.
I hope some poor innocent person didn't get sucked into this crime trying to befriend Cl or CSL. The 1/7 date was about the time IIRC that CL was asked to come in to talk.
(On HIPAA, the privacy rule says a covered entity has to treat a designated "personal representative" the same as the covered individual with respect to uses of personal information with few exceptions (perceived harm, pyschotherpy, etc.) when the patient is still alive and is for health care purposes.
The "personal representative" can also act for a deceased person or the estate.)
I just signed several papers today for vascular surgery next week and went through these specific exemptions. (State law contrary to federal law is preempted.)
http://www.fepblue.org/wasite/wahipaaprivacy/wa-hipaablues_mar06.html#Anchor-hipbluemar06-1
In some cases, a patient will have a personal representative. A personal representative is someone who is speaking for the patient or making medical and health care decisions for patient at a time when he/she cannot make these decisions for themselves. Simply put – a patient can give another person permission to speak for them. This is often through a legal document that the patient has signed. This permission can also be given to a family member or a friend by a court.
If a person has permission from a court or a legal document to act for the deceased person a hospital, doctor or health insurer must talk to the personal representative. If you are acting as a personal representative you have a legal right to the patient's confidential information. This means that the doctor must talk to you about your family member or friend and provide you with any reasonable information you need to do your work for the court or to pay medical bills and other similar work.

IMO, and strictly IMO
IF RS ever came out and said that car was anywhere near Amber's (Christina's sister) from 12/14 until 1/7, I don't see how he can keep calling Christina a "cooperating witness" with a straight face.
That would also strengthen my opinion that the Lowe's guy was indeed Amber's husband.

This means that the doctor must talk to you about your family member or friend and provide you with any reasonable information you need to do your work for the court or to pay medical bills and other similar work. Thanks, Jan - saved me a lot of work! I wonder if ML had signed such a document?

IIRC, I thought that at one point "they" said that her car had been at a fast food place, but then that went away and we heard it was found at the bus station. I don't know if others remember hearing that. Also, of course, I don't know if it was true. If no one else remembers hearing that, maybe I'm just losing it.
